00RESOLUTION#03-15ENDORSINGTHEESTESPARKFEBRUARY3,2015SPECIALELECTIONBALLOTISSUETOREESTABLISHTHETOWN’SRIGHTTOEITHERDIRECTLYORINDIRECTLYPROVIDEALLTELECOMMUNICATIONSSERVICES,INCLUDINGBROADBANDINTERNETSERVICES,RESTRICTEDSINCE2005BYTITLE29,ARTICLE27OFTHECOLORADOREVISEDSTATUTESWHEREASTheEstesParkBoardofTrusteeshaveunanimouslyreferredtothevotersofEstesPark,onFebruary32015,theSpecialElectionBallotIssuetoreestablishtheTown’srighttoeitherdirectlyorindirectlyprovidealltelecommunicationsservices,includingbroadbandinternetservices,restrictedsince2005byTitle29,Article27oftheColoradoRevisedStatutesand;WHEREAStelecommunicationsservicesincludingbroadbandinternetservices,thatarecompetitiveinspeed,cost,andreliabilityareessentialforlocalbusinessesandcitizenstosuccessfullycompeteintoday’sgloballycompetitiveenvironmentand;WHEREAStheTownofEstesPark,throughitsparticipationinPlatteRiverPowerAuthority(PRPA),hasaccesstoanexistingfiberopticringinEstesParkthatcouldhelpmakecompetitivetelecommunicationsservicesavailablewithinourTownandimmediateregionand;WHEREASin2005,Title29,Article27oftheColoradoRevisedStatuteseliminatedtheTownofEstesPark’srighttodirectlyorindirectlyprovidetelecommunicationsservices,includingbroadbandinternetservices,withoutavoteofthepeopletoreestablishthisrightand;WHEREASreestablishingthisrightwillallowtheTowntoleverageallcommunity-ownedfiberopticinfrastructureforthebenefitofitscitizensandbusinesses;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOtosupportandendorsetheEstesParkFebruary3,2015SpecialElectionBallotIssuetoreestablishtheTown’srighttoeitherdirectlyorindirectlyprovidealltelecommunicationsservices,includingbroadbandinternetservices,restrictedsince2005byTitle29,Article27oftheColoradoRevisedStatutes.DATEDthis_______dayofATTEST:flCfl0ToClerkJonO&riayor
