07-1100RESOLUTION#07-11WHEREAS,theEstesValleyFireProtectionDistricthasadoptedthe2009InternationalFireCodeincludingAppendicesandAmendments(the“FireCode”)fortheregulationandgovernanceofconditionshazardoustolifeandpropertyfromfireorexplosionandprovidingforcertainpermittingofsuchusesandoperations;andWHEREAS,Section32-1-1002(1)(d)C.R.S.providesthattheFireCodeadoptedbytheEstesValleyFireProtectionDistrictshallnotapplywithinthecorporatelimitsoftheTownofEstesParkunlesstheBoardofTrusteesoftheTownadoptsaresolutionstatingthattheFireCodeshallapplywithintheboundariesoftheTown;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisinthebestinterestoftheTowntoadoptaresolutionstatingthattheFireCodeasadoptedbytheEstesValleyFireProtectionDistrictpursuanttoResolutionNo.2011-01oftheFireDistrictshallapplywithinthecorporatelimitsoftheTownofEstesPark.NOW,THEREFORE,BASEDUPONTHERECITALSSETFORTHABOVEWHICHAREINCORPORATEDHEREINBYREFERENCE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOASFOLLOWS:1.The2009InternationalFireCodeincludingAppendixesandAmendmentsasmorefullysetforthinResolutionNo.2011-01oftheEstesValleyFireProtectionDistrictshallapplywithinthecorporatelimitsoftheTownofEstesPark.2.ThisResolutionshalltakeaffectandbeinforceonandafterJune1,2011.,2011.MayorpLaNgp0TnClerkDatedthis 00RESOLUTIONNO.2011-01ARESOLUTIONOFTHEESTESVALLEYFIREPROTECTIONDISTRICTADOPTINGTHE2009INTERNATIONALFIRECODEANDCERTAINAPPENDICESANDCERTAINMODIFICATIONSTHERETO,REGULATINGANDGOVERNINGCONDITIONSHAZARDOUSTOLIFEANDPROPERTYFROMFIREOREXPLOSIONANDPROVIDINGFORCERTAINPERMIThNGOFSUCHUSESANDOPERATIONS.WHEREAS,theBoardofDirectorsoftheEstesValleyFireProtectionDistrictdeemsitnecessarytoadoptthefollowingcodeforthepurposeofestablishingrulesofconductandstandardsfortheprotectionoflife,health,property,securityandwelfareoftheinhabitantsandpropertyownersoftheDistrict;andWHEREAS,theBoardofDirectorshasconsideredtheeffectoffirecodeenforcementwithintheboundariesoftheDistrictandhasdeterminedthatenforcementoftheproposedcodeswouldnotcauseunduehardshiporsuppressionofeconomicgrowthwithintheDistrict;andWHEREAS,theBoardofDirectorshasstudiedthenecessityforrealisticandreasonableleveloffireprotectiontobeprovidedbyarural-urbanfireprotectiondistrict;NOW,THEREFOREBEITRESOLVEDThAT:SECTIONI:Adoptionofthe2009InternationalFireCode.ThereisherebyadoptedbytheEstesValleyFireProtectionDistrictforthepurposeofprescribingregulationsgoverningconditionshazardoustolifeandpropertyfromfire,hazardousmaterials,orexplosion,thatcertainCodesknownastheInternationalFireCode,including:AppendixChapters:B(Fire-FlowRequirementsfo?Building):C(FireHydrantLocationsandDistribution);D(FireApparatusAccessRoads)withspecificationsapprovedbytheFireMarshal;F(HazardCategories);F(HazardRanking);G(CryogenicFluids-WeightandVolumeEquivalents),aspublishedbytheInternationalCodeCouncil,beingparticularlythe2009editionthereofandthewholethereof,saveandexceptsuchportionsasarehereinafterdeleted,modified,oramendedbytheResolution,ofwhichsaidCodearenowfiledintheofficesoftheEstesValleyFireProtectionDistrictandthesameareherebyadoptedandincorporatedasfullyasifsetoutatlengthherein.ThedateonwhichthisResolutionshalltakeeffectwithintheincorporatedmunicipalitieswithinthisDistrictshallbethedateofapprovalbythegoverningboardofsaidmunicipalityandthedateonwhichitshalltakeeffectwithintheunincorporatedportionsofLarimerCountyshallbeonthedateofapprovalbytheBoardofCountyCommissionersinandforLarimerCounty,StateofColorado.ThisCodeshallbeineffectwithintheterritoriallimitsoftheEstesValleyFireProtectionDistrict.SECTIONII:EstablishmentandDutiesofLieSafetyInspectors.OrganizationalstructureanddutiesoftheLifeSafetyDIvisionshallbeasprovidedbytheDistrict’srulesandregulationsandinternalorganizationalstructure.SECTIONIII:Definitions.ThefollowingdefinitionsshallbeutilizedinadditiontothosesetforthintheInternationalFireCode:Wherevertheword“jurisdiction”isused,itismeanttobeinclusiveoftheboundariesoftheEstesValleyFireProtectionDistrictastheynowormayhereafterexist.Wheretheterm“Chief”or‘thiefoftheLifeSafetyDivision,isused,itshallbeheldtomeantheChiefoftheEstesValleyFireProtectionDistrict,ortheDistrictFireMarshaloradesignatedmemberoftheDistrict.1 