00RESOLUTION#20-09WHEREAS,anInitiatedOrdinancePetitionwasfiledwiththeTownClerkonJuly8,2009;andWHEREAS,aStatementofSufficiencyoftheInitiatedOrdinancePetitionwasissuedbytheTownClerkonAugust6,2009;andWHEREAS,onAugust25,2009,theTownBoardreviewedtheStatementofSufficiencyandtheInitiatedOrdinance;andWHEREAS,theTownBoarddidnotadopttheInitiatedOrdinanceaspresented,andasrequiredbySection31-11-104C.R.S.,theTownBoardapprovedResolutionNo.16-09settingaspecialelectionontheInitiatedOrdinanceforJanuary12,2010;andWHEREAS,itisthedecisionoftheTownBoardbytheadoptionofthisResolutiontoholdtheInitiatedOrdinanceelectionofJanuary12,2010bymailballotpursuanttotheprovisionsofSection1-7.5-104C.R.S.;andWHEREAS,theTownBoardherebydeterminesthattheLarimerCountyClerkandRecorder’sOfficeshallconductthemailballotelectiononbehalfoftheTownofEstesPark:andWHEREAS,itisnecessarytoauthorizetheTownClerktofixtheballottitlefortheInitiatedOrdinance.NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThatpursuanttotheprovisionsofSection1-7.5-104C.R.S.theSpecialElectionofJanuary12,2010shallbeamailballotelectionconductedinconformancewiththeprovisionsofArticle7.5ofTitle1C.R.S.2.ThatScottDoyle,ClerkandRecorderofLarimerCounty,ColoradobeandisherebyappointedastheDesignatedElectionOfficialfortheTownofEstesParkfortheconductofthismailballotelection.3.ThattheMailBallotPlan,acopyofwhichisattachedheretoasExhibitA,befiledwiththeColoradoSecretaryofStatebytheDesignatedElectionOfficial.4.ThattheDesignatedElectionOfficialisherebyauthorizedtomakeanyrequestedchangesintheMailBallotPlanbytheColoradoSecretaryofState.5.ThattheAgreementConcerningElectionServicesbetweentheLarimerCountyClerkandRecorderandtheTownofEstesPark,acopyofwhichisattachedheretoasExhibitB,isherebyapproved. 00 006.ThattheTownClerkisherebydesignatedbytheBoardofTrusteestofixtheballottitleoftheInitiatedOrdinancefortheSpecialElectiononJanuary12,2010andtransmitsaidballottitletotheDesignatedElectionOfficial.Datedthis_____________________________2009.M7or-vATTEST: 00
