00RESOLUTION#07-16WHEREAS,theEstesValleyFireProtectionDistricthasadoptedthe2015InternationalFireCodeincludingAppendicesandAmendments(the“FireCode)fortheregulationandgovernanceofconditionshazardoustolifeandpropertyfromfireorexplosionandprovidingforcertainpermittingofsuchusesandoperations;andWHEREAS,Section32-1-1002(1)(d)C.R.S.providesthattheFireCodeadoptedbytheEstesValleyFireProtectionDistrictshallnotapplywithinthecorporatelimitsoftheTownofEstesParkunlesstheBoardofTrusteesoftheTownadoptsaresolutionstatingthattheFireCodeshallapplywithintheboundariesoftheTown;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisinthebestinterestoftheTowntoadoptaresolutionstatingthattheFireCodeasadoptedbytheEstesValleyFireProtectionDistrictpursuanttoResolutionNo.2015-02oftheFireDistrictshallapplywithinthecorporatelimitsoftheTownofEstesPark.NOW,THEREFORE,BASEDUPONTHERECITALSSETFORTHABOVEWHICHAREINCORPORATEDHEREINBYREFERENCE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOASFOLLOWS:1.The2015InternationalFireCodeincludingAppendixesandAmendmentsasmorefullysetforthinResolutionNo.2015-02oftheEstesValleyFireProtectionDistrictshallapplywithinthecorporatelimitsoftheTownofEstesPark.2.ThisResolutionshalltakeaffectandbeinforceonandafterMay1,2016.Datedthis____________________________ATTEST:2016. C0ESTESVALLEYFIREPROTECTIONDISTRICTRESOLUTIONNO.2015-02ARESOLUTIONOFIREESTESVALLEYFIREPROTECTIONDISTRICTADOPTINGraE2015INTERNATIONALFIRECODEANDCERTAINAPPENDICESANDCERTAINMODIFICATIONSTHERETOREGULATINGANDGOVERNINGCONDiTIONSHAZARDOUSTOLIFEANDPROPERTYFROMFIREOREXPLOSIONANDPROVIDINGFORCERTAINPERMITTINGOFSUCHUSESANDOPERATIONS.‘WHEREAS,theEstesValleyFireProtectionDistrict(“District”)isaquasi-municipalcorporationandpoliticalsubdivisionoftheStateofColoradooperatingpursuanttoArticleI,Title32,CR5.,forthepurposeofprovidingfireprotectionandrescueservices;andWHEREAS,Section32-1-1002(l)(d),C.R.S.,authorizesafireprotectiondistricttoadoptandenforcefirecodes,althoughnosuchfirecodeshallapplywithinanymunicipalityorunincorporatedportionofacountyunlessthemunicipalorcountygoverningbodyadoptsaresolutionstatingthatsuchcodeshallbeapplicablewithinthefireprotectiondistrict’sboundaries;andWHEREAS,theBoardofDirectorsfindsanddeterminesthatitisinthebestinterestoftheresidents,taxpayers,andvisitorsoftheDistricttomaintainadequateandupdatedregulationsbymeansofadoptingbyreferencethe2015editionoftheInternationalFireCodeforapplicationwithintheDistrictforthepurposeofestablishingrulesofconductandstandardsfortheprotectionoflife,health,property,securityandwelfareoftheinhabitantsandpropertyownersoftheDistrict;andWHEREAS,THEBoardofDirectorshasconsideredtheeffectofFireCodeenforcementwithintheboundariesoftheDistrictandhasdeterminedthatenforcementofthe2015InternationalFireCodewouldnotcauseunduehardshiporsuppressionofeconomicgrowthwithintheDistrict.NOW,THEREFORE,beitresolvedbytheBoardofDirectorsoftheEstesValleyFireProtectionDistrictasfollows:AdoptionofInternationalFireCode.TheBoardofDirectorsoftheEstesValleyFireProtectionDistrictherebyadoptsbyreferencethe2015InternationalFireCodeandAppendices,aspublishedbytheInternationalCodeCouncil,asamendedhereby(“InternationalFireCode”),including:AppendixChapters:B(Fire-FlowRequirementsforBuildings);C(FireHydrantLocationsandDistribution);E(HazardCategories);F(HazardRanking);G(CryogenicFluids-WeightandVolumeEquivalents),saveandexceptsuchportionsasarehereinafterdeleted,modified,oramendedbythisResolution,{00470100.DOCX/2) 