0RESOLUTIONNO.3-07CWHEREAS,in2005,theStateofColoradoadoptedthe“LowIncomeEnergyAssistanceAct”,ColoradoRevisedStatutes40-8.7-101etseq;andWHEREAS,Section40-8.7-106(2)providesthatifamunicipallyownedelectricutilitydeterminesthattheserviceareaofsuchutilityhasalimitednumberofpeoplewhoqualifyforenergyassistancesaidutilitymaybeexemptfromtheobligationsoftheAct;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthattherearealimitednumberofpeoplewhoqualifyforenergyassistancewithintheTown’sLightandPowerservicearea.NOWTHEREFORE,BEITRESOLVEDthat:1.PursuanttotheprovisionsofSection40-8.7-106(2)TrusteesoftheTownofEstesParkherebydeterminesnumberofpeoplewhoqualifyforenergyassistanceandconditionsoftheLowIncomeEnergyAssistanceAct.C.R.S.theBoardofthattherearealimitedpursuanttotheterms2.Duetothisdetermination,theTownofEstesPark’sLightandPowerutilityisexemptfromtheobligationsoftheLowIncomeEnergyAssistanceAct.INTRODUCED,READ,ANDPASSEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthis2Vdayofceqsjcg..,2007.pN.;.TownClerkITOWNOFESTESPARK,COLORADOaa2Mayor 00C).tA’1
