00RESOLUTIONNO.16-09WHEREAS,onJuly8,2009,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk:andWHEREAS,onAugust25,2009,theTownClerkissuedaStatementofSufficiencytotheTownBoardstatingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures:andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition;andWHEREAS,followingsaidreviewtheBoardofTrusteesdidnotadopttheInitiatedOrdinancePetitionaspresented.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:1.TheInitiatedOrdinancePetitionfiledonJuly8,2009isherebyreferredtotheregisteredelectorsoftheTownofEstesPark,ColoradoforaspecialelectiononJanuary12,2010.2.TheTownClerkisherebyorderedtoforthwithpublishtheInitiatedOrdinance.3.TheTownBoardherebydesignatestheTownClerktopromptlyfixaballottitlefortheInitiatedOrdinanceandcertifytheballot.INTRODUCED,READ,ANDPASSEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthisaSdayof_______________,2009TOWNOFESTESPARK,COLORADO/:Y‘K4ayorATTEST:Olerk 00 CCORDINANCENO.07-09WHEREAS,onJuly8,2009,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk;andWHEREAS,onAugust25,2009,theTownClerkissuedaStatementofSufficiencytotheTownBoardstatingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures:andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:Section1:TheEstesParkMunicipalCodeshallbeamendedbytheadditionofSection2.90,toread:Section2.90.010—DiscretionaryDistrictsandAuthorities(a)BeforethecreationofanyUrbanRenewalAuthorityauthorizedundertheColoradoRevisedStatutes,thequestionofthecreationofthesame,shallfirstbesubmittedandapprovedataregularorspecialelection.(b)IfapprovedatthespecialorgeneralelectionrequiredunderSubsection(a)ofthisSection,theTownmustcomplywithallapplicablerequirementssetforthundertheColoradoRevisedStatutes.(c)AnUrbanRenewalAuthoritydulyexitingatthetimeoftheenactmentofthisMunicipalCodeSection2.90.010shallbeabolishedconsistentwithallapplicableColoradoRevisedStatutesandshallimmediatelytakeanyandallnecessarystepstowinddownitsoperationsandtoprovideadequatearrangementsforpaymentofanyoutstandingindebtednessandotherobligationswithinareasonableperiodoftimenottoexceedsixmonths.Section2:ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.OnAugust25,2009,theBoardofTrusteesoftheTownofEstesPark,Coloradodidnotpasstheordinance,andbystatestatute31-11-104havereferredtheinitiatedordinancetotheregisteredelectorsataspecialelectiononJanuary12,2010. 0.0
