This time of the year staff is working on finishing the horse show season and moving into preparing for Elk Fest and the Catch the Glow parade. Staff is currently working on the Dressage Show and the Bio Blitz which look to be a great success. Scottish Festival is just around the corner and preparation for that event is already taking place. Building and Financial reports are through July. WOODLAND HEIGHTS FIRE 9 Staff has received reports of culverts blocked with debris causing rain to overflow ditches and erode roads. Except for portions of High Drive, the roads are privately maintained and culvert cleaning is the property owners’ responsibility. Property owners can consider creating a formal road maintenance association. 9 The Larimer County Commissioners approved a reduced building permit fee program for specific cases such as insufficient insurance coverage. OUTREACH/COMMUNICATION –EXTERNAL CUSTOMERS 9 The community meetings on Enhancing Planning and Building Services are tentatively scheduled for October 8th from 3:00 pm – 5:00 pm and October 16th from 5:30 pm to 7:30 pm. Trustees are encouraged to attend and participate. OUTREACH/COMMUNICATION –INTERNAL CUSTOMERS 9 No significant update. STAFF DEVELOPMENT/TRAINING 9 Will Birchfield, Chief Building Official, attended the International Code Council Colorado Chapter quarterly meeting in Durango. This is an opportunity to network with Building Officials in a small-group setting and stay up to date on International Code amendments. 9 Staff interviewed six applicants for the Senior Building Permit Technician position. Community Development Director Chilcott offered the position to Karlin Goggin, who has 10+ years of permit technician and permit tech supervisor experience. Karlin’s first day is August 27th. Community Development Memo Page 2 of 4 ADDRESSING 9 No significant update. BUILDING CODES, PERMITS, AND INSPECTIONS 9 Building permit reports are attached. Year-to-date permit numbers, valuation, and fees are similar to last year. More permits were issued in July of 2012 than July 2011; however valuation and fee collection was down ($7,082 in fees were waived in July 2012). Staff anticipates a significant increase in valuation when the Estes Park Medical Center picks up and pays for the MRI building permit. 9 Daily inspection workload remains high averaging 16 per day through the end of July. FLOODPLAIN MANAGEMENT 9 No significant update. SIGNS CODE COMPLIANCE 9 Community Development is continuing to focus on life-safety concerns at distressed properties. However, over the past month, Building Inspector Traufield has pro- actively identified unpermitted banners and unpermitted signs and contacted property/business owners to obtain code compliance. He has obtained compliance with approximately twenty sign code violations. Not all are logged and tracked in the code compliance database. 9 The Courtyard Shops has numerous open permits, and probable work without permits. This is a mixed-use, multi-story building. Mixing residential use with restaurant use with limited egress creates significant life-safety hazards in case of emergency. The Chief Building Official has notified all tenants, via letter, of the life- safety concerns and requested a submittal by the current owner of a plan address these concerns. Provided this plan is received by the beginning of September with an approved implementation process, staff has agreed to not red-tag any of the residential units. 9 Later this week, staff will meet with another potential buyer of Marys Lake Lodge Unit 1 to discuss open permits. The Homeowners Association has invited the Chief Building Official onto the property to complete inspections provided access to interior spaces is not required. Will Birchfield plans to complete this within the next few couple weeks. 9 Staff are continuing to reduce the number of code compliance open cases. Community Development is tracking approximately 110 open cases. Since January 1, 2012, staff have closed 217 cases. Page 3 of 4 CURRENT PLANNING 9 This month staff participated in the pre-application meetings for the following projects. Rocky Mountain Performing Arts Center ▪ 116 West Elkhorn Avenue, former Park Theater Mall location ▪ Height Variance request will be heard by the Estes Valley Board of Adjustment. The proposed development will also require Special Review heard by Planning Commission and Town Board. Stall Barns, Stanley Park Fairground ▪ 1209 Manford Avenue ▪ Construct stall barns ▪ This proposal will require a Location & Extent and Special Review, to be heard by Planning Commission and Town Board. Fall River Lodge ▪ 900 West Elkhorn Avenue ▪ Proposed rezoning from A-1 to A and a development