HomeMy WebLinkAboutRESOLUTION 05-08CRESOLUTIONNO.5-080WHEREAS,acomplaintTrusteesoftheTownofEstesKELLI’S,aTAVERNLIQUORviolationsofthestatutesoftheDepartmentofRevenue,LiquorbytheEstesParkPoliceDepartmentwaspresentedtotheParkonFebruary26,2008chargingAGAPEMOULtd.dbaLICENSE,LIQUORLICENSENO.41-52950-000withcertainStateofColoradoandRulesandRegulationsoftheColoradoEnforcementDivision;andWHEREAS,theBoardofTrusteesherebydeterminesthatthereisprobablecausetobelievethattheaforementionedLicenseehasviolatedoneormoreofthestatutesand/orrulesandregulationsgoverningtheoperationsofthelicenseasmorefullysetforthinthecomplaint;andWHEREAS,theBoardbelievesitisnecessarytoholdahearingandissueanOrdertoShowCausewhytheaforementionedlicenseshouldnotbesuspendedorrevokedduetotheviolationspresentedtotheBoard.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.ThatashowcausehearingshallbeheldpursuanttoSection1247-601,C.R.S.,andaNoticeofHearingbeissuedtotheLicenseetoappearandshowcausewhythelicenseshouldnotbesuspendedorrevoked.SaidhearingshalltakeplaceattheTownBoardmeetingscheduledTuesday,March11,2008at7:00p.m.intheBoardRoomoftheEstesParkTownHall,170MacGregorAvenue,EstesPark,Colorado.Section2.ThattheTownClerkshallcauseanOrdertoShowCauseandNoticeofHearingontheaforementionedcomplainttobemailedtothefollowing:AGAPEMOU,LTD.DIBIAKELLI’S110WESTELKHORN,2N0FLOORESTESPARK,COLORADO80517INTRODUCED,READANDPASSEDTHISJk’DAYOFTOWNOFESTESPARKMayor?rot.....2008.c.TownClerk
