AN ORDINANCE APPROVING THE ELKHORN LODGE PHASE 11 ANNEXATION
WHEREAS, the Town of Estes Park has received a petition, signed by the owners
of one hundred percent of the area proposed to be annexed, for the Elkhorn Lodge Phase
II Annexation (Annexation), for the land described in Exhibit A; and
WHEREAS, the Town Board of Trustees has before it an annexation agreement
concerning the conditions for annexing the property; and
WHEREAS, the Town Board has approved resolutions regarding this annexation's
compliance with state statutes governing annexation procedures.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK, COLORADO AS FOLLOWS:
Section 1. The Annexation meets all statutory requirements and is approved.
Upon final execution of the annexation agreement and completion of all procedural
requirements within one year of the approval of this ordinance, the property is annexed
to the Town of Estes Park.
Section 2. The Board approves, and authorizes the Mayor to sign, the annexation
agreement in substantially the form now before the Board. Future amendments to the
agreement may be approved by resolution or motion.
Section 3. Pursuant to section 37-45-136(3.6), C.R.S., the Town consents to the
inclusion of the property into the Northern Colorado Water Conservancy District and its
Municipal Subdistrict, when the annexation becomes effective.
Section 4. The effective date of this annexation shall be the date this ordinance,
the annexation map(s), and the annexation agreement are recorded with the County Clerk
and Recorder.
Section 5. To the extent only that they conflict with this ordinance, any conflicting
ordinances or parts of ordinances are repealed.
PASSED AND ADOPTED by the Board of Trustees of the Town of Estes Park,
Colorado this 27th day of January, 2026.