00WherethetermBoard”isused,itshallbeheldtomeantheBoardofDirectorsoftheEstesValleyFireProtectionDistrict.WhereverthetermInternationalBuildingCode”isused,itshallbeheldtomeantheinternationalBuildingCodeasadopted,amendedandincorporatedintotheLarimerCountyBuildingCodeforunincorporatedportionsofLarimerCountyortheInternationalBuildingCodeasadopted,amendedandincorporatedintotheTownofEstesPark’sBuildingCodewithinitsmunicipality’sterritoriallimits.Wherevertheterm‘AutomaticFireDetectionSystem”isused,itshallbeheldtomeantotalcoveragebysmokeorheatdetectorsinallaccessibleareasandshallincludeallrooms,halls,storageareas,basements,attics,loftsandothersubdivisionsandaccessiblespaces;andtheinsideofallclosetsthatareabletobewalkedinto,elevatorshafts,enclosedstairways,dumbwaitershafts,andchutes.Inaccessibleareasshallnotberequiredtobeprotectedbydetectors.Notification/AudibleappliancesshallbeinstalledtoNationalFireProtectionAssociation(NFPA)standards.Audibleandvisualnotificationlayoutandconfigurationshallbeapproved.Variancestothisrequirementmaybegrantedbythecodeofficialwhenequalorgreaterlifesafetyprotectionisprovided.SECTIONIV:AmendmentsmadeinandtotheInternationalFireCode.TheInternationalFireCodeisamendedandchangedinthefollowingrespects:1.Chapter1,Section108shallbeamendedbythedeletionofsaidSectionInItsentiretyandbytheinsertionofthefollowing:(a)TheDistrict’sBoardoritsdesignee,theAppealsCommitteeshalldeterminethesuitabilityofthealternatematerialsandmethodsandtypeofconstructionandprovidereasonableinterpretationsoftheprovisionsofthisCodeupontherequestofanyinterestedparty,includingtheChief.(b)TheBoard,uponrecommendationoftheAppealsCommitteeortheChieforuponitsownmotion,mayenterintowrittenagreementsforenforcementorcompliancewiththeowner,lessee,occupantorauthorizedagentthereof,ofanyproperty,buildingorstructure,oranyinterestedpersondirectlyaffectedbytheapplicationofthiscode.Saidagreementsmayextendthetimeforcompliancewiththiscode,andmaycontainsuchtermsandconditionsthattheBoarddeemsappropriatetoadequatelyprotectthelife,health,property,securityandwelfareofthegeneralpublic,includingalternativemeanstomeetthespiritandintentofthecode.(c)PersonsaggrievedunderthiscodemayfileanappealwiththeBoardoftheEstesValleyFireProtectionDistrictunderChapter1,Section108oftheInternationalFireCode.TheAppealshallbeheardbythesubcommitteeofthreemembersoftheBoard,designatedannuallybytheBoardasmembersoftheAppealCommittee.ThedecisionoftheAppealCommitteeshallbedeemedasfinalagencyactionforpurposesofanygrievantseekingjudicialreviewofanadversedecision.2.Chapter1,Subsection111.4,deletethefollowing;‘shallbeliabletoafineofnotlessthan(Amount)dollarsormorethan(Amount)dollars”andreplacewith:shallbesubjecttofineand/orimprisonmentuptothemaximumspecifiedin§32-1-1001and32-1-1002,C.R.S.”3.ThefollowingisaddedasanadditiontoChapter1:Section112InspectIonFees:2 00 00(a)Pursuantto§32-1-1002(lfle)(ll)C.R.S.,theBoardmayfixandfromtimetotimemayincreaseordecreasefeesandcharges,atitsdiscretion,forinspectionsandreviewofplansandspecifications,whichare:(1)Requestedormandatedforexistingstructures,buildingsandimprovements;and(2)Necessitatedinconjunctionwithanycountyregulation,resolutionorconditionofdevelopment;or(3)Performedinconjunctionwiththeconstructionofnewstructures,buildings,andimprovements.