RESOLUTION 36-01
CCRESOLUTIONNO.36-01WHEREAS,theTownofEstesPark,Coloradoisauthorizedtoadoptbenefitplans,theTownherebyadoptsthefollowingmeasuresasaformalaction.WHEREAS,theTownmakesgrouphealthinsurancebenefitsavailableforitsemployees,andpaysaportionofthepremiums;andWHEREAS,theTowndesirestoallowitsemployeestoparticipateinamedicalexpensereimbursementplan(MERP)andadependentcareplan(DCP)assetforthintheTownofEstesPark’sCafeteriaPlan(withPremiumPayment,MERPandDCPcomponents)(the“Plan”);andWHEREAS,theTownwishestoadoptaSalaryReductionPlanthatcomplieswithSection125oftheInternalRevenueCode,toenableitsemployeestoelecttopayfortheirshareofthegrouphealthinsurancepremiumsandentirepremiumsforMERPandDCPbenefitsonapre-tax,salaryreductionbasis;andWHEREAS,theTowndeterminesthattheaboveactionsareinthebestinterestsoftheTownofEstesPark.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOthattheBoardherebyadoptsthePlan(consistingofthePlandocument,andcomponentbenefitplansandpolicies)asamendedandrestated,effectiveasofJanuary1,2002.BEITFURTHERRESOLVED,thattheoperationofthegroupinsuranceplanwillcontinueandallemployeecontributionsthereunderwillbemadepursuanttoelectionsundertheCafeteriaPlandocument.BEITFURTHERRESOLVED,thattheCafeteriaPlan,togetherwithitscomponentplans,willbeconsideredoneplanfor(ifapplicable)ERISApurposes,includingreportinganddisclosure(butforCOBRApurposes,theMERPandHealthPremiumcomponentswillbeconsideredseparateplans).INTRODUCED,READ,ANDPASSEDYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthis/tdayof,2001.TOWNOFESTESPARK,COLORADOATTEST:•TownClerk 00
