C0RESOLUTTONNO.4-96SETTINGAPUBLICHEARINGONTHEPROPOSEDAPPORTIONMENTOFCOSTSONTHEREALPROPERTYWITHINPARKENTRANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-INTHETOWNOFESTESPARK,COLORADO.WHEREAS,thetotalcostofconstructingandinstallingcertainpublicimprovements,togetherwithnecessaryincidentals,withinParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“Dist-ict”),intheTownofEstesPark,Colorado(the“Town”)hasbeendefinitelyascertainedasofFebruary6,1996;andWHEREAS,theTownsBoardofTrustees(the“Board”)hasdeterminedtoassessthecostofsuchpublicimprovementsandincidentalsagainstthepropertyincludedwithintheDistrictandspeciallybenefitedbysaidimprovements;andWHEREAS,astatementshowingthewholecostoftheimprovementsandincidentalsandtheproposedapportionmentontherealpropertybenefitedtherebyhasbeenpreparedandfiledintheofficeoftheTownAdministratororhisdesignee;andWHEREAS,theTownAdministratororhisdesigneewillcausetobepublishedinanewspaperofgeneralcirculationintheTownanoticetopersonsinterestedgenerallyandtotheownersoftherealpropertytobeassessedspecilingthewholecostoftheimprovements,theproposedapportionmentontherealpropertybenefitedthereby,andthedate,place,andtimesetbytheBoardforhearingwrittenremonstrancestotheproposedapportionment;andWHEREAS,theBoardhasconsideredthespecialbenefitsaccruingtoeachlotintheDistrictbyreasonoftheimprovementsandhasdeterminedthattheapportiomnentofthecostsofsaidpublicimprovementsisinaccordancewithsuchbenefits;THEREFORE,THETOWNOFESTESPARKRESOLVES:1.TheTownAdministratororhisdesigneeisherebyauthorizedtogivenoticethatthewholecostoftheimprovementsandincidentalshasbeenascertainedandthatahearingwillbeheldonittenremonstrancestotheapportionmentofsuchcostontherealpropertywithinth#155733—2— C0District,bypublicationinoneissueoftheEstesParkTrait-Gazette,anewspaperofgeneralcirculationintheTown,suchpublicationbeingmadeatleastfifleen(15)dayspriortothedateofthehearing.ftaddition,thesamenoticewillbemailedbyfirst-classmailtoeachpropertyownertobeassessedforthecostofthepublicimprovementswithintheDistrict.Suchmailednoticewillbemadeonoraboutthedateofthepublicationofthenoticeofhearing.Thenoticeshallbeinsubstantiallythefollowingform:#155733—3—
