15-970CRESOLUTIONNO.15-97WHEREAS,theTownofEstesParkistheowneroftheHondiusCascadePipeline;andWHEREAS,thewaterrightfortheHondiusCascadePipelinewasdecreedonNovember14,1939,acopyofwhichisattachedheretoasExhibitAandincorporatedhereinbyreference;andWHEREAS,in1922,theLawnLakeFlooddamagedtheHondiusCascadePipelineandtheHydroPlantlocatedattheeasternterminusofthepipelineandthehydropowerwaterrighthasnotbeenexercisedsincethattime;andWHEREAS,onJuly28,1997theTownofEstesPark,thePlatteRiverPowerAuthority,theUnitedStatesofAmericaactingbyandthroughtheNationalParkService,andtheBureauofReclamation,enteredintoaMemorandumofUnderstandingregardingtheuseandoperationoftheFallRiverHydroPlant;andWHEREAS,intheMOUtheTownagreestoabandonitsHydroPowerwaterrightfortheHondiusCascadePipeline;andWHEREAS,theTownownsadditionalwaterrightsonFallRiver,thosebeingtheEstesParkCascadeDiversionandtheEstesParkCascadeDiversionEnlargementadjudicatedonMarch23,1993whicharenotaffectedbytheMOU,northisResolution;NOW,ThEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado:1.TheTownofEstesParkherebypermanentlyabandonsandrelinquishesanyright,titleandinterestitmayhavetothehydropowerwaterrightbeingPowerPriorityNo.1asofNovember10,1908andPowerPriorityNo.3asofJune30,1919fortheHondiusCascadePipelineasmorefillysetforthonExhibitAattachedheretoandincorporatedhereinbyreference.2.Thisabandonmentandrelinquishmentofthehydropowerwaterrightdoesnotaffectinanymanner,theTownofEstesPark’sadjudicatedwaterrightfortheEstesParkCascadeDiversionfor1.55CFSwiththeappropriationdateofDecember31,1959andanadjudicationdateofMarch23,1993and
