MemoTo:HonorableMayorJirsaBoardofTrusteesFrom:FrankLancaster,TownAdministratorDate:July12,2016RE:TOWNOFESTESPATOWNADMINISTRATORPotentialUseofFishHatcheryPropertyObjective:DiscussacourseofactionforpotentiallyusingtheTownownedFishHatcherypropertyforworkforcehousing.PresentSituation:TheTowncurrentlyownsXXacresatthewestendofFishHatcheryRoad,commonlyknownastheFishHatcheryProperty.CurrentlythepropertyisusedfortheHydroplantMuseumandVickiO’Connorpicnicarea,employeehousing,townstorage,andmuchofthepropertyisundeveloped.Inastudysessionon4/28/2015theBoarddiscussedoptionsfortheuseofthepropertyanddirectedstafftoconsideruseofallofthepropertyandnotlimittheoptionstojustthecurrentlydevelopedportion.Sincethattime,wehavehadseveralunsolicitedideasfordevelopmentofthepropertycomeforwardfromdifferentindividuals.Allwereveryconceptualatthispoint,andallwereverydifferent.TheEstesValleyLandTrusthasalsoexpressedinterestinplacingaconservationeasementonthesouthundevelopedportionoftheproperty.Proposal:ThattheTownproceedwithdevelopingandissuingaRequestforProposalsforthedevelopmentofworkforcehousingontheTownownedFishHatcheryproperty.Specificsofthesolicitationtobedevelopedlater.Openstheoptionsforworkforcedevelopmentuptotheimaginationandcreativityofprivatedevelopers•TheTowncanputparametersaroundthescopeoftheproposaltoinsureanyproposalsmeetthegoalsandobjectivesoftheTownBoard•AsuccessfulprojectcouldmakeameaningfulimpactinthesupplyofworkforcehousingintheEstesValleyDisadvantages:•ThelossofTownstoragewouldhavetobeaddressed.•TherewillbeanimpacttoTownemployeescurrentlylivingonthesite.Advantages:

-sCentralFederalLandsHighwayDivision12300WestDakotaAvenueUSDeportmaitSuite380dltflPOdUtlQlLakewood,CO80228-2583FederalHighwayAdmlnbtralionJune20,2016InReplyReferTo:HFPM-l6Mr.GregMuhonenPublicWorksDirectorTownofEstesPark170MacGregorAvenueEstesPark,Colorado80517Re:FHWACLFHD,COFLAP34(1)&COFLAP36(1),EstesParkMoraineAvenueandRiversideDriveEnvironmentalAssessment,FHWAIntenttoMakeaSection4(f)deminimisdeterminationDear.Mr.Muhonen:ThisletterisinregardtoSection4(f)coordinationfortheDowntownEstesLoopproject.Per23CFR774.5,wearecoordinatingwithyouastheownerwithjurisdictionresponsibleforSection4(f)and6(f)resourcesintheTownofEstesPark.WearewritingtoyouinyourpositionasDirectorofPublicWorks,whichoverseesfivedivisionsincludingtheParksDivision.TheCentralFederalLandsHighwayDivision(CFLHD)oftheFederalHighwayAdministration(FHWA)ispreparinganEnvironmentalAssessment(EA)undertheNationalEnvironmentalPolicyAct(NEPA)fortheproposedDowntownEstesLoopproject.ThisprojectisintendedtoimproveaccesstoRockyMountainNationalPark(RMNP)byaddressingcapacity,safety,mobilityandaccessconstraintsintheDowntownportionoftheroadwaynetworkservingtheBeaverMeadowsentrancetoRMNP,TheProposedActioninvolvesconversionofexistingroadwaysfromtwo-waytoone-waythroughdowntownEstesPark.Thetwo-laneonewaycouplethasatotallengthof0.92miles.TheprojectbeginsattheElkhornAvenue/RiversideDriveintersection,continueswestonElkhornAvenue(US36)totheintersectionofMoraineAvenue/BigHornDrivefor0.15miles,thenturnssouthonMoraineAvenue(US36)for0.3milestotheintersectionofMoraineAvenueandRiversideDrive/CragsDrive.Thesetwo-wayroadwaysegmentswouldbeconvertedintoone-wayroads,westandsouth,respectively.Thetwo-laneonewaycoupletiscompletedinthereturningnortherlydirectionviaareconstructedRiversideDrive.ThissegmentbeginsattheMoraineAvenueestRiversideDrive/CragsDriveintersectionthenfollowsnearWestRiversideDrive,IvyStreetandEastRiversideDrivefor0.40milesbacktothebeginningoftheprojectattheEastRiversideDrive/ElkhornAvenueintersection,completingtheloop.Pavementrehabilitation(includinggrindingtheexistingpavementandaddingnewpavementtorepairthedeterioratingasphalt)wouldoccuronElkhornAvenuefromjustwestoftheUS34/US36intersectiontotheElkhorn/MoraineintersectionandalongMorainefromtheElkhorn/MoraineintersectiontotheMoraine/Crags/WestRiversideintersection.PavementrehabilitationonRockwellwouldalsooccurfromMoraineAvetoRiversideAvenue.NewsignalswouldbeaddedtotheElkhorn/Riverside,andElkhorn/Moraineintersections.TheMoraine/Crags/WestRiversideintersectionwouldbereconstructedaseitheratraditionalsignalizedintersectionoraroundabout.Newsidewalk,onstreetbikelanesandtrailconnectionimprovementswouldbeinstalled.Directionalsignagealongthecorridorswouldbeinstalled,aswellaslandscaping.