00forregulatingandgoverningthesafeguardingoflifeandpropertyfromfirearisingfromfireandexplosionhazardsarisingfromthestorage,handlinganduseofhazardoussubstances,materialsanddevices,andfromconditionshazardoustolifeorpropertyintheoccupancyofbuildingsandpremisesintheDistrictandprovidingfortheissuanceofpermitsforhazardoususesoroperations;andeachandalloftheregulations,provisions,conditionsandtermsofsuchInternationalFireCodeonfileintheofficeoftheDistrict,areherebyreferredto,adoptedandmadeaparthereofasiffrllysetoutinthisResolution.Section1.EstablishmentandDutiesofLifeSafetyInspectors.OrganizationalstructureanddutiesoftheLifeSafetyDivisionshallbeasprovidedbytheDistrict’srulesandregulationsandinternalorganizationalstructure.Section2.Definitions.ThefollowingdefinitionsshallbeutilizedinadditiontothosesetforthintheInternationalFireCode:Wherevertheword“jurisdiction”isused,itismeanttobeinclusiveoftheboundariesoftheEstesValleyFireProtectionDistrictastheynowormayhereafterexistWheretheterm“Chief’or“ChiefoftheLifeSafetyDivision”isused,itshallbeheldtomeantheChiefoftheEstesValleyFireProtectionDistrict,ortheDistrictFireMarshalorarepresentativeoftheDistrictdesignatedbytheChiefortheDistrictFireMarshal.Wheretheterm“board”isused,itshallbeheldtomeantheBoardofDirectorsoftheEstesValleyFireProtectionDistrict.Wherevertheterm“InternationalBuildingCode”isused,itshallbeheldtomeantheInternationalBuildingCodeasadopted,amendedandincorporatedintotheLarimerCountyBuildingCodeforunincorporatedportionsofLatimerCountyortheInternationalBuildingCodeasadopted,amendedandincorporatedintotheTownofEstesPark’sBuildingCodewithinitsterritoriallimits.Section3.RevisionstotheInternationalFireCode.ThefollowingsectionsoftheInternationalFireCodeareherebyrevised:(a)Section101.1Title.Insert:EstesValleyFireProtectionDistrictasthe“nameofjutisdiction.”(b)TheseregulationsshallbeknownastheFireCodeoftheEstesValleyFireProtectionDistrict.Hereinafterreferredtoas“thiscode.”(c)ThetitleofSection103shallbeLifeSafetyDivision.{00470100.DOcX/3)MWR2 00(d)Subsection103.1General,isherebyamendedtoreadinitsentiretyasfollows:TheLifeSafetyDivisionisestablishedwithinthejurisdictionunderthedirectionofthefirecodeofficiaLThefunctionoftheDivisionshallbetheimplementation,administrationandenforcementoftheprovisionsofthiscode.(e)Subsection108.1,Boardofappealsestablishedisherebyrepealedandre-enactedtoreadinitsentiretyasfollows:108.1Boardofappealsestablished.Inordertohearanddecideappealsoforders,decisionsordeterminationsmadebythefirecodeofficialrelativetotheapplicationandinterpretationofthiscode,thereshallbeandisherebycreatedaboardofappeals.AppealsshallbeheardbyaboardofappealsofthreemembersoftheBoardofDirectorsoftheEstesValleyFireProtectionDistrictdesignatedannuallybytheboardastheboardofappeals.Thefirecodeofficialshallbeanexofficiomemberofsaidboardbutshallnothaveavoteonanymatterbeforetheboardofappeals.Theboardofappealsshalladoptrulesofprocedureforconductingitsbusiness,