Home My WebLink AboutRESOLUTION 07-0500RESOLUTIONNO.7-05ARESOLUTIONORDERINGANDRESCHEDULINGARECALLELECTIONFORTHETOWNOFESTESPARKWHEREAS,aPetitionwasfiledwiththeTownClerktorecallTrusteeDavidHabeckerfromtheBoardofTrustees;andWHEREAS,inaccordancewithSection314-503(4)C.R.S.,theTownClerksubmittedthePetition,alongwithacertificateofsufficiencytotheBoardofTrusteesonDecember14,2004;andWHEREAS,pursuanttotherequirementsofSection31-4-503(4)C.R.S.,theTownBoardonDecember14,2004settheRecallElectiononthePetitionforTuesday,February15,2005;andWHEREAS,onJanuary28,2005,DavidHabeckerfiledalawsuitintheUnitedStatesDistrictCourtfortheDistrictofColoradonamingasDefendantsamongothers,theTownofEstesPark,Colorado,theBoardofTrusteesoftheTownofEstesPark,Colorado,JohnBaudekMayor,andVickieO’ConnorTownClerk(theTownDefendants);andWHEREAS,aspartofthelawsuit,thePlaintifffiledaMotionforPreliminaryInjunctionrequestingthattheCourtenteranOrderenjoiningtheDefendantsfromconductinganelectiontorecallPlaintiffasTownTrustee;andWHEREAS,onFebruary10,2005,JudgeNottinghamenteredanOrderenjoiningtheDefendantsfromconductinganelectiontorecallDavidHabeckerasTownTrusteeuntilfurtherorderoftheCourt;andWHEREAS,followingthefilingofaMotiontoReconsidertheCourt’sActionbyDefendantsNormanD.PritchardandRichardH.Clark,afurtherhearingontheMotionforPreliminaryInjunctionwasheldonMarch2,2005;andWHEREAS,atthatHearingJudgeNottinghamdissolvedthepreviouslyenteredInjunctionenjoiningtheDefendantsfromholdingtheRecallElection;andWHEREAS,duetothePreliminaryInjunctionenteredbyJudgeNottinghamonFebruary10,2005,anddissolvedbyJudgeNottinghamonMarch2,2005enjoiningtheDefendantsfromholdingtheRecallElection,thetimeperiodsetforthinSection314-503(4),C.R.S.forholdingarecallelectionistolledfortheperiodoftimebetweenFebruary10,2005andMarch2,2005;and1 00 00WHEREAS,Section31-4-504(2)CR5.providesthatatleasttendaysbeforearecallelectiontheClerkshallgivenoticeoftheelectioninaccordanceofSection31-10-501C.R.S.;andWHEREAS,pursuanttoSection31-10-108C.R.S.allrecallelectionsshallbeheldonaTuesdaydesignatedbyResolutionoftheBoardofTrustees;andWHEREAS,duetothetollingofthetimeperiodforholdingarecallelection,therequirementtogivenoticeatleasttendaysbeforearecallelection;andthatarecallelectionmustbeheldonaTuesday,thedatesofMarch22,2005andMarch29,2005areavailableforthereschedulingoftheRecaHElectiontorecallTrusteeDavidHabeckerpursuanttotheRecallPetition;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisnecessaryandappropriatetorescheduletheRecallElectionfollowingthedissolvingofthePreliminaryInjunctionenjoiningtheDefendantsfromconductingtheRecallElectiononFebruary15,2005;andWHEREAS,Section31-10-401CR5.allowstheBoardofTrusteestodelegatetotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,thattheRecallElectionfortherecallofTrusteeHabeckershallberescheduledforTuesday,MarchcM,2005.BEITFURTHERRESOLVEDthattheonlypollingplaceshallbeinRooms202-203oftheMunicipalBuilding,170MacGregorAve.,EstesPark,Colorado;andthatthepollsonelectiondayshallbeopenfrom7:00a.m.—7:00p.m.BEITFURTHERRESOLVEDthatanelectronicvotingsystemshallbeusedintheRecallElectionandthattheTownClerkbeandisherebyauthorizedanddirectedtoperformallactsandfunctionsnecessaryfortheuseofsuchelectronicvotingsystemasrequiredbythelawsoftheStateofColoradopertainingthereto.BEITFURTHERRESOLVEDthatpursuanttoSection31-10-401C.R.S.,theBoardofTrusteesherebydelegatestotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection.BEITFURTHERRESOLVEDthattheRecallElectionshallbeconductedinaccordancewiththeColoradoMunicipalElectionCodeof1965,asamended,andtheapplicableprovisionsofSections31-4-501through31-4-507C.R.S.2 00 02BEITFURTHERRESOLVEDthatthattheTownClerkshallpreparetheballotinaccordancewithSection31-4-504(3)(a),(b),and(c)C.RS.BEITFURTHERRESOLVEDthattheTownClerkbeauthorizedtogiveNoticeoftheRecallElectionbypublicationasprovidedbySection31-10-501C.R.S.BEITFURTHERRESOLVEDthattheTownClerkshall,attheexpenseoftheTown,arrangeforsuchmaterialsandsuppliesforsuchelectionasmaybenecessary.yedandadoptedataregularmeetingheldonthe__________dayof_____TOWNOFESTESPARK,COLORADOBy_______MayorATTEST:TownClerk3 00
