26-19RESOLUTION26-19TOREFERCITIZENINITIATEDORDINANCE23-19TOASPECIALMUNICIPALELECTIONONTUESDAY,DECEMBER10,2019WHEREAS,onJuly31,2019,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk;andWHEREAS,onAugust28,2019,theTownClerkissuedaStatementofSufficiencyandpresentedthepetitionstotheTownBoardonSeptember10,2019statingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures;andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition;andWHEREAS,followingsaidreviewtheBoardofTrusteesdidnotadopttheInitiatedOrdinancePetitionaspresented.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:1.InitiatedOrdinance23-19isherebyreferredtotheregisteredelectorsoftheTownofEstesPark,ColoradoforaSpecialMunicipalElectiononDecember10,2019.2.TheTownClerkisherebyorderedtoforthwithpublishtheInitiatedOrdinance.3.Theballotquestionshallreadasfollows:Shalltheoperationofalimitednumberofmarijuanafacilitiestoincluderetailmarijuanacultivationfacilities,retailmarijuanastores,medicaloptionalpremises,andmedicalmarijuanacenters,beallowedwithinTownlimits?YESNO4.ItisthedecisionoftheTownBoardofTrusteesbytheadoptionofthisResolutiontoholdtheSpecialElectionasamailballotelectionpursuanttotheprovisionsofSection31-10-907—31-10-913C.R.S.5.ThatJackieWilliamson,TownClerkbeandisherebyappointedastheDesignatedElectionOfficialfortheTownofEstesParkfortheconductofthismailballotelection. 6.Thereshallbeone(1)precinctforthismailballotelection.ThemailballotlocationforsaidprecinctshallbetheEstesParkTownHall,170MacGregorAvenue,EstesPark,Colorado80517.7.ElectronicvotingsystemshallbeusedintheSpecialElectionandthattheTownClerkbeandisherebyauthorizedanddirectedtoperformallactsandfunctionsnecessaryfortheuseofsuchelectronicvotingsystemasrequiredbythelawsoftheStateofColoradopertainingthereto.8.PursuanttoSection31-10-401C.R.S.,theBoardofTrusteesherebydelegatestotheTownClerk,byResolution,theauthorityandresponsibilitytoappointtheJudgesofElection.9.TheTownClerkbeauthorizedtogiveNoticeoftheSpecialElectionatleastten(10)dayspriortotheelectionasrequiredbySection31-4-502(2)C.R.S.inaccordancewithSection31-10-501C.R.S.10.TheTownClerkshall,attheexpenseoftheTown,arrangeforsuchmaterialsandsuppliesforsuchelectionasmaybenecessary.DATEDthis)‘dayofcc.e-Ffl019.TOWNOFESTESPARK,COLORADOMayorVATTEST: ORDINANCENO.23-19CITIZENINITIATEDORDINANCETOPERMITTHEOPERATIONOFMARIJUANAFACILITIESWITHINTOWNLIMITSWHEREAS,onJuly31,2019,anInitiatedOrdinancePetitionwasfiledwiththeTownClerk;andWHEREAS,onSeptember10,2019,theTownClerkpresentedaStatementofSufficiencytotheTownBoardstatingthattheInitiatedOrdinancePetitionhastherequisitenumberofsignatures;andWHEREAS,theBoardofTrusteeshavereviewedtheInitiatedOrdinancePetition.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,asfollows:Section1:Thetwoarticlesthatrequireamendingarearticles9.44andarticle9.48:a.9.44currentlystates“itisunlawfulforanypersontooperate,causetobeoperatedorpermittobeoperatedamedicalmarijuanace,nter,anoptionalpremisescultivationoperation,oramedicalmarijuana-infusedproductsmanufacturingfacilityintheTown.”Whereasthosewhosignthispetitionbelieveitshouldread,“itislawfulforapersonoperatingunderanEstesParkissuedlicensetooperateamedicalmarijuanacenterand/oranoptionalpremisescultivationoperationintheTown.Itisunlawfulforanypersontooperate,causetobeoperatedorpermittobeoperatedamedicalmarijuana-infusedproductsmanufacturingfacilityintheTown”b.9.48currentlystates“Itisunlawfulforanypersontooperate