HomeMy WebLinkAboutRESOLUTION 32-130CRESOLUTIONNO.32-13ARESOLUTIONSUSPENDINGUTILITYFEESFOR2013FLOODVICTIMSWITHHOMESANDBUSINESSESWITHOUTELECTRICORWATERSERVICEWHEREAS,inSeptember2013,severefloodingintheserviceareasoftheTown’sLight&PowerandWaterEnterprisesdamagedpublicandprivatepropertyandtheTown’sutilitydistributionsystems;andWHEREAS,somehomesandbusinessesweredestroyedordamagedandtheirelectricand/orwaterserviceisunavailable;andWHEREAS,pursuanttotheTown’sutilityrates,allcustomersarerequiredtopayminimummonthlyutilityfees;andWHEREAS,theBoardofTrusteesservesastheBoardofDirectorsfortheTown’stwoutilitiesandhastheauthoritytomodifyelectricandwaterchargesunderspecialcircumstances;andWHEREAS,theTownBoardofTrusteeswishestosuspendmonthlyminimumchargesforwaterandelectricityasprovidedinthisResolution.NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:1.ThemonthlyminimumchargesforwaterandelectricityforTowncustomersshallbesuspendedunderthefollowingcircumstances:a)Anycustomerwhosestructurewasdestroyedorisunsafe,andtheirelectricorwaterserviceisshowntobeunavailablefromtheTown.2.AnycustomerspecifiedinParagraph1mayrequestsuspensionofminimumchargesforutilityservicesbyprovidingawrittenrequestandafulldescriptionoftheirsituationtotheTown’sUtilityBillingDepartment.ThecustomershallberequiredtoprovidewrittennoticetotheTownoftherestorationofutilityservice.1 oo3.ThesuspensionoftheminimumchargesshallberetroactivetoOctober1,2013,andshallbeeffectiveuntilOctober1,2014,oruntiltheutilityserviceisinuse,whicheveroccursfirst.Datedthis1&’dayofr-atpt2013./MayorATTEST:m0d.Clerk2