(b)Saidfeesandchargesmay.atthediscretionoftheBoard,includeachargeforreimbursementtotheDistrictofanyconsultationfees,expensesorcostsincurredbytheDistrictintheperformanceoftheinspectionsorreviewoftheplansandspecifications.4.Chapter1,Section113shallbeaddedasanewsectiontoreadasfollows:Section113“ThisChaptershallbeinterpretedtobeconsistentwiththeprovisionof§32-1-1002(3),C.R.S.”5.SeeattachedAmendmentspp.6-10.SECTIONV:EnforcementProceduresandAppeal.(a)TheChiefshallenforcethiscodeandshaltinspectorcausetobeinspectedallbuildings,structures,property,premises,andpublicplaces,excepttheinteriorofanyprivatedwellinginaccordancewiththeproceduressetforthin§32-1-1002(3),C.R.S..Allinspectionsshallberecordedinaninspectionreport.(b)A‘NoticeofViolationorHazard”maybeissuedbytheChieforhisdesigneeconcerningviolationsorhazardswhicharenotcorrectedon-siteduringaninspection.SaidNoticeshallbesignedbytheinspectorandcontain,asaminimum,thefollowinginformation:1.Dateofinspection;2.Name/Addressofpremisesinspected;3.Nameofinspector;4.Natureofviolations,includingspecificreferencetosection/subsectionsofthecode;5.Dateofreinspection;6.Suggestedmethodsofcorrectionorcompliance,ifapplicable;7.RighttoappealtotheAppealsBoard;8.Consequencesoffailuretocorrectviolation.(c)An“OrderforImmediateCorrectionofHazard”maybeissuedbytheChief:(1)ForfailuretocorrectaviolationorhazardwithinthetimespecifiedinapreviouslyissuedNoticeofViolationorHazard:or(2)Forviolatingthecodeorstatestatuteandsaidviolationrendersthebuilding,structureorpremisesespeciallyliabletofireorishazardoustothesafetyoftheoccupantsthereof,orwhichissosituatedastoendangerotherpropertyassetforthin§32-1-1002(3)(c),CR5.,whetherornotaNoticehasbeenpreviouslyissued.3 0C(3)AnordershallbesignedbytheChiefandshallcontain,asaminimum,thefollowinginformation:1.Dateofissuance;2.Name/Addressofpremisesinspected;3.Natureofviolationorhazard;4.Demandforimmediatecorrection;5.RightofappealtotheDistrictCourtandtimelimit;6.Penaltiesforviolationoforder;7SignatureoftheChieforhisdesignee;8.Acknowledgementofreceiptsignedbyowner,lessee,agentorotherresponsibleperson.(d)AnappealofaNoticeofViolationorHazardmaybemadetotheAppealsBoardbydeliverytotheChiefinwritinganoticeofappealwithinfivedaysoftheissuanceoftheNoticeofViolationorHazard.Theappealshallbeheardatthenextregularmeetingorspecialmeetingcalledforthatpurpose.TheAppealsBoardmayaffirm,rescind,ormodifytheNoticeandmayenterintosuchenforcementagreementsasitdeemsproper.(e)AnappealofanOrderforImmediateCorrectionofHazardmaybemadetotheAppealsBoardonlyifnopreviousappealhasbeenmadeofapreviouslyissuedNoticeofViolationorHazardconcerningthesameviolationorhazard.AnappealofanOrdermustbeinwritingandfiledwiththeAppealsBoardwithinthreedaysofissuanceoftheOrder.(1’)TheAppealsBoardshallhearallsuchappealsandapplicationforreliefandrenderitsdecisionthereoninaccordancewithitsbylaws,rulesandregulations.(g)IntheeventnoappealismadetotheAppealsBoardpursuanttothiscodeandresolutionortothecourtpursuantto32-1-1OO2(3),C.R.S.andcompliancewiththeOrderand/orcorrectionofthehazardhasnotoccurred,theAppealsBoardmay,uponrecommendationbytheChieforuponitsownmotion,referthemattertotheLarimerCountyDistrictAttorney,ortheTownofEstesParkAttorneydependinguponjurisdiction.(h)Anappealshallsuspendthetimelimitsforcomplianceorcorrectionofafirehazardorhazards,untiltheappealisresolvedforappealsofaNoticeofHazardwhichisissuedpursuanttothisSection,paragraph(c)(1)herein.