00RESOLUTIONNO.22-98ARESOLUTIONAPPROVINGESTESPARKMUNICIPALCOURTPARTICIPATIONINTHECOMMUNITYSERVICECHRISTMASSPECIALPROGRAM.WHEREAS,theTownBoarddesirestorecommendtheparticipationoftheEstesParkMunicipalCourtintheCommunityServiceChristmasSpecialProgramtobenefitneedychildrenwithintheTown.WHEREAS,withinthediscretionoftheMunicipaljudge,trafficoffenderswhopayforcitationsduringaonemonthperiodofNovember11toDecember11,1998,wouldbepermittedtodonatetheequivalentsumofanytrafficfinesimposedbytheMunicipalCourtincashorinkindtotheEstesParkBrightChristmasProgramlocatedwithintheTown.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOASFOLLOWS:Section1.Approval.TheparticipationoftheEstesParkMunicipalCourtintheCommunityServiceChristmasSpecialProgramtobenefitneedychildrenintheTownisherebyapproved,subjecttothefollowingguidelines:1.TheMunicipaljudge,inhissolediscretion,shallrequestthattrafficoffenders,uponentryofapleaofguiltytoatrafficoffenseandtheimpositionofrelatedfinesbytheCourt,bepermittedtodonatetheequivalentsumofsuchfines,incashorinkind,toEstesParkBrightChristmasinlieuofpaymentofsuchfinestotheTown.2.Notwithstandinganysuchdonationinlieuoftrafficfines,anytrafficdefendantshallremainresponsibleforthepaymentoftheCourtCosts,asimposed.3.CashdonationsinlieuoftrafficfinesshallbemadepayabletoEstesParkBrightChristmas.4.InkinddonationsinlieuoftrafficfinesshallbeinapurchaseamountnotlessthantheCourtimposedtrafficfines,andshallbedelivereddirectlytotheTownofEstesParkBrightChristmas.TheTownshallnotbeliableforcreditorrepaymentofanypurchaseamountinexcessofCourtimposedtrafficfines.ThedefendantshallberesponsiblefordeliveryofproofofreceiptofinkinddonationstotheEstesParkMunicipalCourtClerk. 00 005.CharitabledonationsshallbenefitEstesParkBrightChristmasandneedychildrenwhoresideintheTown.6.Townparticipationintheprogramshallnotexceedthedonationofmorethan$2,500oftrafficfines,incashorinkind,toEstesParkBrightChristmas.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKONTHIS3?qDAYOF______________,1998.?vIayor—ATTEST:CTownClerk 00
