00RESOLUTIONNO.14-18ACCELERATINGIMPLEMENTATIONOFTHEDOWNTOWNESTESLOOPPROJECTWHEREAS,theColoradoDepartmentofTransportation(“CDOI’)ownsandmaintainsUSHighway36throughtheTownknownasElkhornAvenueandMoraineAvenue;andWHEREAS,theTownistherecipientofagrantfromtheFederalLandsAccessProgram(the“FLAPGrant”)forthepurposefordesigningandconstructingroadimprovementstofacilitatetrafficflowthroughEstesParktoandfromRockyMountainNationalPark(the‘Project”);andWHEREAS,theTownBoardadoptedResolution35-14andapprovedtheIntergovernmentalAgreementwithCDOTwhichprovidedfundingintheamountoffourmillion,twohundredthousanddollars($4,200,000)toassisttheTownwiththedesignandconstructionoftheProject;andWHEREAS,theTownBoardauthorizedtheexecutionbytheTownoftheFederalLandsAccessProgramProjectMemorandumofAgreement(the“Agreement”)amongtheTownofEstesPark,theColoradoDepartmentofTransportation,theNationalParkServiceandCentralFederalLandsHighwayDivision;andWHEREAS,theAgreementrequiredthateachpartytakeactiontofurtherthedevelopmentandconstructionoftheProject;andWHEREAS,pursuanttotheAgreementthefollowingactionsinfurtheranceoftheProjecthavetakenplace:compliancewiththeNationalEnvironmentalPolicyActregulationsincludingpublicationofanEnvironmentalAssessmentandaFindingofNoSignificantImpact,commencementofpropertyacquisitionsincludingofferstopurchasespecificlandparcels,advancementofthefinaldesigndrawingsto70%completion,andcoordinationforrelocationofburiedutilitysystems;andWHEREAS,onsixseparateoccasions(March26,2013;February28,2014;December9,2014;April15,2015;November29,2016;andMarch13,2018)theTownBoardvotedinfavorofmovingforwardwithspecificphasesoftheProject;andWHEREAS,recentquestionsfromTrusteesregardingtheconsequencesoftheTownwithdrawingitssupportfromtheProjecthavecausedCDOTtosuspendworkontherightofwayacquisitionfortheProject.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheTownofEstesParkaffirmsthecommunitysupportoftheProject,requeststheColoradoDepartmentofTransportationaccelerateacquisitionoftherightsofwayneededtoaccomplishtheproject,andrequeststheProgramingDecisionCommitteeof CC)theCentralFederalLandsHighwayDivisionmoveforwardtheFLAPgrantfundingfrom2021/2022to2019/2020toacceleratecompletionoftheproject.ADOPTEDthis10thdayofJuly,2018.MayorATTEST:-pClerk
