HomeMy WebLinkAboutMINUTES Town Board 2019-10-22TownofEstesPark,LarimerCounty,Colorado,October22,2019MinutesofaRegularmeetingoftheBoardofTrusteesoftheTownofEstesPark,LarimerCounty,Colorado.MeetingheldintheTownHallinsaidTownofEstesParkonthe22nddayofOctober,2019.Present:ToddJirsa,MayorRonNorris,MayorProTernTrusteesEricBlackhurstMarieCenacPatrickMartchinkKenZornesAlsoPresent:TravisMachalek,TownAdministratorDanKramer,TownAttorneyBunnyVictoriaBeers,RecordingSecretaryAbsent:TrusteeCarlieBangsMayorJirsacalledthemeetingtoorderat7:00p.m.andalldesiringtodoso,recitedthePledgeofAllegiance.AGENDAAPPROVAL.Itwasmovedandseconded(Martchink/Zomes)toapprovetheAgenda,anditpassedunanimously.PUBLICCOMMENTS.BelleMorris/TransportationAdvisoryBoardChairencouragedtheBoardtocontinueconsiderationoftheDowntownParkingManagementPlanPhaseII.FrankTheis/TownCitizenstatedtheurgencywhichexistsforworkforcehousingandchildcareneedinthearea.JohnMeissner/TownCitizenstatedconcernregardingcommentsexpressedatthestudysessionoverconstituentscomplaintsattheOctoberTrusteeTalk.Healsostatedconcernforalocalbusinesswhichwasvandalized.TownAdministratorMachalekstatedthevandalizationisunderinvestigationisthePoliceDepartmentaredeterminingwhetherthesituationiscivilorcriminal.NancyAlmond/EstesValleyInvestmentinChildhoodSuccess(EVICS)DirectorstatedMountainTopChildcarehasbeenpurchasedbylocalswhoarecommittedtoretainingthebusinessasachildcarefacilityandpotentiallyexpandingcareforinfantandtoddlers.TheCCAPfreezeinLarimerCountycontinuesforthefourthyearandisanticipatedtocontinueforanadditionalyear.ThefreezehasledtoanincreaseinEVICSscholarships.In2019EVICSassisted45childrenandprojects$60,000inscholarshipsfor2019.TheBoardwasinvitedtotheEVICSWinterWonderlandArtGalaFundraiserevent.KurtisKelly/EstesParkMuseumFriendsandFoundationIncPresidentstatedtheprogramforrecordingoralhistorieswentdormantin2019duetostaffingshortages.HerequestedBoardsupportfortheadditionalmediaemployeebudgetedfor2020.JohannaDarden/TownCitizenstatedshewouldnotsupporttheformationofaEstesParkRegionalTourismAuthorityandrequestedinformationbeprovidedtothepublicregardingtheoversightoftheStanleyproperty.TOWNBOARDCOMMENTSTrusteeBlackhurstattendedtheEstesValleyPlanningCommissionmeetingonOctober15,2019wheretheprocessfor“changeofuse”wasreviewed. BoardofTrustees—October22,2019—Page2TrusteeZorneswouldattendtheOpenLandsAdvisorymeetingtobeheldonOctober24,2019.AninvitationwasextendedtotheBoardforaVeteran’sDayeventonNovember11,2019tobeheldattheVeteransMonumentneartheVisitorsCenter.MayorProTernNorrisstatedtherecontinuestobebearactivityintheareaandencouragedcitizenstosecuretheirhomesandvehicles.MayorJirsastatedPlatteRiverPowerAuthoritywouldholdalisteningsessiononOctober23,2019topresenttheirIntegratedResourcePlan.TrusteeCenacencouragedthepublictoattendtheEVICSWinterWonderlandArtGalaFundraisereventonDecernber5,2019.TrusteeMartchinkattendedtheTrusteeTalkonOctober16,2019statingcommentsduringtheTrusteeTalkareimportantandwelcomespubliccommentduringtalksheldbytheBoard.TheOctober17,2019ParksAdvisoryBoardmeetingwascancelled.HeattendedtheEstesParkEconomicDevelopmentCouncil(EDC)meetingheldonOctober17,2019andwasimpressedwithoveralloperationoftheEDC.TOWNADMINISTRATORREPORT.AdministratorMachalekstatedthesecondoftwobudgetStudySDessionswouldbeheldonOctober25,2019.CONSENTAGENDA:1.Bills.2.TownBoardMinutesdatedOctober8,2019,TownBoardStudySessionMinutesdatedOctober8,2019andSpecialJointMeetingwithLarimerCountyCommissionersMinutesdatedSeptember30,2019.3.EstesValleyPlanningCommissionMinutesandStudySessionMinutesdatedSeptember17,2019(acknowledgmentonly).4.ParksAdvisoryBoardMinutesdatedSeptember19,2010(acknowledgmenton1y)75.TransportationAdvisoryBoardMinutesdatedSeptember18,2019(acknowledgmentonly).Itwasmovedandseconded(Cenac/Norris)toapprovetheConsentAgenda,anditpassedunanimously.PLANNINGCOMMISSIONITEMS:ItemsreviewedbyPlanningCommissionorstaffforTownBoardFinalAction.1.ACTIONITEMS:A.ORDINANCE16-19AMENDMENTTOTHEESTESVALLEYDEVELOPMENTCODE5.1.B.VACATIONHOMETOREVISEDEADLINEFOR(“CAP”)NUMBEROFVACATIONHOMESINRESIDENTIALZONINGDISTRICTS.TheordinancewasinitiallybroughtforwardtoamendthereviewdatetoJune30,ofeachyearforthevacationhomecapnumberinresidentialzoningdistricts.AttheJune28,2019regularmeetingitwasdeterminedchangestorenewaldeadlinesforbusinesslicensesandvacationhomeregistrationrenewalsfor2020wouldbebroughtforwardinNovember2019whichwouldnolongerrequireanadjustmenttothedatethecapisreviewedforvacationhomes.DuetotherenewalperiodchangesstaffrecommendsOrdinance16-19bepostponedindefinitely.Itwasmovedandseconded(Zornes/Norris)totableOrdinance16-19,anditpassedunanimously.ACTIONITEMS: BoardofTrustees—October22,2019—Page31.ESTESVALLEYPLANNINGCOMMISSIONINTERVIEWCOMMITTEE.Itwasmovedandseconded(Norris/Cenac)toappointMayorJirsaandTrusteeBlackhursttotheEstesValleyPlanningCommissionInterviewCommittee,anditpassedwithTrusteeBlackhurstabstaining.REPORT&DISCUSSIONITEMS:1.RESTRICTIVECOVENANTFORTHEPRELIMINARYCONDOMINIUMMAPS,THEDIVIDECONDOMINIUMSATWILDFIRE,ANDTHEMEADOWCONDOMINIUMSATWILDFIRE,WILDFIREROAD,WESTOVERCONSTRUCTION,INC.,RDAASSOCIATESLLC,APPLICANTS.OnOctober8,2019theBoardapprovedpreliminarycondominiummapsfortheWildfireproject,ontheconditionAttorneysfortheTownandtheDeveloperreachacompromiseonthecovenantlanguage.AttorneyKramerstatedcovenantshavebeenmodifiedinthefollowingways:adeedoftrustrequirementhasbeenomitted;stronglywordedwarningshavebeenaddedtothebeginningofthecovenant;deedsfortheworkforceunits,contractsforpurchaseandsaleofworkforceunitswouldberequiredtoreferencethecovenants;failuretocomplywithcovenantswouldresultinliquidateddamagesintheamountof$25,000peryear;andfailuretocomplywiththecovenantscanexplicitlyresultincourtinjunctionrequiringthesaleofthehome;andtheTownwouldbeabletorecoupfees,costs,anddamagesfromtheseller’sproceeds.Theprovisionsweredesignedtowarnpartiesoffuturetransactionsandmakeitdisadvantageoustoallowoccupancybyunqualifiedresidents.TrusteeCenacrequestedclarificationonthewarninglanguageandhowthosewhodonotheedthewarningswouldbepursued.LANDUSEINTERGOVERNMENTALAGREEMENT(IGA)OPTIONS.DirectorHuntprovidedfollowuptotheSeptember30,2019jointmeetingwiththeLarimerCountyCommissionrequestingdirectionfromtheBoardinpreparationfortheNovember14,2019jointmeeting.HeprovidedamatrixwhichoutlinedtheEstesValleyIGAcomparisons.OptionswhichwerereviewedduringtheSeptember30,2019meetingincluded;OptionAtocontinuethecurrentIGAwhichdidnotgainoutrightsupport;OptionBwhichwouldseparatemostfunctionsfortheTownandCounty;andOptionCretainingthestructureofOptionB,withseparationofTown/CountyjurisdictionandincludeajointComprehensivePlan,jointPlanningCommissionandBoardofAdjustment,and/orjointDevelopmentCode.TheBoardwasinagreementtoretaintheNovember14,2019dateforreviewoftheIGAwiththeCounty.TheBoardrequestedmoreinformationbeprovidedregardingthepresentedoptionsandhowtheyrelatetoannexation.StaffrequestedthecurrentPlanningCommissionmaintainaroleintheComprehensivePlanningprocesswhichtheBoardwasinagreement.Additionally,staffrequestedatransitionperiodforthejointPlanningCommissiontoaddressitemswhichwereunderreviewpriortothechangestotheIGAwhichtheBoardwasinagreement.StaffrecommendedseparatePlanningCommissionsandstatedifseparatetherecouldbequarterlymeetingswiththeBoards.TheBoardagreedseparatePlanningandDevelopmentCodeswouldrequireseparatereviewingcommissions.BoardconsensuswasreachedtoretainajointComprehensivePlanbetweentheTownandCounty.Boardcommentshavebeensummarized:Whetherthereisapossibilitytomaintaindifferentcodeswhichresembleeachother,andseparateadministrationofeachcodebytherelevantstaff;clarificationofthedeadlineswasrequested;thepossibilityofasinglecodewithadistinguishingsectionwhichwouldapplytoTownandCountyjurisdiction;theneedforadditionalpublicinputrelatedtoseparatecodes;concernwasheardrelatedtoseparateadministrationandlegalreviewofdifferentcodes;andwhatownershipissueswouldexistifthereisnotafirmlinethatcorrelatestoadirectbreakinthecodearea.KentSmith/Towncitizenwasinsupportofdifferentdevelopmentcodeswithdifferentgoverningbodies.CraigEllsworth/CountycitizenwasinsupportofasinglecodewithTownandCountysections.
