Home My WebLink AboutRESOLUTION 13-06•00RESOLUTIONNO.13-ac0BEINGARESOLUTIONESTABLISFIINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTI-ifiLA1UMEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEJANUARY1,2007.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911”EmergencyTelephoneService,datedNovember14,1990,betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents($.45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents($.45)permonthisnecessaryandappropriatetoadequatelyfundemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonJanuary1,2007,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents($.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-11-101,etseq.,C.R.S. 00 003.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,etseq.,C.R.S.Uponmotiondulymade,secondedandcarried,theforegoingResolutionwasadoptedthis1WtlayofSoi.ic,2006.TOWNOFESTESPARK,COLORADOBy______MayorClerk7 00
