13-1300RESOLUTIONNO.13-13ARESOLUTIONESTABLISHINGANEXTENTIONTOTHEPERMITTINGPERIODFORNONCONFORMINGHOMESDESTROYEDBYTHEWOODLANDSHEIGHTSFIREWHEREAS,onJune23,2012afireintheWoodlandHeightsareainEstesParkdestroyedtwenty-four(24)residentialhomes;andWHEREAS,theEstesParkBoardofTrusteeswishtoassistfiresurvivorsintheirrebuildingeffortsbyofferingadditionalflexibilitythroughamendmentstoadoptedlanduseregulations,includingmodifiedpermittingandapprovalprocedures;andWHEREAS,fullimpositionofcurrentregulationsmaycreateadditionaldistressandhardshipforexistingresidentsandpropertyownersintheEstesValleyaffectedbytheWoodlandHeightsFire;andWHEREAS,theEstesParkBoardofTrusteesfindsthatownersoflegallyestablishedbuildings,usesandstructuresinexistencepriortotheWoodlandHeightsFiremaydesiretorebuildand/orcontinuetheirusesinthesamemannerthatsuchstructuresanduseshavehistoricallyexisted;andWHEREAS,rebuildingisnotanticipatedtogeneratenewtrafficonceconstructioniscomplete;andWHEREAS,therebuildingprogramimposedbythisResolutionisareasonableandsufficientlengthintimetoallowexistingresidentsaffectedbytheWoodlandHeightsFiretoapplyforandobtainbuildingpermitsorotherapprovalsfromtheCounty.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:Section1.UpontheadoptionofthisResolution,aWoodlandHeightsFirePermittingExtensionisherebyapprovedinaccordancewiththeprovisionssetforthherein.Section2.TheWoodlandHeightsFirePermittingExtension(“Extension”)shallbeeffectiveforstructuresthathaveburnedorhavebeendamagedbeyondrepairintheWoodlandHeightsFireArea,asshownonthemapattachedasExhibitA(“Area”).TheExtensionshallcommenceonJune25,2013andconcludeonJuly30,2015,unlessthisResolutionissoonerrepealedordulyextendedbyactionoftheBoardofTrustees. 0CSection3.AllbuildingsandstructureslocatedintheWoodlandHeightsFireArea(ExhibitA),andlegallyconstructedpriortoJune23,2012,areeligiblefortheWoodlandHeightsFirePermittingExtension.StructuresconstructedwithoutpriorapprovalornotlegallyconstructedmaybeeligibleiftheymeettherequirementslistedinSectionFiveofthisResolutionandareapprovedbyLarimerCountyandtheTownofEstesPark.AllrequiredapplicationmaterialsforparticipationintheExtensionmustbefiledwithLarimerCountyandtheTownofEstesParkpriortotheexpirationoftheExtension.Section4.ForthedurationoftheWoodlandHeightsFirePermittingExtension,LarimerCountyandtheTownofEstesParkwillapplythefollowingreviewandapprovalprocessesintheAreainlieuofthosesetoutintheEstesValleyDevelopmentCode:1.Documentationofanonconformingbuilding,structureoruse.ResidentsmayrequestadeterminationfromtheEstesParkCommunityDevelopmentDepartmentthatabuilding,structureoruseisorisnotalegalnonconformingbuilding,structureoruse.Thepropertyownerisresponsibleforprovidingsufficientevidencetoestablishthesizeanddateonwhichthestructurewasconstructedortheusewasestablished.TheLarimerCountyCommunityDevelopmentDepartmentandtheEstesParkCommunityDevelopmentDepartmentwillassistinresearchingapplicablerecordsandreviewingtheinformationprovidedbythepropertyowner,includingbutnotlimitedto:•Historicalrecordsandphotosshowingwhenause/buildingwasestablished.•RecordsoftheCountyAssessor.•RecordsoftheCommunityDevelopmentDepartments.•Descriptionoftheuse(type,size,volume,frequency,hoursofoperations,etc.).•Certificationshowingwhethertheuse/buildinghasbeenincontinuousoperationsinceestablishedandupuntilthetimeofthefire.