00RESOLUTIONNO.18-02WHEREAS,acomplaintbytheEstesParkPoliceDepartmentwaspresentedtotheTrusteesoftheTownofEstesParkonAugust13,2002chargingLABProperties,Inc.,dbaOLDGASLIGHTPUB,aHOTEL&RESTAURANTLIQUORLICENSE,LIQUORLICENSENO.02-52787-0000withcertainviolationsofthestatutesoftheStateofColoradoandRulesandRegulationsoftheColoradoDepartmentofRevenue,LiquorEnforcementDivision;andWHEREAS,theBoardofTrusteesherebydeterminesthatthereisprobablecausetobelievethattheaforementionedLicenseehasviolatedoneormoreofthestatutesand/orrulesandregulationsgoverningtheoperationsofthelicenseasmorefullysetforthinthecomplaint;andWHEREAS,theBoardbelievesitisnecessarytoholdahearingandissueanOrdertoShowCausewhytheaforementionedlicenseshouldnotbesuspendedorrevokedduetotheviolationspresentedtotheBoard.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKCOLORADO:Section1.ThatashowcausehearingshallbeheldpursuanttoSection1247-601,CR5.,andaNoticeofHearingbeissuedtotheLicenseetoappearandshowcausewhythelicenseshouldnotbesuspendedorrevoked.SaidhearingshalltakeplaceattheTownBoardmeetingscheduledTuesday,August27,2002at7:00p.m.intheBoardRoomoftheEstesParkMunicipalBuilding,170MacGregorAvenue,EstesPark,Colorado.Section2.ThattheTownClerkshallcauseanOrdertoShowCauseandNoticeofHearingontheaforementionedcomplainttobemailedtothefollowing:LABProperties,Inc.dbaOLDGASLIGHTPUB246MoraineAve.P.0.Box3032EstesPark,CO80517INTRODUCED,READANDPASSEDTHIS/SDAYOF________2002.TOWNOFESTESPARKATTEST:TownClerk 00
