HomeMy WebLinkAboutRESOLUTION 15-20RESOLUTION16-20ARESOLUTIONAPPROVINGTHEESTESPARKPLANNINGCOMMISSIONBYLAWSWHEREAS,theTowniscurrentlyintheprocessofformingandappointinganewPlanningCommission;andWHEREAS,itisnecessaryandappropriateforTownofEstesParkBoardsandCommissionstohaveanapprovedsetofbylawsforconductofbusiness;andWHEREAS,undersection2.1(C)oftheEstesParkDevelopmentCodeTeffectiveApril1,2020,bylawsforthePlanningCommissionmustbeapprovedbytheBoardofTrustees;andWHEREAS,TownBoardapprovalofastandardizedsetofbylawsinaccordancewithTownGovernancePolicy102willmeetthegoalofanorderlymeetingprocess:NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheEstesParkPlanningCommissionBylawsladoptedSpring2020]nowbeforetheBoardareherebyapproved.DATEDthisZ.L1dayof‘—kpc..sj..&2020.TOWNOFESTESPARKMayorATTEST:ToeClerkAPPROVEDASTOFORM:TownAttorney ESTESPARKPLANNINGCOMMISSIONBYLAWS[AdoptedSpring2020]I.ROLETheEstesParkPlanningCommission(“Commission’)isestablishedundersection2.1(C)oftheEstesParkDevelopmentCode.TheCommissionexercisestheauthoritygiventoitbytheTownBoardasoutlinedbelow:1.PerformallofthedutiesandresponsibilitiesofamunicipalplanningcommissionpursuanttoColoradolaw;2.PerformallofthedutiesandresponsibilitiesofthePlanningCommissionasdescribedintheEstesParkDevelopmentCode;and3.MakerecommendationstoTownBoardregardingtheTown’sComprehensivePlan,providedthatfinaladoptionoftheComprehensivePlanshallbeatthediscretionoftheTownBoard.II.MEETINGSA.RegularMeetings.RegularmeetingsshallbeheldthethirdTuesdayofeachmonth,beginningat1:30PM.Atmeetings,theCommissionshallconsiderallmailersproperlybroughtbeforetheCommissionasscheduleditems.IfanychangeismadetothestartingtimeofaCommissionmeeting,eitherbytheCommunityDevelopmentDirectororbytheCommissionatapreviousmeeting,Commissionmembersshallbenotifiedofsuchchangeatleastfivedayspriortothemeeting.B.StudySessions.StudysessionsoftheCommissionmaybescheduledbytheCommissionortheCommunityDevelopmentDirectorasneeded.Noofficialactionshallbetakenandnoquorumshallberequiredforthestudysession.Thestudysessionshallbeopentothepublic.UnlessrequestedbytheChair,nopubliccommentshallbetakeninastudysession.C.SpecialMeetings.SpecialmeetingsmaybeheldatanytimeuponcallbytheChair,theCommission,ortheCommunityDevelopmentDirector.Noticeofatleastthree(3)calendardaysshallbegiventoeachmemberoftheCommission.Thetime,place,andpurposeofthespecialmeetingshallbespecifiedinthenoticetotheCommissioners.PublicnoticeofthemeetingshallbegiveninaccordancewithColoradoRevisedStatutesSec.24-6-402(2)(c).D.OpenMeetings.Allmeetingsareopentothepublic.ActionoftheCommissionshallbeinfullcompliancewithColoradostatutesgoverningopenmeetings.Ill.MEMBERSANDQUORUMA.Membership.TheCommissionconsistsoffive(5)votingmembers,asprovidedintheDevelopmentCode. B.Quorum.Aquorumfortransactionofbusinessshallconsistofthree(3)members.Inameetingwhereaquorumisnotpresent,noactionshallbetaken,andallscheduledmattersshallberescheduledforhearingatthenextregularlyscheduledCommissionmeeting,orataspecialmeeting.C.Action.ActionbytheCommissionshallbebymajorityvoteofthemembersattendinganyregularorspecialmeetingatwhichaquorumispresent,unlessotherwiseprovidedbylaworordinance.D.Liaison.TheTownBoardmayappointoneofitsmembersasaliaisontotheCommission,whoshallreceivecopiesofallnotices,documents,andrecordsofproceedingsoftheCommissionwhichanyCommissionerwouldalsoreceive.IV.OFFICERSA.Officers.ThereshallbeaChairandaViceChairfortheCommission.Eachshallserveforaone-yearterm.TheChairandVice-ChairshallbechosenbymajorityvoteofmembersoftheCommission.TheCommunityDevelopmentDepartmentPlanningDivisionAdministrativeAssistant,orhisorherdesignee,shallserveasRecordingSecretary.B.Elections.Officersshallbeelectedbythemembersannually,atthefirstregularlyscheduledmeetingofeachyearorassoonthereafteraspracticable.NotificationofwhoiselectedChairandViceChairwillbesenttotheTownClerk.C.Chairpersonresponsibilities:1.Shallpresideatallmeetingsatwhich(s)heispresent;2.Shallensurethatallmeetingsareconductedwithdecorumandefficiency;3.MaycallspecialmeetingsinaccordancewiththeBylaws;4.ShallsignanydocumentsonbehalfoftheCommission;5.ShallseethatdecisionsoftheCommissionareproperlytaken;6.AsanyothermemberoftheCommission,shallvoteonmattersbeforetheCommission,maymakeorsecondmotions,andmayspeakfororagainstproposals.D.Vice-Chairpersonresponsibilities:PresideovermeetingsandperformtheotherdutiesoftheChairintheeventtheChairisabsentorunabletoact.E.RecordingSecretaryresponsibilities:1.AttestthesignatureoftheChairorViceChaironthedocumentsoftheCommission;2.PrepareandkeeptheminutesofallmeetingsoftheCommissioninanappropriateanddesignatedfile;3.GiveandserveallnoticesrequiredbylawortheseBylaws;4.PreparetheagendainconsultationwiththeChairforallmeetingsoftheCommission;5.BecustodianofCommissionrecords; 