Home My WebLink AboutRESOLUTION 08-20RESOLUTION08-20APPROVINGAMENDEDPLATNO.1OFTHEESTESPARKRESORTTOWNHOMESUBDIVISION,TOWNOFESTESPARK,COLORADOWHEREAS,anapplicationforanAmendedPlattoremovetwolotswithinaplatted“TownhomeSubdivision”wasfiledbyMountainVillageDevelopment,LLC(owner/applicant);andWHEREAS,theEstesParkResortTownhomeSubdivisionisrecordedintherecordsoftheLarimerCountyClerkandRecorderatReceptionNo.20180005399,onJanuary26,2018,consistingof33lotsonaparcelapproximatelynineacresinsize,andlocatedwithinanA(Accommodations)ZoningDistrict;andWHEREAS,theAmendedPlatremovestwoofthe33lots,andslightlyreconfiguresadjacentlots,withnootherchangestotheplatbeingproposed;andWHEREAS,apublicmeetingwasheldbeforetheEstesValleyPlanningCommissiononNovember19,2019,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindings:1.ThisproposalcomplieswithapplicablesectionsoftheEVDC.2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Noissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.WHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonJanuary28,2020andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;andWHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationofthePlanningCommissionandthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesValleyDevelopmentCode. NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:AmendedPlatNo.1,EstesParkResortTownhomeSubdivisionisherebyapproved,withthefollowingconditionofapproval:1.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalPlatapplication,thedevelopershaHsubmittheplatforrecording.Iftheplatisnotsubmittedforrecordingwithinthissixty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.DATEDthisZtdayof_ ____ _ ____ _ ____ ,2020.TOWNOFESTESPARKMayorATTEST:APPROVEDASTOFORM:TownAttorney