andshallrenderalldecisionsandfindingsinwritingtotheappellantwithaduplicatecopytothefirecodeofficial.108.1.1Boardofappealsprocedure.AnappealofaNoticeofViolationorHazardmaybemadetotheboardofappealsbydeliveryofawrittennoticeofappealtotheChiefwithinfivedaysoftheissuanceoftheNoticeofViolationorHazard.TheappealshallbeheardbytheboardofappealsatthenextregularmeetingoftheBoardofDirectors,orataspecialmeetingoftheBoardofDirectorscalledforthatpurpose.Anoticeofappealshallbebasedonclaimthattheintentofthiscodeortheruleslegallyadoptedhereunderhavebeenincorrectlyinterpreted,theprovisionsofthiscodedonotfullyapply,oranequivalentmethodofprotectionorsafetyisproposed.IntheeventnonoticeofappealisfiledandnopetitionforreviewofanyorderisfiledwiththeLarimerCountyDistrictCourtwithinfivedaysafterthemakinganysuchorderpursuanttoSection32-1-1002(3)(c),C.LS.,andcompliancewiththeorderand/orcorrectionofthehazardhasnotoccurred,theChiefmayreferthemattertotheLarimerCountyDistrictAttorney,ortotheTownAttorneyofEstesParkforenforcementandprosecution.(1)Subsection109.4isherebyamendedtoreadinitsentiretyasfollows:109.4VIolationpenalties.Itshallbeunlawfulforanypersontoviolateanyprovisionofthiscodeortofailtocomplywithanyoftherequirementsthereofortoerect,install,alter,repairordoworkinviolationoftheapprovedconstructiondocumentsordirectiveofthefirecodeofficial,orofapermitorcertificateusedunderprovisionsofthiscode.Anypersonwho{OO47OIOCDOCX/Mfl3 CCisfoundguilty,pleadsguiltyorpleadsnobcontenderetoaviolationofthiscodeshallbeguiltyofamisdemeanor,punishablebyafinenottoexceedTwoThousandSixHundredFiftyDollars($2,650.00)inaccordancewithSection1.20.020oftheMunicipalCodeoftheTownofEstesPark,Coloradoasthesamemaybeamendedorincreasedinthefuture,andbyafineinLarimerCountyCourtnottoexceedOneThousandDollars($1,000.00),orbyimprisonmentaspermittedbylawinthejurisdictioninwhichtheviolationoccurs.Eachdaythataviolationcontinuesafterduenoticehasbeensewedshallbedeemedaseparateoffense.Aviolationofanyprovisionofthiscodeisdeclaredtobeaseriousthreattopublichealthandsafety.(g)AnewSubsection109.5isherebyenactedtoreadinitsentiretyasfollows:109.5Workcommencingbeforepermitissuance.Anypersonorfirmwho,beforeobtainingthenecessarypermit(s),commencesanyconsucfionof,orworkon,abuilding,structure,fireprotectionsystem,firealarmsystem,fireextinguishingsystemthatisnototherwiseexemptedfromobtainingapermit,shallbesubjecttoaprocessingandpenaltyfeeinadditiontothestandardprescribedpermitfee.Suchadditionalfeeshallnotbelessthan$25,ormorethan$100forthefirstsuchviolation,Apersonorfirmcommittingthesamesuchviolationrepeatedlyissubjecttoprocessingandpenaltyfeesequaltofourtimestheamountofthepermitfeeforeverysubsequentviolationcommittedthereafterwithinany180-dayperiod.(h)Subsection111.4isherebyamendedtoreadinitsentiretyasfollows:111.4Failuretocomply.Anypersonwhoshallcontinueanyworkafterhavingbeenservedwithastopworkorder,exceptsuchworkasthatpersonisdirectedtoperformtoremoveaviolationorunsafecondition,shallbeliabletoafineasprovidedinSubsection109.4.(i)Subsection113.1isherebyamendedtoreadinitsentiretyasfollows:113.1Fees.Apermitshallnotbeissueduntilthefeeshavebeenpaid,norshallamendmenttoapermitbereleaseduntiltheadditionalfee,ifany,hasbeenpaid.Feesforanypermit,inspections,andservicesauthorizedbythecodeshallbeassetforthaScheduleofFeesinamountsasdeterminedbytheboard,subjecttoamendmentinthediscretionoftheboard.