CCRESOLUTIONNO.4-98ARESOLUTIONREVISINGTHEFINALTOTALCOSTOFTHEPUBLICIMPROVEMENTSMADETNPARKENTRANCEESTATESSPECLkLIMPROVEMENTDISTRICTNO.95-1,INTHETOWNOFESTESPARK,COLORADO;ADJUSTINGANDREDUCINGTHESHAREOFSAIDCOSTASSESSEDAGAINSTEACHLOTTNTHEDISTRICT;ANDRATIFYINGTHEMANNERFORTHECOLLECTIONANDPAYMENTOFSAIDASSESSMENTS.WHEREAS,byOrdinanceNo.12-95,finallypassedandadoptedonAugust8,1995,theBoardofTrustees(the“Board”)oftheTownofEstesPark,Colorado(the“Town”),createdParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“District”),forthepurposeofpayingforpublicimprovementstobeconstructedintheDistrict;andWHEREAS,thetotalcostofsuchpublicimprovementswasdefinitelyascertainedinaccordancewithstatestatutes;andWI-IEREAS,suchtotalcostwasdulyandlawfullydeterminedtobe$460,000,less$20,000whichwaspaidbytheTowntoreflectthegeneralbenefitprovidedbysuchimprovementstotheTown.leaving$440,000tobeassessedagainsttherealpropertyspeciallybenefitedandincludedwithintheDistrict;andWHEREAS,theBoardapportionedashareofsuchcosttoeachlotintheDistrict,inaccordancewiththebenefitstobederivedbysaidpropertyandpreparedanassessmentrollshowingtheshareattributedtoeachsuchproperty;andWHEREAS,theBoarddulyadoptedOrdinanceNo.5-96(the‘AssessmentOrdinance”),approvingandconfirmingsuchapportionmentofsaidtotalcosttopropertieswithintheDistrictreceivingspecialbenefitfromtheconstructionofthepublicimprovements;andWHEREAS,theBoarddirectedtheTownTreasurer/FinanceOfficertocollectamountspayableinaccordancetherewith;andWHEREAS,ownersof23assessedpropertieshavepaidtheassessmentsonsuchpropertiesinfullonorbeforethedateofthisResolution;andWHEREAS,ownersof14assessedpropertieselectedtopayandnowarepayingtheassessmentsontheirpropertiesinten(10)annualinstallments,withinterest;and3S21452 00 CCWHEREAS,theconstructionoftheimprovementsintheDistrictnowhasbeencompletedandallcostshavenowbeenpaidbytheTown;andWHEREAS,thetotalcostofsuchimprovementsactuallywaslessthanthedefinitelyascertainedcostof$460,000;andWHEREAS,theBoardhasdeterminedandherebydeterminesthatitisinthebestinterestoftheinhabitantsoftheDistricttoadjustandreducetheassessmentswhicharepayableininstallmentsbycurrentpropertyownerswithintheDistrictonaproratabasistoreflectsuchreductioninthetotalcostoftheimprovementsandtoreducetherateofinterestthereon;andWHEREAS,theBoardhasdeterminedandherebydeterminesthatitisinthebestinterestoftheinhabitantsoftheDistricttoreffindaportionoftheassessmentswhichhavebeenpaidinff11onaproratabasistocurrentpropertyownerstoreflectsuchreductioninthetotalcostoftheimprovements;andWHEREAS,thesingleholderofcertainspecialassessmentbondsoftheTownissuedtofinancetheimprovementswithintheDistricthasagreedtothereductioninassessmentsinwriting;andWI-JEREAS.itisnecessary’fortheBoard:(i)toauthorizesuchadjustmentandreductionintotalcostbylegislativemeasure;(H)toapproveandconfirmrefundstocurrentownersofpropertiesforwhichassessmentshavebeenpaidinfull;(Hi)toapproveandconfirmanamendedassessmentrollforcurrentownersofpropertiesforwhichassessmentsarebeingpaidininstallments;and(iv)toratifythetermsandprovisionsoftheAssessmentOrdinance;NOWTHEREFORE,THETO’WThJOFESTESPARK,COLORADORESOLVES:Section1.ConfirmationofAdjustedandReducedCostsandAssessments.TheadjustedandreducedtotalandfinalcostoftheimprovementsintheDistrictisherebyapprovedandconfirmedasofMarch10,1998.TheBoardherebyadjustsandreducestheshareofsaidcostassessedtoanduponeachlotwithintheDistrict.SaidapportionmentisherebydeclaredtobeinaccordancewiththespecialbenefitswhichthepropertyintheDistrictreceivedbyreasonoftheconstructionofsaidimprovements.Section2.AssessmentsPaidinInstallments.Currentownersofthe14propertiesforwhichassessmentsarebeingpaidovertimeshallpaythereducedannualinstallmentssetforthon#382445-3 00 