00RESOLUTION#22-06WHEREAS,theFirewiseCoalitionofEstesValley(Firewise)hasobtainedanorderfromtheDistrictCourtofLarimerCounty,ColoradotoplaceontheNovember7,2006,GeneralElectionballotthequestionoftheformationoftheEstesValleyRuralFireProtectionDistrict(theFireDistrict);andWHEREAS,aspartoftheprocesstoformtheFireDistrict,FirewisepreparedaServicePlanfortheFireDistrict,whichwasapprovedbytheBoardofCommissionersofLarimerCounty,Colorado.TheServicePlansetsforththeservicestobeprovidedbytheFireDistrictandhowtheservicesaretobefunded.TheFireDistrictwillprovideandfundthoseservicespursuanttoanIntergovernmentalAgreementwiththeTown;andWHEREAS,theIntergovernmentalAgreementprovidesthattheFireDistrictwillpaytotheTownit’sproratashareofthecostofprovidingfireandemergencyservicestoboththeTownandtheFireDistrictbasedupontheassessedvaluationofpropertyintheTownandintheFireDistrict.TheTownwillcontinuetoprovidethesameleveloffundingtotheEstesParkVolunteerFireDepartmentasitiscurrentlyproviding:andWHEREAS,theIntergovernmentalAgreementprovidesarealisticandfairdistributionofthecostofprovidingfireandemergencyservicestoboththeTownandtheFireDistrict.TheformationoftheFireDistrictwillalsoprovideadditionalfundingforexpandingfireandemergencyservicestoareasoutsideoftheTownthatareintheFireDistrict;andWHEREASTheproposedmilllevyof4.25millsforpropertywithintheFireDistrictislowerthanmostmillleviescurrentlyassessedinfireprotectiondistrictsinLarimerCountyandtheFrontRange;andWHEREAS,formationoftheFireDistrictandtheenteringintotheIntergovernmentalAgreementwillrelievemembersoftheEstesParkVolunteerFireDepartmentfromitscurrentresponsibilityforfundraising.ThiswillenabletheVolunteerFireDepartmenttoconcentrateontrainingandcallresponsetomeetthegrowingnumberandtypesoffireandemergencycallsintheTownandtheFireDistrict,andWHEREAS,inreturnforaguaranteedsourceofcontributiontothefundingoftheEstesParkVolunteerFireDepartmentthroughtheIntergovernmentalAgreement,theTowniswillingtocommittothecontinuedprovisionoffireandemergencyservicestoareaswithintheTownandtheFireDistrictpursuanttothetermsoftheIntergovernmentalAgreement.1.Basedontherecitalssetforthabovewhichareincorporatedhereinbyreference,TheTownBoardherebyfinds,resolvesanddeterminesasfollows:a.TheTownBoardurgeseligibleelectorsoftheproposedEstesValleyRuralFireProtectionDistricttovotefortheformationoftheFireDistrict(BallotQuestion54)andfortheballotquestiontoallowtheFireDistricttoretainandspendallfundsreceivedthroughit’s4.25milllevy(BallotQuestion5B).b.TheTownBoardherebyrecognizesthattheproposedIntergovernmentalAgreementisafairandappropriatemethodtofundfireandemergencyservicesforboththeTownandtheFireDistrict. 00 00c.OncetheFireDistrictisformedandtheIntergovernmentalAgreementissigned,theTownwillprovidethroughitsgeneralfundsufficientrevenuestomaintainthecurrentlevelofresponseforfireprotectionandemergencyserviceswithintheTownandtheFireDistrict.Datedthis-‘dayofSeptember,2006.AflESTtCHrk 00