(j)Subsection503.2.2isherebyamendedtoreadinitsentiretyasfollows:(OO47OIOODOCX/3}MWR4 o0503.2.2AuthorIty.Theflrecodeofficialshallhavetheauthoritytorequireorpermitmodificationstotherequiredaccesswidthswheretheyareeitherinadequateoradequateforfireorrescueoperationsorwherenecessary’tomeetthepublicsafetyobjectivesofthejurisdiction.(k)Subsection505.lisherebyamendedtoreadinitsentiretyasfollows:505.1Addressidentification.Newandexistingbuildingsshallbeprovidedwithapprovedaddressidentification.Theaddressidentificationshallbelegibleandplacedinapositionthatisvisiblefromtheskeetorroadfrontingtheproperty.Addressnumbersshallbeilluminatedorreflectiveandshallbeclearlyvisiblefromtherightofway.AddressidentificationcharactersshallbeArabicnumbersoralphabeticalletters.NumbersshallnotbespelledoutEachcharactershallbenotlessthan4incheshighwithaminimumstrokewidthofV2inch.Whererequiredbythefirecodeofficial,addressidentificationsshallbeprovidedinadditionalapprovedlocationstofacilitateemergencyresponse.Whereaccessisbymeansofaprivateroadandthebuildingcannotbeviewedfromthepublicway,amonument,poleorothersignsormeansshallbeusedtoidentifythestructure.Duringconstruction,approvedaddressnumbersshallbedisplayednexttothedrivewayentranceleadingtotheprojectsite.Theprovisionofthissubsectionmaybeappliedretroactivelytoexistingstructures.Addressidentificationshallbemaintained.0)AnewSubsection903.2.13isherebyenactedtoreadinitsentiretyasfollows:903.2.13CD-CommercialDowntownzonedistrict.InanyCD-CommercialDowntownzonedistrict,allnewconstructionandsubstantialimprovements,regardlessofuses,requireapprovedautomaticsprinklersystemsasspecifiedinthissection.Inthiszonedistrict,allnewlyconstructedandsubstantiallyimprovedbuildingsshallbeprotectedwithNFPA13compliantautomaticsprinklersystems.Newconstruction,includesbothinitialdevelopmentandre-development(demolitionandrebuild).Improvementsinclude,butarenotlimitedto,additionsandremodels.Substantialimprovementsareimprovementstobuildingswhichrequirepermitsandwhenthevalueoftheimprovementsexceeds50%ofthepit-improvementvalueofthebuilding.Theprovisionsofthissubsectionareinadditiontoanddonotexemptanyrequirementsforautomaticsprinklersystemscontainedelsewhereinthiscode.(m)Subsection1011.5.],DimensIonreferencesurfaces,isherebyrepealedinitsentirety.{00470100.DOCX/3)MWR 00(n)Subsection1013.2isherebyamendedtoreadinitsentiretyasfollows:1013.2Floor-LevelexitsignsinGroupR-1.WhereexitsignsarerequiredinGroupR-1occupanciesbySection1013.1,additionallow-levelexitsignsshallbeprovidedinallareassewingguestroomsinGroupR-1occupanciesandshallcomplywithSection1013.5Thebottomofthesignshallbenotlessthan10inchesnormorethan12inchesabovethefloorlevel.Thesignshallbeflushmountedtothedoororwall.Wheremountedonthewall,theedgeofthesignshallbewithin4inchesofthedoorframeonthelatchside.Floor-levelexitssignsshallbeprovidedinallcorridorssewingguestroomsofhotelsinGroupR,Division1Occupanciesandshallindicatethepathofexittravel.(o)Subsection1015.8,Windowopenings,isherebyrepealedinitsentirety.