CaRESOLUTIONNO.04-10WHEREAS,bytheStatutesoftheStateofColorado,the&dayofApril,2010isfixedasthetimeforaregularmunicipalelectiontoelectthreeTrustees.WHEREAS,itisthedutyoftheBoardofTrusteestoprovidefortheholdingofsuchanelection;andWHEREAS,itisthedecisionoftheTownBoardbytheadoptionofthisResolutiontoholdtheRegularMunicipalelectionofApril6,2010bymailballotpursuanttotheprovisionsofSection1-7.5-104C.R.S.;andWHEREAS,theTownBoardherebydeterminesthattheLarimerCountyClerkandRecorder’sOfficeshallconductthemailballotelectiononbehalfoftheTownofEstesPark;andNOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThatpursuanttotheprovisionsofSection1-7.5-104C.R.S.theMunicipalElectionofApril6,2010shallbeamailballotelectionconductedinconformancewiththeprovisionsofArticle7.5ofTitleIC.R.S.2.ThatScottDoyle,ClerkandRecorderofLarimerCounty,ColoradobeandisherebyappointedastheDesignatedElectionOfficialfortheTownofEstesParkfortheconductofthismailballotelection.3.ThattheMailBallotPlan,acopyofwhichisattachedheretoasExhibitA,befiledwiththeColoradoSecretaryofStatebytheDesignatedElectionOfficial.4.ThattheDesignatedElectionOfficialisherebyauthorizedtomakeanyrequestedchangesintheMailBallotPlanbytheColoradoSecretaryofState. 00 005.ThattheAgreementConcerningElectionServicesbetweentheLarimerCountyClerkandRecorderandtheTownofEstesPark,acopyofwhichisattachedheretoasExhibitB,isherebyapproved.6.ThattheTownClerkisherebydesignatedbytheBoardofTrusteestofixtheballotfortheRegularMunicipalElectiononApril6,2010andtransmitsaidballottitletotheDesignatedElectionOfficial.DATEDthisr2cdayof_____________________2010.TOWNOFESTESPARK6’MayorAflEst(?—.CrCToWnClerkJ 00