agreement to allow two parcels to be used as one. Habitat/Salud ▪ Gray Hawk Court/Red Tail Court ▪ Subdivide and rezone a portion of the property from O-Office to R-1- Residential. Westover Construction ▪ 1789 Wildfire Road ▪ Proposed amended development agreement regarding allowed uses, possible annexation, and review development plan. Wonderview Condomiums ▪ Corner of Wonderview Avenue and MacGregor Avenue ▪ Proposed conversion from condominiums to townhomes Stonewood Subdivision ▪ Moraine Avenue ▪ Proposed conversion of the Rippling River development from condominiums to townhomes. In addition to these projects, attached is a list of projects currently under review. Last year, stalled residential and accommodations projects re-started. This year, a variety of new projects are underway (commercial, non-profit, and special districts). Planner Dave Shirk is the primary contact for all but two of these projects. 9 Staff will continue to encourage customers to schedule appointments to meet with Planner Dave Shirk. This is appreciated because it allows staff to research customer concerns ahead of the meeting and efficiently assist customers. Page 4 of 4 STRATEGIC/COMPREHENSIVE PLANNING 9 On August 21st, the Planning Commission will wrap up the Action Plan discussion. An updated Action Plan will be presented to the Town Board and could assist with strategic planning. 9 On July 17th the Commission listened to Trustee Erickson’s presentation about Roadmap to the Future, the Transportation Visioning Committee’s report. Trustee Ericson requested that the Commission review the report and consider incorporating it in the Estes Valley Comprehensive Plan. This review will begin at the August Planning Commission meeting. BOARDS AND COMMISSIONS 9 Planning Commissioner Rex Poggenpohl has resigned from the Estes Valley Planning Commission. The August 21st meeting is his last meeting. Applications for the Commission are now being accepted. Residents living in the unincorporated Estes Valley can apply by August 27th. This is a County Commission appointed position. Interviews are tentatively scheduled for September 5th, which will allow for an appointment at the September 11th Administrative Matters meeting. OFFICE ORGANIZATION/RECORDS MANAGEMENT 9 No significant updates. TECHNOLOGY - PERMITTING SOFTWARE, GEOGRAPHIC INFORMATION (GIS) 9 Alan Fraundorf is researching the cost of using Larimer County’s Permits Plus system for permitting until a permanent solution is implemented. 9 Community Development and others involved in permitting will begin meeting with Consultant Don Widrig to discuss how we would like the new system to work (work flow, etc.). FINANCES 9 To improve transparency 1600 Community Development has been renamed Planning Division, and 2300 Protective Inspections has been renamed Building Safety Division. 9 There are no significant expenditure or revenue changes since last month’s report, with the exception that overtime is over budget. The annual overtime budget for Building Safety was $155. Overtime paid out through the end of July is $1,686 (2007% of budget). For the Planning Division the annual budget is $1,288 and actuals are $1,730. ECONOMIC DEVELOPMENT 9 No update. In 2010/2011, Community Development staff were directed to strictly enforce the Sign Code and the Estes Valley Development Code ‘containment provisions’ downtown. Staff addressed banners, sandwich boards, flashing signs, outdoor sales and storage, etc. Voluntary compliance was obtained in most cases. However, staff did issue a summons and complaint to the Estes Park Sweat Shirt Center at 117 West Elkhorn Avenue for violating Estes Valley Development Code Section 4.4.D.1.a, which states: Except as may be allowed in paragraph (3) below, all retail sales, displays and activities and all other uses, storage, and activity shall be wholly contained within the interior of a building or permanent structure. Municipal Judge Brown found that any ambiguity in the language of Section 4.4.D.1.a was to be construed in favor of the property owner. He held that the display of merchandise inside the alcove was not a display and/or activity “within the interior of a building.” This year staff has addressed some sign violations, primarily banners and signs without permits. Staff has not pursued retail sales and displays in alcoves downtown given the 2011 court ruling. Continued on page 2 Community Development Memo Page 2 of 2 Staff Recommendation: If the Community Development/Community Services Committee believes policy discussion concerning retail sales and displays downtown is warranted, staff recommends this be discussed at a Town Board Study Session with input from local merchants.
