Home My WebLink AboutRESOLUTION 16-97ccRESOLUTIONNO.16-97BEINGARESOLUTIONESTABLISHINGAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIMEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEAPRIL1,1998.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911’tEmergencyTelephoneService,datedNovember14,1990,betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishcertainchargesforemergencytelephoneaccesstobeassesedtelephoneserviceusersintheTownofEstesPark;andWHEREAS,byresolution,theTownofEstesParkmostrecentlyapprovedatelephoneexchangeaccessfacilitychargeofforty-fivecents($.45)permontheffectiveJanuary1,1998;andWHEREAS,atitsmostrecentregularsession,theColoradoLegislatureenactedSenateBill97-132inrecognitionoftheincreasednumberofwirelesstelephoneserviceusersinthestateofColoradoandtoimplementprovisionsforgoverningbodiestoadoptaccessfacilitychargesforwirelessserviceusersinamannerandinanamountconsistentwiththetelephoneexchangeaccessfacilitychargereferredtoabove;andWHEREAS,SenateBill97-132providesthatanyaccessfacilitychargeassesseduponwirelessserviceusersshallbeexpendedforthepurposeofallowingpublicsafetyansweringpointstomakechangesinandadditionstoexistingequipmenttoallowwirelessserviceuserstoreceivethesamelevelofemergencytelephoneserviceaswirelineserviceusers;andWHEREAS,thenumberofwirelesstelephoneusersinLarimerCountyasawholeandintheTownofEstesParkspecificallyhasexpandeddramaticallysincetheoriginalcreationoftheLarimerEmergencyTelephoneAuthority;andWHEREAS,theLarimerEmergencyTelephoneAuthorityischargedbystatuteandintergovernmentalagreementwiththeobligationofprovidingemergencytelephoneservicestowirelessserviceusersaswellaswirelineservicesusers;and 00 00WHEREAS,inorderfortheLarimerEmergencyTelephoneAuthoritytoprovidesuchservicesasintendedbySenateBill97-132,theBoardofTrusteesdeemsthatitisnecessaryandappropriatethatawirelessaccessfacilitychargebeimposeduponwirelessserviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesfindsthattheaforesaidfacilitychargeshouldbesetattherateofforty-fivecents($.45)perwirelesslinepermonth;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonApril1,1998,awirelessserviceuseraccessfacilitychargeshallbeestablishedattherateofforty-fivecents($.45)permonthperwirelesslineuseraccessfacility.2.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollecttheaccessfacilitychargeinaccordancewith§29-11-100.5,etseq.,C.R.S.Uponmptiondulymadesecondedandcarried,theforegoingResolutionwasadoptedthisdayof/Lc’%kJ,1997.TOWNOFESTESPARK,COLORADOMayorATTEST:.TownClerk 00
