ORDINANCE NO. 13-25
AN ORDINANCE CONSENTING TO THE INCLUSION OF CERTAIN
PROPERTIES LOCATED WITHIN THE TOWN OF ESTES PARK INTO THE
IVIUNICIPAL SUBDISTRICT, NORTHERN COLORADO
WATER CONSERVANCY DISTRICT
WHEREAS, the Town of Estes Park is the holder of three (3) units of
Windy Gap water under the Rules and Regulations of the Municipal Subdistrict,
Northern Colorado Conservancy District (the "Subdistrict"); and
WHEREAS, certain properties located within the Town of Estes Park
have inadvertently not been included within the boundaries of the Subdistrict;
and
WHEREAS, it is necessary for the Town of Estes Park to consent to the
inclusion of said properties within the Subdistrict, pursuant to the provisions of
section 37-45- 136(3.6) C.R.S; and
WHEREAS, the Town Board wishes to use the provisions of section 37-
45- 136(3.6) C.R.S., to consent to the inclusion of those properties within the
Subdistrict, which properties were not included at the time of annexation of the
property to the Town of Estes Park.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK, COLORADO AS FOLLOWS:
Section 1: Pursuant to the provisions of section 37-45-136(3.6) C.R.S,
the Board of Trustees of the Town of Estes Park hereby consents to the
inclusion of the properties set forth on Exhibit "A" attached hereto and
incorporated herein by reference within the boundaries of the Subdistrict.
Section 2: The Board of Trustees hereby authorizes the Utilities Director
or designee to file the necessary documents for inclusion of the lands as set
forth on Exhibit "A" and pay all fees necessary to accomplish the inclusion of
the lands within the Subdistrict.
Section 3: This Ordinance shall take effect and be enforced thirty (30)
days after its adoption and publication by title.
PASSED AND ADOPTED by the Board of Trustees of the Town of Estes Park,
Colorado this 8TH day of JULY, 2025.

AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN TERRITORY TO
THE TOWN OF ESTES PARK, COLORADO, TO BE KNOWN AND DESIGNATED AS
CLOUD NINE SUBDIVISION ADDITION
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
Section 1. That a Petition for Annexation, together with four (4) copies of the plat of
said area as required by law, was filed with the Board of Tmstees on the 23th day of
January, 2017 by the landowners of one hundred percent (100%) of the area and owning
one hundred percent (100%) of the area, excluding public streets and alleys of the area
hereinafter described. The Board, by Resolution at its regular meeting on the 28th day of
February, 2017, accepted said Petition and found and determined that the provisions of
Section 31-12-107(1), C.R.S., were met; and the Board further determined that the Town
Board should consider the annexation plat on Tuesday, March 28,2017 at 7:00 p.m. in the
Municipal Building for the purposes of determining that the proposed annexation complies
with the applicable provisions of Sections 31-12-104 and 31-12-105, C.R.S., and is
considered eligible for annexation.
Section 2. That the Notice of said hearing was given and published as provided in
Section 31-12-108(2), C.R.S.
Section 3. That the hearing was held pursuant to the provisions of Section 31-12-
109, C.R.S., on the 28th day of March, 2017.

determining that the proposed annexation met the requirements of the applicable parts of

AN ORDINANCE APPROVING THE ANNEXATION OF
CERTAIN ENCLAVES WITHIN THE TOWN OF ESTES PARK,
COLORADO, TO BE KNOWN AS:
LEXINGTON LANE ADDITION,
SILVER LANE STABLES ADDITION,
ICE OF ESTES ADDITION
GADECKI ADDITION AND
BURKE-ALLEN ADDITION
WHEREAS, there exists certain enclave properties which have not been
annexed to the Town; and the Town desires to annex these enclaves.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK. COLORADO.
Section 1: The property more fully described in Section 5 below are enclaves
within the Town of Estes Park due to the fact that the individual properties are entirely
contained within the outer boundaries of the Town of Estes Park.
Section 2: The individual properties have been surrounded by the boundaries of
the Town of Estes Park for a period of not less than 3 years.
Section 3: Notice as required by Section 31-12-106 (1), C.R.S.. was published
as provided in said Section.
Section 4: No additional terms or conditions are to be imposed upon the
annexation of the properties.

AN ORDINANCE APPROVING THE ANNEXATION
OF CERTAIN TERRITORY TO THE
TOWN OF ESTES PARK, COLORADO,
TO BE KNOWN AND DESIGNATED AS
CARLSON ADDITION
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
Section 1. That a Petition for Annexation, together with four (4) copies of the plat of
said area as required by law. was filed with the Board of Tmstees on the :27th_day of July,
2001 by the landowners of one hundred percent (100%) of the area and owning one
hundred percent (100%) of the area, excluding public streets and alleys of the area
hereinafter described. The Board, by Resolution at its regular meeting on the 14th day of
August. 2001. accepted said Petition and found and determined that the provisions of
Section 31-12-107(1), C.R.S., were met; and the Board further determined that the Town
Board should consider the annexation plat on Tuesday, September 25, 2001 at 7:00 p.m.
in the Municipal Building for the purposes of determining that the proposed annexation
complies with the applicable provisions of Sections 31-12-104 and 31-12-105, C.R.S., and
is considered eligible for annexation.