COFLAP34(1)&36(1)ESTESPARK-MORAINE/RIVERSIDE/ELKHORNPROJECT“DOWNTOWNESTESLOOP”HistoricResourcesOnehistoricNRHP-eligibleproperty,aportionofSH262(MoraineAvenue),willbeimpactedbytheProposedAction.ThedocumentedsegmentbeginsattheintersectionofUS34andUS36attheeastendofElkhornAvenue,continueswestalongElkhornAvenuetoitsintersectionwithMoraineAvenueandsouthalongMoraineAvenue,turnstothewest-southwestnearCragsDrive,andendsapproximately400feetwestof351MoraineAvenue.SH262wasoriginallyalocalroadusedbyresidentsofEstesPark.AftertheRMNPopenedin1915,itwasusedasanentranceroadintothepark.TheroadwasdesignatedSH262in1939and,by1946ithadbeenextendedintotheRMNP,endingattheintersectionofFallRiverRoad(US34)andDeerRidgeJunction.Thisroutewasuseduntil1965,whentheBeaverMeadowsparkentranceopened.Atthistime,theroadwasrenamedSH66and,in1977,itbecamepartofUS36.Aspartofthisproject,SH262willbeoverlainovertheoriginalroad’salignment.Anewintersectionconfigurationwillbebuilt,requiringtheremovalofanon-historicbuilding(commercialproperty,theDonutHaus)atthecurrentintersection.Bothasignalizedintersectionandroundaboutintersectionarecurrentlyunderconsiderationatthislocation.Undereitherconfiguration(signalizedorroundabout),theintentistomakegeometricandgradechangestoimproveoperationalefficiencyandadditionalsightdistance,therebyimprovingsafetyconditions.Thehistoricshortrockretainingwallandrock-linedcurb,alongthewestsideofthecurveinfrontofsites5LR13751and5LR13753(theformerRockyMountainParkheadquarters),willremaininplace.Anewshortretainingwallwillbeadded,ifnecessary,infrontoftheseolderwallfeaturesinconjunctionwiththelowerroadgrade.TheretainingwallalongtheeastsideofMoraineAvenuethatstretchesfrom250Moraineto261MoraineAvenuewillalsonotbedirectlyimpactedandwillbelocatedmorethan100feetnorthoftheproposednewconstruction.Inshort,theproposedimprovementstoMoraineAvenuewillnotadverselyaffectthehistoricintegrityofSH262oranyofitsassociatedfeatures.Section4(f)HistoricDeterminationTheprojecthasbeendeterminedtohave‘noadverseeffect”onSH262underSection106.SHPOconcurredinwritingwiththeSection106“noadverseeffect’determinationforthispropertyasstatedinalettertoCFLHDdatedMay19t,2016.SH262anditsassociatedfacilities(retainingwalls,curb)arelocatedinthehighwayright-of-way.Ifahistoricresourceiswithinright-of-way,theSection4(f)PolicyPaper(July2012,page36)statesthefollowing:‘whenafuturetransportationprojectisadvancedresultinginaSection106determinationofnohistoricpropertiesaffectedornoadverseeffecttosuchresources,therewouldbenoSection4(f)use.”Thus,Section4(f)wouldnotapplytoSH262.ParkResourcesTheproposedprojectwouldrequiretheconversionofapproximately18611squarefeetofexistingparklandinportionsofBaldwinParkandChildren’sParktotransportationuse:•BaldwinParkiscurrently61,940squarefeetinsize.TheproposedroadwayrealignmentalongRiversidewouldrequirepartialacquisition(14,463squarefeet)ofthepark,whichrepresentsalossofapproximately23%.TheportionofBaldwinParknearIvyStreetiswherethemajorityofparklandlosseswouldoccur.TheproposedhorizontalcurvefromtheWestRiversidealignmenttotheproposedalignmentofthenewbridgeovertheBigThompsonandtheresultingalignmentontheothersideoftheriver(EastRiverside)causethisimpact.Theproposedcurveradiusisnecessarytomeetingengineeringstandards.Anexistingasphaltpavementareacurrentlyutilizedforparkingwillberemoved.TheplazaandseatingareacurrentlylocatedattheentrytoBaldwinParkPage2of5
