See attached document. INFORMATION PAPER ON CDPHE GRANT TO INCREASE RECYCLING BINS IN ESTES PARK PURPOSE: Seek direction from the PUP and Town Board on how to proceed with execution of a CDPHE grant to procure additional recycling bins for downtown Estes Park. BACKGROUND: Data from several sources suggest Estes Park's recycling rate is substantially lower than in similar towns across the U.S.—perhaps as low as 8 percent in 2007. The LWV&CRC has worked to increase this rate by promoting recycling and expanding recycling infrastructure. In January 2012, LWV&CRC members discussed with Estes Park administrative and engineering staff the initiative to acquire more recycling bins for the town. Subject to Board of Trustee approval, the town representatives expressed interest in providing bin installation and incorporating the new bins into existing town contracts for trash and recycling removal. In February 2012, at the suggestion of Town Trustee Ericson, the LWC&CRC applied for a recycling grant from the Colorado Department of Public Health and Environment (CDPHE). The application included letters of support from Steve Gillette, Larimer County Solid Waste, and Mayor Bill Pinkham. In April, CDPHE announced a grant to Estes Park for $18,350. Most of the grant--$14,900--funds 24 new animal -proof recycling bins. Estes Park now has about 145 trash cans downtown, and only 13 recycling containers, a ratio of 11:1. Adding 24 recycling bins would bring the total to 37 and improve the ratio to about 4:1. The LWV&CRC located an experienced local vendor (2I{ Waste Industries of Greeley) who offered an animal -proof recycling bin at a cost of about $600 each. The town engineer reviewed the 2K Waste Industries design and prefers an alternate and more costly approach of securing bins from a national vendor of bear -proof bins. This approach ensures bins are ADA compliant and may provide the town increased protection from potential litigation by working with a vendor that is more likely to have the experience and resources to successfully resolve law suits. Purchasing bins from a different source raises costs a minimum of $50 per unit and incurs shipping costs estimated at up to $5,000--not funded by the grant. Under terms of the grant, new bins must be purchased and installed by June 30, 2013 using LWV&CRC funding. The LWV&CRC secured a line of credit from First National Bank of Estes Park to provide the upfront funding. After installation, the CDPHE will reimburse the LWV&CRC enabling the LWV&CRC to pay off the borrowed funds. Failure to execute makes the LWV&CRC liable for the project costs —an untenable position. Concurrent with this project, Estes Park experienced several tragic, high -profile incidents of bears being killed as a result of foraging for food from human garbage sources. As a result, the town and local businesses are under pressure to transition to bear -resistant trash receptacles. The LWV&CRC is receptive to partnering with the town, if desired, to purchase dual trash/recycling bins rather than stand-alone recycling bins which would require unbudgeted funding. Besides "bear -proofing" 24 trash receptacles, dual bins would likely make better use of limited sidewalk space and present a more aesthetically coherent and pleasing appearance. LWV&CRC/Morris/5 Dec 12 In order to execute the grant successfully, the LWV&CRC requires a Board of Trustee decision on pursuing single or dual -use receptacles, approval to incorporate the state -funded recycling bins into Estes Park's existing trash and recycling collection system, and approval for the town's engineering department to provide installation. Possible courses of action follow with estimated costs. Note: bin cost estimates do not include a contingency margin as reflected in estimated shipping costs. Also, engineering staff estimates bin signage costs would be minimal —maybe $20 a bin or about $500 overall. COURSES OF ACTION: OPTION A: Town declines or is unable to provide requested installation and servicing. PROS: Town incurs no new expenses or obligations. CONS: LWV&CRC reneges on state grant —a poor reflection on the town and loss of the opportunity to acquire needed recycling infrastructure at relatively little cost. Estes Park's downtown area fails to reflect visible environmental stewardship despite our historical and economic ties to RMNP and conservation. OPTION B: Town agrees to provide installation and servicing only as originally envisioned, with LWV&CRC acquiring bins from local manufacturer. PROS: Town incurs comparative minimal expense of installation and servicing. Community benefits from in -kind donation of transportation of bins to Estes Park. CONS: Bins are not town engineering department's preferred option. Potentially exposes the town to sole responsibility if town is sued over aspects of the bins' use. OPTION C: Town agrees to provide installation and servicing, and single bins (model CE-140CH) are acquired from Bear -Savers at a unit cost of $652. PROS: