00RESOLUTION#12-09WHEREAS,theTownofEstesParkandtheStateofColoradothroughtheColoradoDepartmentofTransportationnegotiatedaContractAgreementforthepurposeofprovidingfundsfromtheState,whichalongwithTownfunds,willbeusedfortheconstructionofpedestrianandaestheticimprovementsknownasFallRiverTrailPhase4-B(the‘Project”);andWHEREAS,thetermsandconditionsoftheProjectrequiretheTownapprovetheContractandauthorizetheexpenditureofthesefundsplustheTown’sbalanceofthecostoftheproject,byResolution;andWHEREAS,sufficientfundshavebeenpreviouslyappropriatedbytheTowninthe2009TownBudgetfortheTown’sbalanceofthecostoftheproject.NOW,THEREFORE,BASEDUPONTHERECITALSSETFORTHABOVEWHICHAREINCORPORATEDHEREINBYREFERENCE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOASFOLLOWS:1.TheContractAgreementbetweentheTownofEstesParkandtheStateofColoradofortheuseandbenefitoftheColoradoDepartmentofTransportationfortheProjectisherebyapproved.2.TheMayorandTownClerkareherebyauthorizedtoexecutetheContract.3.Thefundsappropriatedinthe2009TownBudgetareherebyauthorizedtobeexpendedpursuanttothetermsandconditionsoftheContract.Datedthis,2009.<ç.-ATTET’:Tow(lerk 00
