HomeMy WebLinkAboutRESOLUTION 18-20RESOLUTION18-20APPROVINGELKHORNLODGEPRELIMINARYSUBDIVISIONFLATWHEREAS,anapplicationfortheElkhornLodgePreliminarySubdivisionPlatwasfiledbyEastAvenueDevelopment,LLC,aTexaslimitedliabilitycompany(applicant);andWHEREAS,theElkhornLodgePreliminarySubdivisionPlatproposesthirteen(13)lotsonaparcelapproximately18.58acresinsize,locatedwithinaCO(OutlyingCommercial)ZoningDistrict,withaMixed-UsePlannedUnitDevelopmentoverlay(ElkhornLodgePUD)alsoproposedforthesubjectproperty;andWHEREAS,thelotscreatedbyElkhornLodgeSubdivisionPreliminaryPlatareproposedtorangefrom0.276to3.291acresinsize;andWHEREAS,apublicmeetingwasheldbeforetheEstesValleyPlanningCommissiononFebruary25,2020,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovalofthePreliminarySubdivisionPlatwiththefollowingfindings:1.ThePreliminaryPUDandPreliminaryPlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesValleyComprehensivePlan.2.ThePreliminaryPUDandPreliminaryFlataregenerallyconsistentwiththegoalsandpoliciessetforthintheEstesParkDowntownPlan.3.ThePreliminaryPUDandPreliminaryFlatcomplywithapplicablestandardssetforthintheEstesValleyDevelopmentCode...4.ThePlanningCommissionistherecommendingbody,andistoforwardarecommendationonthePreliminaryPUDandPreliminaryFlattotheTownBoardofTrustees.5.Adequatepublicfacilitiesarecurrentlyavailabletoservetheproposedproject.6.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereraisedbyanyreviewagency.WHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonFebruary25,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationofthePlanningCommissionandthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicanthascompliedwiththeapplicablerequirementsoftheEstesParkDevelopmentCode.