(p)Subsection1030.1isherebyamendedtoreadinitsentiretyasfollows:1030JGeneral.Inadditiontothemeansofegressrequiredbythischapter,provisionsshallbemadeforemergencyescapeandrescueopeningsinGroupR-2occupanciesinaccordancewithTable1006.3.2(1)and1006.3,2(2)andGroupR-3occupancies.Basementsandsleepingroomsbelowthefourthstoryabovegradeplaneshallhaveatleastoneexterioremergencyescapeandrescueopeninginaccordancewiththissection.Wherebasementscontainoneormoresleepingrooms,emergencyescapeandrescueopeningsshallberequiredineachsleepingroom,butshallnotberequiredinadjoiningareasofthebasement.Suchopeningsshallopendirectlyintoapublicwayortoayardorcourtthatopenstoapublicway.Exceptions:1.Emergencyescapeandrescueopeningsarenotrequiredfrombasementorsleepingroomsthathaveanexitdoororexitaccessdoorthatopensdirectlyintoapublicwayortoayard,courtorexteriorexitbalconythatopenstoapublicway.(4)Subsection1030.2isherebyamendedtoreadinitsentiretyasfollows;1030.2MinimumSize.Emergencyescapeandrescueopeningsshallhaveaminimumnetclearopeningof5.7squarefeet,Section4.RepealofPriorResolutions.PreviousResolutionsoftheEstesValleyFireProtectionDistrictadoptingearliereditionsofInternationalFireCode,are{OO47OIDODOCX/3)MWR6 00herebyrepealedintheirentiretyimmediatelyupontheEffectiveDateofthisResolutionassetforthinSection9hereof.Section5.Severability,ifanypart,section,subsection,sentence,clauseorphraseofthisResolutionortheInternationalFireCodeadoptedherebyisforanyreasonheldtobeinvalid,suchinvalidityshallnotaffectthevalidityoftheremainingprovisions.TheboardherebydeclaresthatitwouldhavepassedandadoptedthisResolutionandtheInternationalFireCodeadoptedherebyshouldanyothersection,subsection,sentence,clauseorphrasebedeclaredinvalid.ItisfurtherthedeclarationoftheboardthatnoprovisionofthisResolutionorthecodeorstandardsadoptedhereinbeinterpretedinconflictwithStatelawasitnowexistsormaybeamendedinthefuture.IntheeventthereisaconflictbetweenStatelawandthiscode,Statelawshallcontrol.Section6.CopiesonFile.AcopyofthisResolutionandtheInternationalFireCodeadoptedhereinshallbekeptonfileinthebusinessofficeoftheDistrict,andshallbeavailableforpublicinspection.Section7.Repealer.AUresolutions,orpartsthereof,inconflictwiththisResolution,areherebyrepealed,providedthatthissectionshallnotrepealtherepealerclausesofanypriorresolutionsorherebyreviveanyordinancesorresolutionspreviouslyrepealed.Section8.Publication.NoticeoftheadoptionofthisResolutionshallbepublishedintheEstesParkTrailGazetteandafullcopyoftheResolutionasadoptedshallbepostedontheDistrict’swebsite.Section9.EffectiveDate.ThisResolutionshalltakeeffectandmaybeenforceduponitsapprovalbytheDistrict’sBoardofDirectors,andthisResolutionshallbeinfullforceandeffectwithintheTownofEstesParkandunincorporatedportionsofLarimerCountylocatedwithintheDistrict,upontherespectiveadoptionofasimilarresolutionorordinancebysuchotherjurisdiction(s).Untilsuchtimethatasimilarresolutionorordinancehasbeenadoptedinsuchjurisdictions,the2009InternationalFireCodeaspreviouslyadoptedbytheDistrictshallbeandremainenforceableineachjurisdiction.Section10.Authorization.TheofficersoftheDistrictareauthorizedanddirectedtotakeactionsnecessaryandappropriatetoeffecttheprovisionsofthisResolution.(00470100D0CX/3)MWR7