00ExhibitA,attachedheretoandincorporatedhereinbythisreference,tocorrectfortheadjustedandreducedassessmentamounts.Section3.AssessmentsPaidinFull.Currentownersofthe23propertiesforwhichassessmentswerepaidinftllpriortothedateofthisResolutionshallreceiveproratedamountsincashtocorrectfortheadjustedandreducedassessmentamounts.AscheduleshowingsuchamountapplicabletoeachpropertyindividuallyisattachedheretoasExhibitBandincorporatedhereinbythisreference.Section4.PaymentofAssessments.TheBoardherebydirectstheTownTreasurer/FinanceOfficertocollectallofthereducedamountsnowpayableininstallmentsasanassessmentundertheAssessmentOrdinancepursuanttoSection31-25-526(1),ColoradoRevisedStatutes.TheassessmentsshallbedueandpayableattheofficeoftheTownTreasurer/FinanceOfficeratthesametimeandinthesamemannerassetforthintheAssessmentOrdinance.Section5.WaiverofObjections.PursuanttothetermsoftheAssessmentOrdinance,allpersonselectingtopayininstallmentsshallconclusivelybeconsideredtohaveconsentedtosaidimprovements.SuchelectionshallconclusivelybeconsideredtobeawaiverofanyrighttoquestionthepowerorjurisdictionoftheTowntoconstructtheimprovements,thequalityofthework,theregularityorsufficiencyoftheproceedings,thevalidityorthecorrectnessoftheassessments,orthevalidityofthelienthereof.Section6.Installments.TheremainderofsaidinstallmentsshallbedueandpayablesuccessivelyonorbeforeApril15ofeachyearthereafteruntilpaidinfull,withinterestontheunpaidprincipal.Therateofsuchinterestontheassessmentswasadoptedat6.750%butwillnowbecalculatedat5.00%oftheprincipalamountoutstandingoneachassessment.InteresthasaccruedatthelowerratefromApril16,1997.Thetenth(10th)andlastinstallmentwillbedueandpayableonApril15,2006.Theownerofanypropertynotindefaultastopaymentofanyinstallmentorportionthereofmayatanytimepaythewholeoftheunpaidprincipalwiththeinterestaccruingtothematurityofthenextinstallment.Section7.PenaltyforDefaultorNon-Payment.Failuretopaythewholeamountofanyinstallmentwhenduealsoshallcausethewholeoftheunpaidprincipalofandinterestontheassessmentamounttobecomedueandcollectibleimmediately.Thewholeamountofanysuchunpaidprincipalandtheaccruedinterestthereonshall,aftersuchpropertysaleorsuchfailuretopay#3824454 00 CCaninstallment,drawinterestattherateestablishedpursuanttoSection5-12-106(2)and(3),ColoradoRevisedStatutes,untilthedateofforeclosuresaleortaxsale.Inthecaseoffailuretopayanyinstallmentorportionthereof;atanytimepriortothedateofforeclosuresaleortaxsaletheownermaypaytheamountofallunpaidinstallmentswithinterestatsaidpenaltyratepermonthorfractionofamonthandallotherpenaltiesandcostsofcollectionaccrued,andshallberestoredtotherightthereaftertopayininstallmentsinthesamemannerasifthedefaulthadnotbeensuffered.Section8.AssessmentLien.AllassessmentsleviedagainsttherealpropertyintheDistrict,togetherwithallinterestthereonandpenaltiesfordefaultinpaymentthereof;andallcostsincollectingthesame,shallconstitute,fromthedateofthefinalpublicationoftheAssessmentOrdinance,aperpetuallienintheseveralamountsassessedagainsteachlotortractofland.Suchlienshallhavepriorityoverallotherliensexceptgeneraltaxliens,andshallbeenforcedinaccordancewiththelawsoftheStateofColorado.Section9.RatificationofAssessmentOrdinance.ThetermsandprovisionsoftheAssessmentOrdinanceareherebyratifiedandconfirmedintheirentiretyexceptinsofarastheadjustmentandreductionofassessmentsauthorizedinthisResolutionshallmodi&anysuchtermsandprovisions.Section10.Severability.IfanyoneormoresectionsorpartsofthisResolutionshallbeadjudgedunenforceableorinvalid,suchjudgmentshallnotaffect,impair,orinvalidatetheremainingprovisionsofthisResolution,itbeingtheintentionthatthevariousprovisionshereofareseverable.Section11.Repealer.Allacts,orders,resolutions,ordinances,orpartsthereof;inconflictwiththisResolution,areherebyrepealed.Section12.RecordingandAuthentication.ThisResolution,immediatelyonitspassage,shallberecordedinthecustomarymannerforTownResolutionsandshallbeauthenticatedbythesignaturesoftheMayorandTovnClerk.Section13.EffectiveDate.ThisResolutionshallbeeffectiveimmediatelyuponitsadoptionbytheBoard.#3824455
