00RESOLUTION#09-11ARESOLUTIONAGAINSTTHEPROPOSEDREVISIONTOTHEREGULATIONNUMBER11,PARTATOEXPANDTHEEMISSIONSANDINSPECTIONPROGRAMTOTHEESTESPARKAREAWHEREAS,theAirPollutionControlDivisionhasinformedtheTownofEstesParkthattheyintendtorequestthattheAirQualityControlCommissionschedulearulemakinghearinginSeptemberinordertoallowvehicleemissionstestingtobeginintheEstesParkareain2012;andWHEREAS,theTownofEstesParkhasrequestedthattheSeptemberhearingbeheldinEstesParktoallowadequatepublicparticipationtoourresidents;andWHEREAS,ItistheTownofEstesPark’sviewthatcentralized1M240emissionstestingintheEstesParkareawillhaveveryrealimpactsonourresidents;andWHEREAS,TheTownofEstesParkisuniquefromothercommunitiesintheozonenonattainmentareaandthatinitiatingthelM240testprogramwouldnotbeanefficientoreffectivewaytoaddressozoneairquality;andWHEREAS,Theprimaryreasonforthisbeliefrelatestothesmallnumberofresidentvehiclesinthearea,theoverwhelmingnumberoftouristvehiclesduringthesummerozoneseason,thefardistancetodrivetocentralizedteststationsandthehardshipofdrivingtotheteststationsforouruniquelyolderpopulationdemographic;andWHEREAS,WhiletheBoardrecognizesthattheozonemonitorinRockyMountainNationalParkdoesshowelevatedozonelevelsduringthesummerseason,emissionsfromtouristvehiclesduringthatseasonareexpectedtobemuchgreaterthanthosefromthelocalresidentfleet;andWHEREAS,TheDenverMetroNorth-FrontRangecentralizedtestingprogramprovidesteststationsformotoristsinLoveland,FortCollinsandGreeley,butnotinEstesPark.IncludingEstesParkresidentswouldrequirethosemotoriststodriveaconsiderabledistancetooneofthecentralizedtestingstationsNOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOthattheBoardofTrusteesherebyexpressesitsoppositiontoincludingEstesParkintheemissionstestingareaandencouragestheAirQualityControlCommissiontochoosetoexcludetheEstesParkareafromtheprogramduetotheapplicableairqualityscienceandtheeffectsoftheprogramonthepopulationlivingintheareaasauthorizedinSenateBill09-003. 00 CCINTRODUCED,READ,ANDPASSEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKonthis12thdayofJuly2011.TOWNOFESTESPARK,COLORADO_\nTo&ClerkMayor 0‘—4V