•OtherrecordsasdeemedappropriatebytheLarimerCountyorEstesParkCommunityDevelopmentDirectors.2.Rebuildingnonconformingbuildingsandstructures.ThepropertyownershallsubmitacompletebuildingpermitapplicationbyJuly30,2015.Thebuildingorstructuremayonlyberebuiltinthesamelocation,sizeandcharacterastheoriginalbuildingorstructureunlesstheEstesParkCommunityDevelopmentDirectordeterminesthattheexistingsiteconditionsmakesuchlocation,sizeorcharacterimpracticalorunnecessary.3.Reestablishinganonconforminguse.Thetimeframetoreestablisha 00nonconformingusedestroyedoraffectedbytheWoodlandHeightsFireisherebyextendedtoJuly30,2015.4.Setbackrequirements.ReplacementbuildingsandstructuresshallmeetcurrentsetbackrequirementsunlesstheEstesParkCommunityDevelopmentDirectordeterminesthattheexistingsiteconditionsmakesuchlocationimpracticalorunnecessary.TheEstesParkCommunityDevelopmentDirectorshallbeauthorizedtoapproveavarianceofupto50%ofthecurrentsetbackrequirementsuponfindingthefollowingcriteriahavebeenmetordeterminedtobeinapplicable:A.Therearespecialcircumstancesorconditions,suchasexceptionaltopographicconditions,narrowness,shallownessortheshapeofproperty,orotherextraordinaryandexceptionalsituationorconditionofsuchpieceofproperty,thatarepeculiartothelandorstructureforwhichthevarianceisrequested;B.Thestrictinterpretationandenforcementoftheprovisionsofthecodewouldcauseanunnecessaryandunduehardship;C.Grantingthevariancewillnotresultinasubstantialadverseimpactonotherpropertyinthevicinityofthesubjectlandorstructure;D.Forcasesthatrequireavariance,associatedfeesshallbewaived.Section5.ForthedurationoftheExtensiontheTownofEstesParkmayconsiderrequestsonacasebycasebasistorebuildabuildingorstructure(s)thatmayhavenotbeenlegallypermittedorconstructed.AspartoftheReviewprocess,TownStaffwillvisitthesiteandcompleteapublicsafetyoverview.ThedestroyedbuildingorstructuremaybeallowedtobereplaceduponapprovaloftheEstesParkCommunityDevelopmentDirectorifthefollowingconditionsaremetoraredeterminedtobenotapplicable:A.Accessroadwayisuseableandaccesslocationdoesnotimpactfunctionandsafetyofpublicroadways.B.AdequatedrainageisprovidedandapprovedbytheLarimerCountyEngineeringDepartmentand/ortheEstesParkPublicWorksDepartment.C.Adequatewaterandsewerprovisionsexistorcanbeprovidedandapprovedbytheappropriateagencies.D.Structuresarelocatedinamannerthatmitigatestothemaximumextentpracticabletheimpactsfromnaturalhazards,includingbutnotlimitedtoflood,firedamage,unstablesoilsandgeologicalhazards.E.Theproposedbuildingorstructurewillnotresultinasubstantialadverseimpactonotherpropertyinthevicinityofthesubjectproperty.F.AnyareasofsignificantconcernasidentifiedbytheEstesParkCommunityDevelopmentDirectorwillbeaddressedatapublichearingbeforetheBoardofCountyCommissioners.Section7.Shouldanyoneormoresectionsorprovisionsofthis 00Resolutionbejudiciallydeterminedtobeinvalidorunenforceable,suchdeterminationshallnotaffect,impairorinvalidatetheremainingsectionsorprovisionsofthisResolution,itbeingtheintentoftheBoardthatsuchinvalidorunenforceableprovisionsareseverable.Section8.ForthedurationoftheProgram,intheeventofanyinconsistencybetweentheResolutionandanyotherEstesValleyDevelopmentCode,thisResolutionshallcontrol.PASSEDANDADOPTEDthisdayofATTEST:‘z;-.wnClerk.2013.Mayor
