Home My WebLink AboutRESOLUTION 09-050RESOLUTIONNO.9-05BEINGARESOLUTIONSUBMITTINGTOTHEREGISTEREDELECTORSOFTHETOWNOFESTESPARK,COLORADO,ATASPECIALELECTIONTOBEHELDONTUESDAY,AUGUST2,2005,THEQUESTIONOFWHETHERTHETOWNOFESTESPARKSHALLFORMAHOMERULECHARTERCOMMISSIONAND,IFTHEFORMATIONOFTHECHARTERCOMMISSIONISAPPROVEDBYTHEVOTERS,PROVIDINGFORTHEELECTIONOFFIFTEENAT-LARGEMEMBERSTOTHECHARTERCOMMISSION.WHEREAS,theBoardofTrusteesoftheTownofEstesPark,Colorado,approvedOrdinanceNo.5-05initiatingtheadoptionofahomerulecharterandprovidingfortheelectionofchartercommissioners;andWHEREAS,theSection31-2-204(2)C.R.S.requiresthat,withinthirty(30)daysofadoptingsuchanordinance,theBoardofTrusteesmustcallanelectiononwhethertoformahomerulechartercommissionandelectingchartercommissionmembers;andWHEREAS,Section31-10-401,CR5.,allowstheBoardofTrusteestodelegatetotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThataspecialmunicipalelectionshallbeheldfortheregisteredelectorsoftheTownofEstesPark,Colorado,onTuesday,August2,2005.AtsuchelectionthereshallbesubmittedtosuchelectorsthequestionofwhethertheTownofEstesParkshallformahomerulecommissionandtheelectionoffifteen(15)at-largememberstothecommissiontotakeofficeiftheformationofthechartercommissionisapprovedbytheelectors.1 00 002.Thatballotquestionshallreadasfollows:ShalltheTownofEstesPark,Coloradoformahomerulechartercommission?czYesDNo3.Thattheballotshallalsoprovidefortheselection,byeachregisteredelector,offifteen(15)memberstothechartercommission,electedat-large,totakeofficeiftheformationofthechartercommissionisapprovedbytheelectors;andthattheballotshalllistallproperlyqualifiedcandidateswhoaredulynominatedbytimely-filedpetitions.4.ThatthegjypollingplaceshallbeintheMunicipalBuilding:Rooms202-203,MunicipalBuildingforpollingplacevoting,August2,2005(electionday),170MacGregorAve.,EstesPark,Colorado.5.ThatthepollsonElectionDayshallbeopenfrom7:00am.-7:00p.m.6.ThattheGlobalElectronicVotingSystem“ACCUVOTE”shallbeusedinthemunicipalelectionandthattheTownClerkbeandisherebyauthorizedanddirectedtoperformallactsandfunctionsnecessaryfortheuseofsuchvotingequipmentasrequiredbythelawsoftheStateofColoradopertainingthereto.7.ThatpursuanttoSection31-10-401,C.R.S.,1973,theBoardofTrusteesdelegatestotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection.8.ThattheJudgesofElectionshallreceivefortheirservicesthesumof$10.00/ea.forJudgesTrainingSchool,$100.00/ea.onElectionDay,and$10.00/hr.foranyJudgesoassignedasdeemednecessarybytheClerk.9.ThattheTownClerkofEstesParkcomplywithalloftheapplicableprovisionsoftheColoradoMunicipalElectionCodeof1965,asamended,andtheMunicipalHomeRuleAct,andisherbyauthorizedtotakeallsuchactionsasmaybenecessarytoconducttheelectionontheabove-statedballotquestionandselectionofchartercommissionmembers,andtomakesuchpublicationsasmaybenecessary.2 00 00DATEDthis____________dayof___________________________2005.TOWNOFESTESPARKATTEST:cn1TownClerk3 o0
