Home My WebLink AboutRESOLUTION 14-08cmCmc_iRESOLUTIONNO.-BEINGARESOLUTIONESTABLISHINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIMEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEJANUARY1,2009.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,ci’seq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E9II”EmergencyTelephoneService,datedNovember14,1990,betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents($45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents($.45)permonthisnecessaryandappropriatetoadequatelyfindemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:I.CommencingonJanuary1,2009,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents($.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-Il-101.ci’seq.,C.R.S. 00 C03.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,ciseq.,C.R.S.ATTESaaTown-Clerkttw1ijTCbfl1CIQVkIUponmotiondulymade,secondedandcarded,theforegoingResolutionwasadoptedthisg1dayofSefttnlh2C,2008.Mayor2 00
