Home My WebLink AboutRESOLUTION 08-0700RESOLUTIONNO._________BEINGARESOLUTIONESTABLISHINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIMEREMERGENCYTELEPHONEAUTHORITYEFFECTWEJANUARY1,2008.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101.etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911”EmergencyTelephoneService,datedNovember14,1990,betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstaWtoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents(5.45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents(5.45)permonthisnecessaryandappropriatetoadequatelyfundemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonJanuary1,2008,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents(5.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-11-101,etseq.,C.R.S. 00 003.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,etseq..C.R.S.Uponmotiondulymade,secondedandcarded,theforegoingResolutionwasadoptedthisjq.a%dayofocclssr,2007.TOWNOFESTESPARK.COLORADOByU9asSLMayorTownClerk2 -Jt 4’!