6.InformtheCommissionofcorrespondencerelatingtobusinessoftheCommissionandattendtosuchcorrespondence.V.MEETINGPROCEDURESA.ParliamentaryProcedure.TheChairshallpresideinaccordancewithgenerallyacceptednormsfortheconductofparliamentaryprocedure.TheCommissionmayoverturnaparliamentarydeterminationoftheChairbymajorityvote.Robert’sRulesofOrdermaybeconsideredasaparliamentaryguide.TheTownAttorneyshallserveasaparliamentaryprocedureresource.B.PublicInvitedtobeHeard.TheChairmayallowpersonalappearancesatthebeginningofeachregularmeetingbyanypersondesiringtospeakonamatternotontheagenda.TheCommissionshallnottakeactiononitemspresentedundersuchpersonalappearances.Anystatementmadeshallberelevanttolandusemattersandshallbenotmorethanthreeminutesperpersoninduration.TheChairshallrequestthatallpersonssoappearingidentifythemselvesbynameandaddress.C.ConsentAgenda.Itemsontheconsentagendamaybeapprovedintheaggregatebyasinglemotion.AnyCommissionermayremoveanyitemfromtheconsentagenda.Removeditemsshallbeheardfollowingthedispositionoftheremainingconsentagenda,andshallbediscussedandvotedonseparately.D.FormalAction.Eachformalactionrequiredbylaworordinanceshallbeembodiedinaformalmotionorresolution.E.ReviewCriteria.Thoseitemstobeconsideredwhichrequirereviewpursuanttoadoptedcriteriashallbeconsideredinthecontextofsuchcriteria.TheCommissionshallstatefindingsbasedonthecriteriawhentakingactiononsuchanitem.F.ChairProTem.IntheeventtheChairandtheViceChairarebothabsentorunabletoactinaregularorspecialmeetingwhereaquorumhasbeenmet,anothermemberoftheCommissionshallbechosenbytheCommissiontoperformtheresponsibilitiesoftheChairforthemeeting.G.TimelyConclusionofMeetings.Regularmeetingsshallendnolaterthan5:00PMunlesstheCommissionapprovesanextensiontothemeetingbyatwo-thirds(2/3)majorityvote.Anyitemontheagendawhichcannotbeheardandconsideredbytheconclusionofthemeetingmay,asprovidedbytheDevelopmentCode,becontinueduntilandheardatthenextregularlyscheduledmeeting,oraspecialmeeting,andshallhavepriorityoveranyothermatterstobeheardandconsidered.H.CancellationofMeetings.RegularlyscheduledmeetingsoftheCommissionmaybecanceledorrescheduledupondeterminationbytheChair.IntheeventnoapplicationhasbeenreceivedforhearingbytheCommissionatanyregularlyscheduledmeeting,andintheabsenceofotherpressingbusiness,theCommunityDevelopmentDirectormaycancelthemeeting. VI.ATTENDANCEAllmembersshallattendallmeetings,includingspecialmeetings,oftheCommission,ifpossible.Intheeventanymembermissesthree(3)consecutiveregularmeetingsoratotaloffour(4)regularmeetingsinacalendaryear,theCommissionmayreportsuchabsenteeismtotheTownBoard.VII.COMPLIANCEWITHTOWNPOLICIESA.CompliancewithTownPolicies.InadditiontotheseBylaws,theCommissionoperatesunderthetermsoftheTownofEstesParkGovernancePolicy102,asamendedfromtimetotime.ThePolicytermsareincorporatedintotheseBylawsbythisreference.AcopyofthatPolicy,alongwiththeseBylaws,shallbeprovidedtoeachmemberatthetimeoftheirappointment.B.VolunteerClassification.ParticipationasamemberoftheCommissionisdoneofone’sownfreewillinthecontextofvolunteerism.VolunteersappointedbytheTownBoardwillactinaccordancetoanyadoptedTownvolunteermanualorpolicy.VIII.CONFLICTOFINTERESTAllmembersoftheCommissionaresubjecttothestandardsofconductundertheStateofColoradoCodeofEthics,Sections24-18-101etseq.,CR5.,andArticleXXIXoftheColoradoConstitution(Amendment41).AtthetimeofintroductionofanindividualitemontheCommissionagendainwhichthememberhasaconflictofinterest,themembershallstatethatheorshehasaconflictofinterestandthenabstainfromparticipatingandvotingonthematter.AmemberhavingaconflictofinterestonanymattershallnotattempttoinfluenceothermembersoftheCommissionatanytimewithregardtosaidmatter.Adoptedthis—dayof____________,2020ESTESPARKBOARDOFTRUSTEESBy:ToddJirsa,r