BE FT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
Section 1. That a Petition for Annexation, together with four (4) copies of the plat of
said area as required by law, was originally filed with the Board of Trustees on the 24th day
of August, 1999, and was modified on November 23, 1999 by the landowners of one
hundred percent (100%) of the area and owning one hundred percent (100%) of the area,
excluding public streets and alleys of the area hereinafter described. The Board, by
Resolution at its regular meeting on the 23 day of November, 1999, accepted said
Modified Petition and found and determined that the provisions of Section 31-12-107(1),

AN ORDINANCE APPROVING THE ANNEXATION OF
CERTAIN TERRITORY TO THE TOWN OF ESTES PARK,
COLORADO, TO BE KNOWN AND DESIGNATED AS
CARRIAGE HILLS ADDITION
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
Section 1: That a Petition for Annexation, together with
four (4) copies of the plat of said area, as required by law, was
filed with the Board of Trustees on the 23rd day of April, 1991,
by the landowners of more than fifty percent (50%) of the area,
excluding public streets and alleys, of the area hereinafter
described. The Board, by Resolution at a regular meeting on the
23rd day of April/ 1991, accepted said Petition and found and
determined that the provisions of Section 31-12-107(1), C.R.S.,
were met; and the Board further determined that a public hearing
should be held on May 28, 1991 at 7:30 P.M. in the Municipal
Building for the purpose of determining that the proposed
annexation complies with the applicable provisions of Sections
31-12-104 and 31-12-105, C.R.S., and is considered eligible for
annexation.
Section 2: That the Notice of said Hearing was given and
published as provided in Section 31-12-108, C.R.S.
Section 3: That the Hearing was held pursuant to the
provisions of Section 31-12-109, C.R.S., on this 28th day of May,
1991.
Section 4; That following said Hearing, the Board of
Trustees adopted a Resolution determining that the proposed
annexation met the requirements of the applicable parts of
Section 31-12-104 and 31-12-105, C.R.S.; and that an election was
not required under Section 31-12t-107 (2) , C.R.S.
Section 5: The annexation;is not subject to any additional
terms and conditions
Section 6; That the .anneaciafcion of the following described
area designated as CARRIAGB BI$L^ ADDITION to the Town of Estes
Park, Colorado, is hereby approved?
CARRIAGE HILLS ADDITION to the Town of Estes Park, Colorado
being a portion of the NWi of the NWi of Section 6, Township 4
North, Range 72 West of the 6th P.M. and a portion of the NEi,
the SEk of the NWi, the NE} of the SWi of Section I, Township 4
North, Range 73 West of the 6th P.M., being more particularly
described as follows:
Exhibit "A" attached hereto and incorporated herein by
reference.
Section 7: The Town of Estes Park, Colorado hereby
consents pursuant to Section 37-45-136(3.6) C.R.S., to the
inclusion of the lands described above into the Northern Colorado
Water conservancy District and the Municipal Subdistrict, Northern
Colorado Water Conservancy District.
Section 8: This Ordinance shall take effect and be
enforced thirty (30) days after its adoption and publication.

and owning more than fifty percent (50%) of the area, excluding

April, 1982, accepted said Petition and found and determined
that the provisions of Section 31-12-107 (1) (g), C.R.S 1973, as
amended, were met; and the Board further determined that a public
hearing should be held on June 8, 1982, at 7:30 P.M. in the
Municipal. Building for the purpose .of determining that the proposed
annexation complies with the applicable provisions of Sections

in force immediately after its passage, adoption and signature
of the Mayor.

AN ORDINANCE ANNEXING CERTAIN TERRITORY
TO THE TOWN OF ESTES PARK, COLORADO, TOBE KNOWN AND DESIGNATED AS "FALL RIVERADDITION" TO THE TOWN OF ESTES PARK,
COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK, COLORADO:
Section 1. That -the Board of Trustees of the Town
of Estes Park, Colorado, by Resolution adopted April 23,
1973, found the Petitions seeking the annexation of the
territory described belowwere in substantial compliance with
•the provisions of Section 159-21-6 (1) of Colorado Revised
Statutes, 1965, as amended. After notice and hearing as
provided by law, the Board of Trustees of the Town of Estes
Park, on May 28, 1975, adopted by Resolution its findings of
fact and conclusions in reference to such proposed annexation;
by such Resolution, the Board of Trustees determined the pro-
posed annexation complied with the applicable provisions of
Sections 139-21-5 and 139-21-4 of Colorado Revised Statutes,
1963, as amended. It further found that no additional terms
or conditions were to be imposed upon said territory, and tha-t
an election was not required under the provisions of Section
•139-21-6 (2) of said statutes.
Section 2. That the annexation to the Town of Estes
Park, Colorado of the following described territory, -to be
known and designated as "Fall River Additiori' to the Town of
Estes Park, Colorado is hereby approved:

of the Board of Trustees an emergency exists, this ordinance
shall take effect and be in force five (5) days after its
final passage, adoption and publication.
