o0RESOLUTIONNO.18-07WHEREAS,onNovember20,2007,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk;andWHEREAS,onDecember5,2007,theTownClerkissuedaStatementofSufficiencytotheTownBoardstatingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures;andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition;andWHEREAS,followingsaidreviewtheBoardofTrusteesdidnotadopttheInitiatedOrdinancePetitionaspresented.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:1.TheInitiatedOrdinancePetitionfileonNovember20,2007isherebyreferredtotheregisteredelectorsoftheTownofEstesPark,ColoradofortheregularMunicipalElectiononApril1,2008.2.TheTownClerkisherebyorderedtoforthwithpublishtheInitiatedOrdinance.3.TheTownBoardherebydesignatestheTownClerktopromptlyfixaballottitlefortheInitiatedOrdinanceandcertifytheballot.INTRODUCED,READ,ANDPASSEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthisl(’dayof________________,2007TOWNOFESTESPARK,COLORADOMayor-,Iaz._,.Np0..nen’..()TownClerk -.-‘,.‘ 4-.,. 00ORDINANCENO.29-07WHEREAS,onNovember20,2007,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk;andWHEREAS,onDecember5,2007,theTownClerkissuedaStatementofSufficiencytotheTownBoardstatingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures;andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:Section1:TheEstesParkMunicipalCodeshallbeamendedbytheadditionofSection17.44.090,toread:BeforeanysaleofanypropertyownedbytheTownofEstesParkwithintheStanleyHistoricDistrict,thequestionofsuchsaleandthetermsandconsiderationthereofshallbesubmittedandapprovedataregularorspecialelection.Section2:ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.OnDecember11,2007,TheBoardofTrusteesoftheTownofEstesPark,Coloradodidnotpasstheordinance,andbystatestatute31-11-104havereferredtheinitiatedordinancetotheregisteredelectorsattheregularlyscheduledmunicipalelectiononApril1,2008. 00
