0aRESOLUTION#07-09WHEREAS,theFireServicesInitiativeCommitteeofEstesValley(FSIC)isintheprocessofobtaininganorderfromtheDistrictCourtofLarimerCounty,ColoradotoplaceontheNovember3,2009,GeneralElectionballotthequestionoftheformationoftheEstesValleyFireProtectionDistrict(theFireDistrict);andWHEREAS,aspartoftheprocesstoformtheFireDistrict,FSICpreparedaServicePlanfortheFireDistrict,tobeapprovedbytheBoardofCommissionersofLarimerCounty,Colorado.TheServicePlansetsforththeservicestobeprovidedbytheFireDistrictandhowtheservicesaretobefunded.TheFireDistrictwillprovideandfundthoseservicespursuanttoIntergovernmentalAgreementswiththeTown;andWHEREAS,theIntergovernmentalAgreementsprovidethattheTownwilltransfertotheFireDistrict7%oftheTown’scollectedsalestaxforfireandemergencyservices;andWHEREAS,theIntergovernmentalAgreementsprovidearealisticandfairdistributionofthecostofprovidingfireandemergencyservicestotheFireDistrict.TheformationoftheFireDistrictwouldalsoprovideadditionalfundingforexpandingfireandemergencyserviceswithintheFireDistrict;andWHEREAS,theproposedmilllevyof1.95millsforpropertywithintheFireDistrictislowerthanallmillleviescurrentlyassessedbyfireprotectiondistrictsinLarimerCountyandlowerthanmostmillleviesassessedbyfireprotectiondistrictsintheFrontRange;andWHEREAS,theprovisionoffireandemergencyserviceswouldbeprovidedbytheFireDistrictpursuanttotheIntergovernmentalAgreementsforallareaswithintheFireDistrictthroughtheEstesParkVolunteerFireDepartment.1.Basedontherecitalssetforthabovewhichareincorporatedhereinbyreference,TheTownBoardherebyfinds,resolves,anddeterminesasfollows:a.TheTownBoardagreeswiththeprovisionsoftheServicePlanandrequestsapprovaloftheServicePlanbytheBoardofCommissionersofLarimerCounty.b.TheTownBoardherebyrecognizesthattheproposedIntergovernmentalAgreementsareafairandappropriatemethodtofundandprovidefireandemergencyservicesfortheFireDistrict.c.TheTownBoardurgeseligibleelectorsoftheproposedEstesValleyFireProtectionDistricttovotefortheformationoftheFireDistrictinNovember 00 00andvotefortheballotquestiontoallowtheFireDistricttoretainandspendallfundsreceivedthroughits1.95mMlevy.Datedthis24thdayofMarch,2009.r-AUF•‘..•erk 00
