AN ORDINANCE TO LEASE LOT 4, ELM ROAD 2ND ADDITION,
TO THE PLATTE RIVER POWER AUTHORITY
WHEREAS, the Platte River Power Authority desires to lease land to site utility
scale batteries; and
WHEREAS, the Town has land appropriate for this use, namely a portion of
Lot 4, Elm Road 2nd Addition (Property); and
WHEREAS, section 31-15-713, C.R.S., requires that all leases of municipal
property for longer than one year be in the public interest and approved by ordinance;
and
WHEREAS, the Board of Trustees determines that leasing the Property for the
stated purposes is in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE TOWN OF ESTES PARK, COLORADO AS FOLLOWS:
Section 1: The Board approves, and authorizes the Mayor to sign, a lease of the
Property to the Platte River Power Authority in substantially the form now before the
Board.
Section 2: To the extent only that they conflict with this Ordinance, the Board
repeals any conflicting ordinances or parts of ordinances. The provisions of this
Ordinance are severable, and invalidity of any part shall not affect the validity or
effectiveness of the rest of this Ordinance.
Section 3: This Ordinance shall take effect and be enforced thirty (30) days after
its adoption and publication.
PASSED AND ADOPTED by the Board of Trustees of the Town of Estes Park,
Colorado this 24TH day of JUNE, 2025.
