HomeMy WebLinkAboutMINUTES Estes Valley Board of Adjustment 2014-01-07 RECORD OF PROCEEDINGS Regular Meeting of the Estes Valley Board of Adjustment January 7, 2014 9:00 a.m. Board Room, Estes Park Town Hall Board: Chair Jeff Moreau, Vice-Chair Bob McCreery, Members John Lynch, Wayne Newsom, and Pete Smith; Alternate Member Chris Christian Attending: Members Newsom, Smith and Lynch Also Attending: Senior Planner Shirk, Planner Kleisler, Recording Secretary Thompson Absent: Members McCreery and Moreau Member Lynch called the meeting to order at 9:00 a.m., acting as Chair Pro-Tem. There was a quorum in attendance. He introduced the Board members and staff. The following minutes reflect the order of the agenda and not necessarily the chronological sequence. There were three people in attendance. 1. PUBLIC COMMENT None. 2. CONSENT Approval of minutes of the November 5, 2013 meeting. It was moved and seconded (Smith/Newsom) to approve the Consent Agenda as presented and the motion passed unanimously. 3. TRACT 6, BEAVER POINT 1ST ADDITION, TOWN OF ESTES PARK, 650 Moraine Avenue Planner Kleisler reviewed the staff report. The applicant, Dallman Construction, recently received approval of a Development Plan and Preliminary Subdivision Plat for Mountain River Townhomes. This development includes plans for 26 single-family units. Prior to approval, the plans were revised to increase a wildlife migration corridor, which in turn created a requirement for a fire truck turnaround. The proposed location of the turnaround requires variances from the following Estes Valley Development Code sections: Section 4.4, Table 4-5, which requires a 25-foot front setback in the A–Accommodations zone district; Section 7.5.F.2.b(3), which requires a minimum 25-foot landscaped buffer on property abutting arterial streets; and Section 7.5.F.2.b(6), which states no development parking or drives, shall be located within the street frontage buffer. Approval of the variances would allow the fire truck turnaround to encroach fifteen (15) into the setback along Moraine Avenue. Planner Kleisler stated the proposed turnaround stems from a request from Planning Division staff to remove a driveway connection east of proposed Unit 13, which would have provided a through connection to Park River Place and would have satisfied requirements of the Estes Valley Fire Protection District. Staff requested this connection be removed to provide additional wildlife habitat and migration corridor, and to alleviate potential traffic impact on the Park River West neighborhood. Planner Kleisler stated the application was routed to all affected agencies and adjacent property owners, and no significant issued were raised relative to code compliance or the provision of public services. Findings 1. This request complies with review criteria set forth in Section 3.6.C of the Estes Valley Development Code. RECORD OF PROCEEDINGS Estes Valley Board of Adjustment 2 January 7, 2014 2. Special circumstances exist and practical difficulty may result from strict compliance with Code standards. 3. The variances are not substantial. 4. The essential character of the neighborhood would not be substantially altered, nor would adjoining properties suffer a substantial detriment. 5. The variances would not adversely affect the delivery of public services. 6. The variances represent the least deviation from the regulations that will afford relief. 7. This request has been submitted to all applicable reviewing agency staff for consideration and comment. No significant issues or concerns were expressed by reviewing staff relative to code compliance or the provision of public services. 8. The submitted conditions or circumstances affecting the property are not of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulations for such conditions or situations. 9. Failure to apply for a building permit and commence construction or action with regard to the variance approval within one (1) year of receiving approval of the variance shall automatically render the decision of the BOA null and void. Planner Kleisler stated staff recommended approval conditional to compliance with Mountain River Townhomes Development Plan 2013-03. Public Comment Jeff Moreau/applicant stated access between Mountain River Townhomes and Park River West was planned. The project will include 26 individually owned lots, with some community property. It was moved and seconded (Newsom/Smith) to approve the three variance requests for Mountain River Townhomes with the findings and conditions recommended by staff and the motion was approved 3-0, with two absent. 4. REPORTS None. 5. ELECTION OF OFFICERS It was moved and seconded (Smith/Newsom) to appoint Member Lynch as chair of the Board of Adjustment for 2014 and the motion passed unanimously with two absent. Member Lynch represents unincorporated Larimer County. It was moved and seconded (Newsom/Smith) to appoint Member Moreau as vice- chair of the Board of Adjustment for 2014 and the motion passed unanimously with two absent. Member Moreau represents the Town of Estes Park.