More visible manufacturer "track record" and potential shielding from lawsuits. CONS: LWV&CRC would request town fund the delta of $4,268 to $5,768 (approximately $768 more for bins and $3,500 to $5,000 for shipping). OPTION D: Town agrees to provide installation and servicing, and dual bins (basic model CE-240CH) are acquired from Bear -Savers at a unit cost of $773. PROS: More visible manufacturer "track record" and potential shielding from lawsuits. Opportunity to show good faith and concrete progress to constituencies concerned about protecting the area bear population and support for Estes Park's image as caring for our natural resources. Economically efficient: essentially the same shipping costs, but getting a superior solution to town needs (increase recycling opportunities while reducing bear attraction to trash as a food source) CONS: LWV&CRC would request town fund the delta of $7,172 to $8,672 (approximately $3,672 more for bins and $3,500 to $5,000 for shipping). Model is not preferred solution of town engineering department from a long-term perspective. LWV&CRC/Morris/5 Dec 12 OPTION E: Town agrees to provide installation and servicing, and town engineering department's preferred dual bins (model CE-232-CHR) are acquired from Bear -Savers at a unit cost of $1,153. PROS: More visible manufacturer "track record" and potential shielding from lawsuits. Opportunity to show good faith and concrete progress to constituencies concerned about protecting the area bear population and support for Estes Park's image as caring for our natural resources. Economically efficient: essentially the same shipping costs, but getting a superior solution to town needs (increase recycling opportunities while reducing bear access to trash as a food source). Model is engineering department's preferred long-term selection. CONS: LWV&CRC would request town fund the delta of $16,292 to $17,792 (approximately $12,792 more for bins and $3,500 to $5,000 for shipping). As directed by the Town Board, Public Works is proceeding with the bidding of the MPEC and Stall Barn projects for completion 2013. The instructions for bidders are as follows: The Town of Estes Park is soliciting bids for construction of a new Multi -Use Stall Barn and Multi -Purpose Event Center (MPEC). The Multi -Use Stall Barn is approximately 26,000 square feet and the MPEC is approximately 37,000 square feet. The site is located in Estes Park at the Stanley Park Fairgrounds, generally located between Community Drive and 4th Street and Highway 36 and Manford Avenue. The Multi -Use Stall Barn and MPEC will be located at the vacant North West quadrant of the Fairgrounds, on generally 4.5 acres. The Town awarded a construction contract for earthwork and extension of a sanitary sewer line which will service the property. The earthwork and sanitary sewer line construction are estimated to be completed by January 15, 2013. The Town reserves the right to award within 90 days of bid opening either the Multi -Use Stall Barn, or the MPEC, or both buildings concurrently. The Town will determine which of the buildings or if both buildings will be constructed after the bid opening. The project will be out for bid on December 12, 2012 with a construction completion date targeted for 175 calendar days following bid award for the Multi -Use Stall Barn, and 240 calendar days following bid award for the MPEC. Electronic and hard copies of the bids should be provided. Electronic bids shall be emailed to Norris Design, attention Elena Scott escott norris-desig_Dx,om. Sealed bids will be received at the Town's Public Works offices (170 MacGregor Ave, Estes Park, CO 80517) for the services referenced above until 3:00 PM (Mountain Time) on January 8, 2013, at which time the bids will be opened in public by Town staff and design team members. The bids shall be in a sealed envelope, plainly marked "Stanley Park Fairgrounds — Multi -Use Stall Barn and Multi -Purpose Event Center" and shall state the name and address of the bidder. All sheets submitted with the bid shall be clearly marked with the Contractor's name submitting the bid. No proposals will be considered which are received after the time mentioned and any proposals so received shall be returned to the submitter and not be considered under any circumstances. Sole responsibility rests with the submitter to see that their proposal is received on time at the stated location. Town of Estes Park presently anticipates issuing'the Notice to Proceed within 90 days of bid opening. A bidder to whom a contract is awarded will be required to furnish certification of specific insurance requirements and performance bonds necessary for contracts with Town of Estes Park. There will be a mandatory pre -bid conference at 9:00 am on December 18, 2012 at the Town of Estes Park Museum, located at 200 4th Street, Estes Park, CO. All bidders are required to submit questions in writing by December 21, 2012. Responses will be provided in writing by December 28, 2012.