,causetooperateorpermittobeoperatedanymarijuanacultivationfacilities,marijuanaproductmanufacturingfacilities,marijuanatestingfacilitiesandretailmarijuanastoreswithintheTown,andallsuchusesareherebyprohibitedinanylocationwithintheTownorwithinanyareahereinafterannexedtotheTown.”Whereasthosewhosignthispetitionbelieveitshouldread,“itislawfulforapersonoperatingunderanEstesParkissuedlicensetooperateamarijuanacultivationfacilityand/orretailmarijuanastoreswithintheTown.Itisunlawfulforanypersontooperate,causetooperateorpermittobeoperatedanymaruanaproductmanufacturingfacilitiesormarijuanatestingfacilities”c.ArticleXVIII,Section16oftheColoradoconstitutiongivesColoradocitizenstheabilitytoestablishandoperatemarijuanaestablishments,whereastheTownofEstesPark’smunicipalcodetakesthatabilityaway.TheTownwouldgreatlybenefitfromanewsourceofrevenueandit’sinthebestinterestofthecitizensofEstesParktopreservetheirpersonalfreedoms.d.ThepurposeofthisinitiatedmeasureistoamendtheEstesParkmunicipalcodes,article9.44and9.48inordertomorealignwiththestatelaw,Article XVIII,Section16andtheColoradomedicalmarijuanacode.AllowtheoperationofRecreationalMarijuanaEstablishmentsandMedicalMarijuanaBusinesseswithinthetownlimitsoftheTownofEstesPark.e.Theinitiatedordinancewould:1.AmendthemunicipalcodetoallowtheoperationofRecreationalMarijuanaEstablishmentsandMedicalMarijuanaBusinesseswithinthetownlimitsoftheTownofEstesPark.2.Provideforthelawfulsaleandcultivationofrecreationalandmedicalmarijuanapursuanttothestatelicensingsystem.3.LimitpermittedTownzonesfortheoperationoflicensedretailersandcultivatorstoCommercial—Outlying(CC)andCommercial—Heavy(CH).4.ProhibittheoperationoflicensedretailersandcultivatorsintheCommercialDowntown(CD)zoneaswellasanyzonethatisnot(CC)or(CH)5.Createsetbacksrequiringtheoperationoflicensedretailersandcultivatorstobeatleast1000ftfromschools(K-12)6.Createfourclassesoflicenses:a)RetailMaruanaCultivationFacility,b)RetailMarijuanaStore,c)MedicalOptionalPremises,d)MedicalMarUuanaCenter.7.Supportduallicensingforeachtypeoflicense(localinadditiontostatelicenses)8.Imposealimitofthreelicenseholdersforeachtypeoflicense.9.Imposecommunityoutreach,whichrequirestheeducationofresponsibleconsumptiontotheconsumerbaseofEstesPark.10.Permitandimposetaxationofrevenuesderivedfromcommercialmarijuanafacilities(bothexcisetaxandretailsalestax)viaanelectioninNovember2019anddeterminetheallocationofsaidrevenuesviaanelectioninNovember2019.11.NotallowtheimpositionofunreasonablyimpracticalmeasurestocomplywithTownregulationsconcerningmarijuanaestablishmentsandbusinesses.12.AllowtheTowntoestablishadministrativerulesinsupportofthenewlicensesandapplicationprocesses.13.Thetypesoflicensesareasfollows:a.Recreationalmarijuanacultivationfacility:licenseallowingforthecultivationofrecreationalmarijuanaproducts.b.Medicalcultivation:licenseallowingforthecultivationofmedicalmarijuanaproducts.c.Retailmarijuanastore:licenseallowingforthesaleofrecreationalproductsd.Medicalmarijuanacenter:licenseallowingforthesaleofmedicalproducts14.TheapplicationprocessshallincludethefollowingwithdetailstobedeterminedthroughtheTown’sadministrativerule-makingprocess:a.Applicationprocedure b.Applicationrequirementswillincludethefollowing(andisnotlimitedtothefollowing)1.Siteplans2.Operatingplans3.Securityplan4.Communityoutreachandengagementc.Applicationfees1.Initialapplicationfees2.Annualrenewalfeesd.Ownershiprequirementse.Backgroundchecksf.Inspectionsf.DEFINITIONS.Asusedinthissection,unlessthecontextotherwiserequires:1.