o0RESOLUTIONNO.15-09RESOLUTIONIMPOSINGATEMPORARYMORATORIUMONTHEISSUANCEOFBUILDINGPERMITSFORWINDTURBINESWITHINTHETOWNOFESTESPARKWHEREAS,onApril30,2009,theTownofEstesParkinstitutedapublicprocesstodeterminewhetherornotregulationsgoverningtheinstallationandoperationofwindturbinesshouldbeconsideredbytheTownofEstesPark;andWHEREAS,theprocessofobtainingandreviewingpubliccommentregardingtheinstallationandoperationofwindturbineswithintheTownhasnotbeenconcluded;andWHEREAS,numerousapplicationsforbuildingpermitsfortheinstallationofwindturbineshavebeenfiledwiththeTown’sCommunityDevelopmentDepartment;andWHEREASthepublicprocessmayindicateaneedtoconsideradoptingregulationsbytheTowntoaddressissuessurroundingthesiting,noise,visualandotherpotentialimpactstoadjoiningpropertiesfromtheinstallationandoperationofwindturbineswithintheTown;andWHEREAS,itisnecessarytodeclareatemporarymoratoriumontheissuanceofanybuildingpermitforanywindturbineuntilsuchtimeastheBoardofTrusteesoftheTownhasanopportunitytoreviewtheinputreceivedfromthepublicprocessconcerningpotentialimpactsofwindturbinesonpropertieswithintheTownandconsideradoptionofanynecessaryregulationsaddressinganynegativeimpactsofthelocationandoperationofwindturbineswithintheTown;andWHEREAS,itisanticipatedbytheBoardofTrusteesthatthepublicprocessandpossibleintroductionofnecessaryregulationscanbeaccomplishedwithinonehundredtwenty(120)days;andWHEREAS,pursuanttotheapplicableprovisionsofSection29-20-101etseq.knownastheLocalGovernmentLandUseControlEnablingActof1974,theTownofEstesParkhasthepowertoimposethistemporarymoratorium.NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK:1.TheBoardofTrusteesherebyimposesatemporarymoratoriumontheissuanceofanybuildingpermitbytheCommunityDevelopmentDepartment 00 o0fortheinstallationofanywindturbinewithintheTownofEstesPark.ThistemporarymoratoriumshallapplytoallapplicationsforbuildingpermitsfiledwiththeCommunityDevelopmentDepartmentfromthedateofthisResolution.2.Thistemporarymoratoriumshalltakeeffectimmediatelyandbeinforceforonehundredtwenty(120)daysunlessamendedand/orterminatedbyfurtheractionoftheBoardofTrustees.INTRODUCED,READ,ANDPASSEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthisjIft%dayoff-pi..osm,2009.S._000*.02C0-p—eonTownClerk 00
