HomeMy WebLinkAboutRESOLUTION 11-0400RESOLUTIONNO.11-04WHEREAS,theServicePlanfortheproposedEstesParkFireProtectionDistrictwasfiledinLarimerCounty,Colorado,onApril1,2004;andWHEREAS,theServicePlanwasapprovedbytheLarimerCountyBoardofCommissionersonJune12004;andWHEREAS,aPetitionhasbeenfiledintheDistrictCourt,LarimerCounty,Colorado,requestingformationoftheEstesParkFireProtectionDistrict;andWHEREAS,aHearingonsaidPetitionhasbeensetforAugust2,2004;andWHEREAS,itisanticipatedthattheDistrictCourtwillrefertheformationoftheEstesParkFireProtectionDistricttotheeligibleelectorsoftheDistrictatthegeneralelectionofNovember2,2004;andWHEREAS,asapartoftheformationoftheEstesParkFireProtectionDistrict,theeligibleelectorswillbeaskedtoapproveamilllevyof3.5millstofundtheoperation,includingcapitalexpenditures,oftheEstesParkFireProtectionDistrict;andWHEREAS,iftheEstesParkFireProtectionDistrictisapprovedbytheeligibleelectorsoftheDistrict,adisproportionateshareoftherealpropertytaxeswillbepaidbyownersofcommercialpropertiesduetotheprovisionsoftheGallagherAmendmenttotheColoradoConstitution(residentialpropertyisassessedat796%ofmarketvalueandcommercialpropertyisassessedat29%ofmarketvalue);andWHEREAS,itistheopinionoftheBoardofTrusteesoftheTownofEstesParkthattheTownshouldlessentheimpactofthedisproportionatepaymentofrealpropertytaxesforthefundingoftheEstesParkFireProtectionDistrictbycommercialpropertyownersintheTown;andWHEREAS,itistheopinionoftheBoardofTrusteesthattheTownenactapolicytoreimburseownersoftaxablecommercialrealandpersonalpropertylyingwithintheboundariesoftheTownofEstesParkinanamountequaltothedifferencebetweentheassessedrateofresidentialandcommercialproperty;andWHEREAS,itistheopinionoftheBoardofTrusteesthatsaidreimbursementshallcontinueforaperiodofthree(3)years1 00 o0NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:1.IftheEstesParkFireProtectionDistrictisapprovedbyavoteoftheeligibleelectorsoftheDistrictandamilllevyof3.5millsisimposeduponallrealandpersonalpropertylocatedwithintheEstesParkFireProtectionDistrictforpaymentinthecalendaryearsof2005,2006and2007,theTownshallreimburseanyownerofcommerciallyassessedrealand/orpersonalpropertypayingsaidpropertytaxlocatedwithintheboundariesoftheTownofEstesParkanamountequaltothedifferencebetweenthepropertytaxpaidonacommerciallyassessedpropertyandpropertyassessedattheresidentialrate.2.TheappropriateofficialsandstaffoftheTownofEstesParkareherbyauthorizedtotakealladministrativeactionsnecessarytocarryoutthetermsandconditionsofthisResolutionincluding,butnotlimitedto,developmentofaprogramforreimbursementoftaxespaidforthecalendaryearsof2005,2006and2007,andmakingappropriateadjustmentintheTown’sBudgetfortheyears2005,2006and2007.3.TheTownBoardshallreviewthisrebateprogramin2007forpossibleextensionoftherebateprogram.Datedthiso’7dayof_ __ _ ___ ___ _ __ _ ___ _ ,2004.ATTEST:C—TownClerk2 o0-S.’.
