RULE AND ORDER
THIS MATTER came before the Court this day upon a Stipulation and Consent to EntryofRuleandOrderenteredintobetweenPlaintiffThomasE.Dreiss and Defendants Robert WellsJohnson,Diane Rae Krotter,and the Estate of Mark Musick Krotter,by and through KarenGaineraspersonalrepresentative(the “Parties”),with respect to the property that is the subjectmatterofthisaction(the “Property”),said Stipulation and Consent being duly executed by thepersonsinterestedasownersoftheProperty,and those otherwise interested of record;and itappearingtotheCourtfromsaidStipulationandConsentandtheotherpleadingshereinthatsaidpersonsaretherecordowners.
THE COURT FINDS AS FOLLOWS:
1.It has full and complete jurisdiction of the subject matter of this action and thePartiesthereto.
2.That service has been made upon all interested Parties as required by law.
3.Thomas E.Dreiss (“Dreiss”),Robert Wells Johnson (“Johnson”),Diane RaeKrotter(“Krotter”),and Mark Musick Krotter are the owners of record of the Property,Dreiss,Johnson,Krotter,and the Estate hold the Property as tenants in common (the “Tenants inCommon”).Mark Musick Krotter is deceased and,consequently,the Estate of Mark MusickKrotter,by and through Karen Gainer as personal representative (the “Estate”),has beensubstitutedastherealpartyininterest.

Lot 4,Section 3,Township 4 North,Range 73 West of the 6th PM,except portion thereof conveyed in Book 1147 at Page 51 of theLarimerCountyrecords.
5.On November 30,2006,Plaintiff Thomas E.Dreiss and Defendant Robert WellsJohnsonprovidedaJointNoticetotheLarimerCountyBoardofCountyConimissioners-”Pursuant to C.R.S.§30-28-101(l0)(C)(II).
6,The Parties have jointly filed a Stipulation and Consent to Entry of a Rule andO’der to Partition he Propety.
NOW,THEREFORE,IT IS ORDERED,ADJUDGED,and DECREED AS FOLLOWS:
1.The Property is hereby partitioned pursuant to C.R.S.§38-28-110 as described inExhibit1attachedheretoandincorporatedhereinbyreference.
2.Mr.Dreiss takes sole fee simple title to the parcel described in Exhibit 1.
3.Mr.Dreiss shall have no right,title or interest in or to any of the other portions oftheProperty.
4.Johnson,Krotter,and the Estate (the “Remaining Parties”)shall continue to owntheProperty,excluding the parcel described in Exhibit 1,as tenants in common,with eachowninganundivided113rdinterest.
5.The Court is advised that the Remaining Parties are engaged in negotiationsregardingthedispositionoftheirrespectiveinterestsinthePropertyaswellasadjacentpropertywhichiscommonlyowned.
6.The Remaining Parties are directed to file with the Court,no later than March 15,2008,a stipulation regarding the disposition of their interests,if any,in the Property.
7.Dreis shall convey to Krotter/Johnson Family Cabins,LLC,by Special WarrantyDeed,those certain easement rights previously conveyed to Dreiss by Alison Krotter Johnson onoraboutOctober24,2004.
8.Neither the Parties to this action,nor their heirs,successors,or assigns,shall buildorcausetohebuiltanyimprovementsontheProperty,including without limitation,buildings,structures,roads,utilities,water lines,sewage facilities,or fences on or before August 1,2014.
9.A certified copy of this Rule and Order with Exhibit 1 shall be recorded andindexedintheofficeoftheClerkandRecorderof’Larimer County,in like manner and with likeeftbctasiftheywereadeedofconveyancefromtheTenantsinCommonconveyingtheparceldescribedinExhibitItoThomasB.Dreiss.
10.The counterclaims against Mr.Dreiss are hereby dismissed with prejudice andMr.Drciss is dismissed from the case.
11.The Parties shall each bear their own costs and attorneys fees incurred in thisaction.