“ColoradoMedicalMarijuanaCode”meansarticle43.3oftitle12,ColoradoRevisedStatutes.2.“Consumer”meansapersontwenty-oneyearsofageorolderwhopurchasesmarijuanaormarijuanaproductsforpersonalusebypersonstwenty-oneyearsofageorolder,butnotforresaletoothers.3.“Marijuana”or“marihuana”meansallpartsoftheplantofthegenuscannabiswhethergrowingornot,theseedsthereof,theresinextractedfromanypartoftheplant,andeverycompound,manufacture,salt,derivative,mixture,orpreparationoftheplant,itsseeds,oritsresin,includingmarihuanaconcentrate.“Marijuana”or“marihuana”doesnotincludeindustrialhemp,nordoesitincludefiberproducedfromthestalks,oil,orcakemadefromtheseedsoftheplant,sterilizedseedoftheplantwhichisincapableofgermination,ortheweightofanyotheringredientcombinedwithmarijuanatopreparetopicalororaladministrations,food,drink,orotherproduct.4.“MedicalMarijuanaBusiness”meansalicensedMedicalMarijuanaCenter,aMedicalMarijuana-InfusedProductsManufacturer,anOptionalPremisesCultivationOperation,aMedicalMarijuanaTestingFacility,aMedicalMarijuanaBusinessOperator,aMedicalMarijuanaTransporter,aMarijuanaResearchandDevelopmentFacility,oraMarijuanaResearchandDevelopmentCultivation.5.“Marijuanaaccessories”meansanyequipment,products,ormaterialsofanykindwhichareused,intendedforuse,ordesignedforuseinplanting,propagating,cultivating,growing,harvesting,composting,manufacturing,compounding,converting,producing,processing,preparing,testing,analyzing,packaging,repackaging,storing,vaporizing,orcontainingmarijuana,orforingesting,inhaling,orotherwiseintroducingmarijuanaintothehumanbody.6.“Marijuanacultivationfacility”meansanentitylicensedtocultivate,prepare,andpackagemarijuanaandsellmarijuanatoretailmarijuanastores“Marijuanaestablishment”meansamarijuanacultivationfacility,a marijuanatestingfacility,amarijuanaproductmanufacturingfacility,oraretailmarijuanastore.7.Marijuanaproductmanufacturingfacilitymeansanentitylicensedtopurchasemarijuana;manufacture,prepare,andpackagemarijuanaproducts;andsellmarijuanaandmarijuanaproductstoothermarijuanaproductmanufacturingfacilitiesandtoretailmarijuanastores,butnottoconsumers.8.‘Marijuanaproducts”meansconcentratedmarijuanaproductsandmarijuanaproductsthatarecomprisedofmarijuanaandotheringredientsandareintendedforuseorconsumption,suchas,butnotlimitedto,edibleproducts,ointments,andtinctures.9.“Marijuanatestingfacility’meansanentitylicensedtoanalyzeandcertifythesafetyandpotencyofmarijuana.10.“Medicalmarijuanacenter”meansanentitylicensedbyastateagencytosellmarijuanaandmarijuanaproductspursuanttosection14ofthisarticleandtheColoradoMedicalMarijuanaCode.11.”Retailmaruanastore’meansanentitylicensedtopurchasemarijuanafrommarijuanacultivationfacilitiesandmarijuanaandmarijuanaproductsfrommarijuanaproductmanufacturingfacilitiesandtosellmarijuanaandmarijuanaproductstoconsumers.12.”Unreasonablyimpracticable”meansthatthemeasuresnecessarytocomplywiththeregulationsrequiresuchahighinvestmentofrisk,money,time,oranyotherresourceorassetthattheoperationofamarijuanaestablishmentisnotworthyofbeingcarriedoutinpracticebyareasonablyprudentbusinesspersonSection2:ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.OnSeptember10,2019,theBoardofTrusteesoftheTownofEstesPark,Coloradodidnotpasstheordinance,andbystatestatute31-11-104havereferredtheinitiatedordinancetotheregisteredelectorstoaspecialelectiononDecember10,2019.
