Home My WebLink AboutRESOLUTION 21-99.coCoRESOLUTIONNO.21-99WHEREAS,Section31-11-111(4)C.R.S.providesthatanyprotestconcerningaballottitleshallbeconductedasprovidedbylocalcharter,ordinance,orresolution;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkpursuanttothetermsandconditionsofthisresolutionestablishesaprocedureforprotestofanyballottitleforaninitiatedordinanceorreferendumfiledwiththeTownpursuanttotheprovisionsofArticle11ofTitle31,C.R.S.NOW,THEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado:1.AnyregisteredelectoroftheTownofEstesParkorthepersonsdesignatedasrepresentinganinitiatedordinanceorreferendumpetitionmayfilewiththeTownClerkawrittenprotestoftheballottitlefollowingthefixingofaballottitlebytheBoardofTrusteesoftheTownofEstesParkoritsdesignee.2.Theprotestshallbeinwritingandshallspecifythegroundsfortheprotest.3.Theprotestshallbefiledwithin3calendardaysfollowingthefixingoftheballottitle.4.Ifaprotestisfiled,theTownBoardshallreviewtheprotestataregularorspecialmeeting.ThepersonsubmittingtheprotestshallbegivenwrittennotificationofthereviewbytheTownBoardandanopportunitytobeheardbeforetheTownBoardconcerningtheprotest.5.TheTownBoardreviewoftheprotestshallbelimitedtowhetherornottheballottitlefairlyreflectstheproposedinitiativeorreferendumsothatvoterswillnotbeclearlymisledinsupportfororagainstthepropositionbyreasonofwordsusedintheballottitle.Adoptedthis___________dayof,1999.AHEST:PARKoTownClerk c2
