C0RESOLUTTONNO.4-96SETTINGAPUBLICHEARINGONTHEPROPOSEDAPPORTIONMENTOFCOSTSONTHEREALPROPERTYWITHINPARKENTRANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-INTHETOWNOFESTESPARK,COLORADO.WHEREAS,thetotalcostofconstructingandinstallingcertainpublicimprovements,togetherwithnecessaryincidentals,withinParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“Dist-ict”),intheTownofEstesPark,Colorado(the“Town”)hasbeendefinitelyascertainedasofFebruary6,1996;andWHEREAS,theTownsBoardofTrustees(the“Board”)hasdeterminedtoassessthecostofsuchpublicimprovementsandincidentalsagainstthepropertyincludedwithintheDistrictandspeciallybenefitedbysaidimprovements;andWHEREAS,astatementshowingthewholecostoftheimprovementsandincidentalsandtheproposedapportionmentontherealpropertybenefitedtherebyhasbeenpreparedandfiledintheofficeoftheTownAdministratororhisdesignee;andWHEREAS,theTownAdministratororhisdesigneewillcausetobepublishedinanewspaperofgeneralcirculationintheTownanoticetopersonsinterestedgenerallyandtotheownersoftherealpropertytobeassessedspecilingthewholecostoftheimprovements,theproposedapportionmentontherealpropertybenefitedthereby,andthedate,place,andtimesetbytheBoardforhearingwrittenremonstrancestotheproposedapportionment;andWHEREAS,theBoardhasconsideredthespecialbenefitsaccruingtoeachlotintheDistrictbyreasonoftheimprovementsandhasdeterminedthattheapportiomnentofthecostsofsaidpublicimprovementsisinaccordancewithsuchbenefits;THEREFORE,THETOWNOFESTESPARKRESOLVES:1.TheTownAdministratororhisdesigneeisherebyauthorizedtogivenoticethatthewholecostoftheimprovementsandincidentalshasbeenascertainedandthatahearingwillbeheldonittenremonstrancestotheapportionmentofsuchcostontherealpropertywithinth#155733—2— 00 C0District,bypublicationinoneissueoftheEstesParkTrait-Gazette,anewspaperofgeneralcirculationintheTown,suchpublicationbeingmadeatleastfifleen(15)dayspriortothedateofthehearing.ftaddition,thesamenoticewillbemailedbyfirst-classmailtoeachpropertyownertobeassessedforthecostofthepublicimprovementswithintheDistrict.Suchmailednoticewillbemadeonoraboutthedateofthepublicationofthenoticeofhearing.Thenoticeshallbeinsubstantiallythefollowingform:#155733—3— 0NOTICEPUBLICNOTICEOFTHEWHOLECOSTOFTEEPUBLICIMPROVEMENTSTOBEMADENPARKENThANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-1,NTEETOWNOFESTESPARK,COLORADO,ANDOFAHEARINGONWRflTENREMONSTRANCESTOTEEPROPOSEDAPPORTIONIvENTOFSUCHCOSTONTIEREALPROPERTYBENEFITEDBYTEEIMPROVEMENTS.TOALLPERSONSINTERESTEDGENERALLYandtotheownersofpropertytobeassessedforthecostofcertainpublicimprovementswithinParkEntranceEstatesSpecialImprovementDistrictNo.95-1,intheTownofEstesPark,Colorado,noticeisherebygiven:(a)ThetotalcostofconstructingandinstallingimprovementswithintheDisthct,includingcostsofcollectionoftheassessmentsandcrtainotherincidentalcosts,is$460,000,suchcostsbeingattributable$109,614towaterimprovementsand$350,386toroadimprovements;(b)TheportionofthetotalcosttobepaidbytheTownis$20,000,whichamountisentirelyforroadimprovements;(c)TheshareapportionedtoeachlotwithineachofthetwoassessmentunitsintheDistrictisasfollows:AssessmentUnitA*(WaterImprovements)-Totalcosttobeapportioned$109,614:PropertyAssessmentLots1-10,Block2,ParkEntranceEstates,andLot1andOutlotA,KaufthmnMB])S-131-87,andthattactoflanddescribedinBook1575atPage463oftheLarimerCountyClerkandRecorder’srecords(ChittwoodProperty)$8,431.85perlotAssessmentUnitB*(RoadImprovements)-Totalcosttobeapportioned$330,386:PropertyAssessmentLotsI-26,Block1,ParkEntranceEstates,andLots1-10,Block2,ParkEntranceEstates,andLot1andOutlotA,KaufhanMRDS-131-87,#155733—4—