(i)Anappealshallnotsuspendthetimelimitforcomplianceorcorrectionoflifesafetydeficienciesorviolations.AnappealofanOrderissuedpursuanttoSectionV,Paragraph(c)(2)hereinshallnotsuspendthetimelimitsforcomplianceorcorrection,andcomplianceorcorrectionshallbemadeorrenderedforthwith,unlesstheAppealsBoardsuspendstheOrder.SECTIONVI:Penalties(a)Anyowner,lessee,agent,oroccupantofanybuildingorpremisesmaintaininganyconditionlikelytocausefireortoconstituteanadditionalfirehazardoranyconditionwhichimpedesorpreventstheegressofpersonsfromsuchbuildingorpremisesinviolationoftheprovisionsof§32-1-1002(3),C.R.S.,shallbedeemedtobemaintainingafirehazard.AnypersonwhoviolatesanyprovisionofsaidSectionV.subsection(c)isguiltyofamisdemeanor.Eachdayinwhichsuchviolationoccursshallconstituteaseparateviolationof§32-1-1002(3),C.RS..4 00(b)Theapplicationoftheabovepenaltyshallnotbeconstruedtopreventtheenforcedremovalorcorrectionofprohibitedconditionsorotherinjunctiverelief.SECTIONVII:RepealofConflictIngOrdinancesorResolutions.AllformerordinancesorresolutionsenactedbytheDistrictorpartsthereofconflictingorinconsistentwiththeprovisionsofthisresolutionoftheCodeorstandardsherebyadoptedareherebyrepealed.SECTIONVIII:ValidityandConflict.TheEstesValleyFireProtectionDistrictBoardofDirectorsherebydeclaresthatshouldanysection,paragraph,sentenceorwordofthisresolutionorofthecodeorstandardsherebyadoptedbedeclaredforanyreasontobeinvalid,itistheintentoftheEstesValleyFireProtectionDistrictBoardofDirectorsthatitwouldhavepassedallotherportionsofthisresolutionindependentofeliminationherefromofanysuchportionasmaybedeclaredinvalid.ItisfurtherthedeclarationoftheEstesValleyFireProtectionDistrictBoardofDirectorsthatnoprovisionofthisresolutionorthecodeorstandardsadoptedhereinbeinterpretedinconflictwithexistingStatelaw.IntheeventthereisconflictbetweenStatelawandthiscode,Statelawshalltakeprecedent.SECTIONIX:DateofEffect.ThisresolutionshalltakeeffectandbeenforcedwithinincorporatedmunicipalitiesandunincorporatedportionsofLarimerCountyfromandafteritsapprovalassetforthin§32-1002(1)(d),C.R.S.Adopted:9(1L1,2011.ESTESVALLEYFIREPROTECTIONDISTRICTBy________AUST:S4,retar5 size (Emergency Escape and Rescue Opening) Estes Valley Fire Protection Districts Proposed Amendments to the 2009 International Fire Code Required (Exit signs) id:Floor-level exit signs shall be provided in all rridors serving guest rooms of hotels in Group R Division 1 Occupancies.The bottom of such sign shall not be less than 6 inches (152 mm)or more than 8 inches (203 mm)above the floor level and shall indicate the path of exit travel.For exit and exit- access doors,the sign shall be on the door or adjacent to the door with the closest edge of the sign ithin 4 inches (102 mm)of the doorirame. This amendment is to add floor-level exit signs in corridors of certain hotels to assist occupants in exiting a building under fire and smoke conditions.This will meet the current Larimer County requirement and the Town’s amendment 1QZ 4.d- Delete Exception:i he minimum net clear opening for emergency escape and rescue grade floor openings shall be 5 square feet (0.46 m2). If exception is not deleted add the following text at the end of the exception:Grade floor openings are those openings which are a maximum 44 inches above grade,immediately outside the opening for a minimum 36 inch square area centered on the opening.The area immediately outside the opening must be reasonably accessible to emergency responders. This will match the Town of Estes Park BC amendment.5.7 square feet is the area necessary for firefighters in full gear to maneuver through the opening from a ladder.This is the most common option for other jurisdictions.