COFLAP34(1)&36(1)ESTESPARK-MORAINE/RIVERSID&ELKHORNPROJECT“DOWNTOWNESTESLOOP”(acrossfromthePostOffice)willbemovedtotheformerasphaltparkingareafurthersouth.Children’sParkisapproximately16,211squarefeetinsize.Approximately4,148squarefeet(26%)wouldberequiredtoreconstructtheintersectionatElkhorn/Riversideincludingtheaccommodationoftworight-turnlanesfromnorthboundRiversideontoeastboundElkhorn,sidewalksandapedestriancrosswalk.Theareatobeacquirediscurrentlyusedforsidewalkandlandscaping.Inaddition,restroomscurrentlylocatedadjacenttoRiversidealongtheBigThompsonRiver(withinChildren’sPark)wouldneedtoberemovedtoaccommodatetheroadwaycross-section.NoimpactsareanticipatedtotheexistingplaygroundorotheramenitieswithinChildren’sPark.ProposedEnhancementsTheprojectteamrecognizestheimportanceofparklandtothedowntownenvironmentandlargercommunity.Thus,wehaveworkedtoreduceimpactstotheextentfeasiblewhileidentifyingreplacementpropertiesforconversiontoparkland.Theintentistobenefitthecommunitybyconstructingnewformalandinformalnaturalspacesforrecreationandriveraccess,andconnectingandimprovingtheparkandriverwalkexperiencebetweenBaldwinParkandtheBigThompsonRiverwalk,SeveralareasalongRiversideDrivearerecommendedforconversiontoparkareaaspartoftheimplementationoftheProposedAction.Theadditionoftheseparkareaswouldconstituteacreagegreaterthantheparklandsimpactedalongthecorridor(anacreageof41,390squarefeeUO.95acre,whichrepresents22,779squarefeet/0,52acreofnewparkarea).Proposedconversionoflandstoparkisshownintheattachedexhibitsandincludesthefollowing(fromsouthtonorthalongRiversideDrive):•BaldwinPark(Parcel11):TheproposedshiftintheRiversideDrivealignmentwouldcreateatriangularshapedparcelofspaceadjacenttoBaldwinPark.Thisareaisrecommendedtobetransferredtoparkland(partofBaldwinPark).•UpstreamRiverCorridor(Parcels17-18):TherelocationofcommercialandresidentialpropertiesalongRiversideDrive(eastoftheRiver)willcreateanopportunityforparklandconversion,enhancedriveraccessandfloodplainmitigationarea.Withthewiderfloodplainboundariesassumedunderrecentfloodflowdata,theexistingbuildingsarelocatedwithinthefloodplain.Conversiontopark/openspaceareahelpsrestorenaturalconditions.Theintentoftheplanneddesignistoimproveparklandinterconnections.Anexistingsidewalklocatedalongthewestedgeoftheriver(alongthePostOfficelotandacrossfromparcels20and21)wouldbewidenedandanewpedestrianaccesspointwouldbeaddedtoprovideconnectivitytotheriver.•RiversideBridge(Parcels12-13):Parcels12and13areprivatepropertiesthatneedtobeacquiredtoreconstructRiversideDrive.ItisrecommendedthatthesetwoparcelsbetransferredtotheTownforparkland.Conversiontoparkwouldprovideenhancedaccesstotheriver,aswellastheopportunitytoextendafuturetrail(shownindashedlineonExhibitA)paralleltotheriver.Therecommendationsdescribedaboveareproposedenhancementstooffsetimpactstoparksduetotheproject.Page3of5
CoFLAP34(1)&36(1)ESTESPARK-MORAINE/RIVERSID&ELKHORNPROJECT“DOWNTOWNESTESLOOP”DeMinimisFindingAsapartoftheenvironmentalreviewprocess,theFHWAhasresponsibilitiestocomplywithSection4(f)oftheDepartmentofTransportationActof1966(whichhasbeenlaterrevisedandrecodifiedbutstillreferredtoasSection4(f)).TheintentoftheSection4(f)Statute,49u.s.c.Section303,andthepolicyoftheFHWAistoavoidtransportationuseofhistoricsitesandpubliclyownedrecreationalareas,parks,andwildlifeandwaterfowlrefuges.IftheFHWAdeterminesthatatransportationuseofthesetypesofproperties,alsoknownasSection4(9properties,resultsinademinimisimpactonthatproperty,ananalysisofavoidancealternativesisnotrequired,andtheSection4(f)evaluationprocessiscomplete.Deminimisimpactsonpubliclyownedparks,recreationareas,andwildlifeandwaterfowlrefugesaredefinedasthosethatdonot‘adverselyaffecttheactivities,featuresandattributes”oftheSection4(f)resource.Thefindingofademinimisimpactonrecreationalandwildliferesourcescanbemadewhen:1)ThetransportationuseoftheSection4(f)resource,togetherwithanyimpactavoidance,minimization,andmitigationorenhancementmeasuresincorporatedintotheproject,doesnotadverselyaffecttheactivities,features,andattributesthatqualifytheresourceforprotectionunderSection4(f);2)Thepublichasbeenaffordedanopportunitytoreviewandcommentontheeffectsoftheprojectontheprotectedactivities,features,andattributesoftheSection4(9resource;and3)Theofficial(s)withjurisdictionoverthepropertyareinformedofFHWA’sintenttomakethedeminimisimpactfindingbasedontheirwrittenconcurrencethattheprojectwillnotadverselyaffecttheactivities,features,andattributesthatqualifythepropertyforprotectionunderSection4(f).Throughthedetailedscreeningprocess,theproposedprojectalternativewasdeterminedtobetheleastenvironmentallydamagingalternative,Wehavefoundthroughthescreeningprocessthatthereisnoreasonablealternativethatwouldmeettheidentifiedtransportationneedswithoutimpactingtheseparklands.Togetherasateamandwiththepartneragencies,wehaveworkedtoreduceimpactstoparklandthroughtheproposeddesignandhaveidentifiedopportunitiestoprovidereplacementlandsthatwillbecomelong-termamenitiesandassetsforthecommunity.Theproposedenhancements,includinginformalnaturallands,plaza/seatingareas,sidewalks,pathways,riveraccessandrestroomswillbeconstructedundertheproposeddesign.ApreliminaryconceptplanforparklandandamenityreplacementsisshowninExhibitsAandB.Thus,thecharacteristicsandfeaturesthatmakethepropertieseligibleforSection4(1)protectionwillremain.ItisFHWA’sintenttomakeadeterminationthattheimpactstoBaldwinParkandChildren’sParkaredeminimis.Perrequirementsof23CFR774.5(a)(2)(ii),thepublicwillreceivenoticeandanopportunityforpublicreviewandcommentconcerningtheeffectsonparklandsduringtheEnvironmentalAssessmentpubliccommentperiod.Followingthepubliccommentperiod,FHWAwillpresentthecommentsreceivedtoyourofficeandrequestthatyourofficeconcurwiththeFHWAfindinginwriting.Thisdetermination,publicoutreachandsubsequentconcurrencewillsatisfytheSection4(9requirementsforthisproject.Section6(f)StateandlocalgovernmentsoftenobtaingrantsthroughtheLandandWaterConservationFund(LWCF)todevelopormakeimprovementstoparksandoutdoorrecreationareas.SectionPage4of5
CoFLAP34(1)&36(1)ESTESPARK-MORAINE/RIVERSIDE/ELKHORNPROJECT‘DOWNTOWNESTESLOOPS6(f)propertiesarethosepurchasedorimprovedwithLWCFgrants.Section6(f)prohibitstheconversionofpropertyacquiredordevelopedwithLWCFgrantstoanon-recreationalpurposewithouttheapprovaloftheDOl’sNationalParkService(NPS).InColorado,theColoradoStateTrailsProgramimplementedbytheDepartmentofNaturalResourcesbyColoradoParksandWildlife(CPW)administerstheLWCFGrantprogram.Children’sPark,aswellasportionsofBaldwinPark,werepurchasedwithLWCFgrants.Sinceportionsoftheseparkswillbeconverted,theofficialwithjurisdictionoftheSection6(f)property(theTownofEstesPark)istobeconsultedwithconcerningtheanticipatedimpactareaandproposedreplacementlandthatisofreasonablyequivalentsize,usefulnessandlocation,andofatleastequalfairmarketvalue.ConsultationandcoordinationwithColoradoStateTrailsProgramstaffmembersforthisprojectbeganinSeptemberof2014andhascontinuedsincethattime.Alettertoyourequestingconcurrencewiththeanticipatedareaofparklandtobeconverted(fortheproject)alongwithproposedreplacementland,isforthcoming.WewouldliketothanktheTownofEstesParkfortheircooperationwiththisproject.Pleasecontactmeifyouhaveanyquestionsregardingthismatter.Sincerely,mesHerlyckProjectManagerExhibits•A:AnticipatedImpactstoParkProperty•B:ProposedReplacementParkLandsPage5of5
