HomeMy WebLinkAboutVARIANCE 1224 CHASM LN DATE UNKNOWN DATE: February 6, 2000 REQUEST: A request by George Young for a variance from the 50-foot side yard setback as required in the “RE-1” Rural Estate zoning district (10-acre). LOCATION: 1224 Chasm Lane, within the unincorporated Estes Valley (see Attachment A). FILE #: 1224 Chasm Lane - YOUNG, George STAFF FINDINGS AND RECOMMENDATION: The applicant, George Young, requests a variance to Table 4-2 “Base Density and Dimensional Standards” for the “RE-1” Rural Estate District of the Estes Valley Development Code to allow a side yard setback of 39-feet in lieu of the 50-feet required. The applicant proposes to expand an existing cabin that was built with a 30-foot setback prior to setback requirements. Approval would not change the status as a legal-nonconforming structure. This request has been submitted to all applicable reviewing agency staff for consideration and comment. No significant issues or concerns were expressed by reviewing staff relative to code compliance or the provision of public services, though the Larimer County Building Department had comments related to wildfire hazard and foundation construction. Special circumstances exist in that the existing structure was built prior to adoption of building setbacks, and is now in a 10-acre zoning district that requires 50-foot setbacks. The lot is only .974-acres. The requested variance is not substantial relative to existing conditions. The essential character of the neighborhood would remain the same. If the applicant were to raze the cabin and rebuild completely within the building setback lines, the additional site disturbance and removal of trees might have a greater change in the visual character of the neighborhood compared to the proposed addition. The variance would not adversely affect the delivery of public services. The cabin has been in the Young family since construction. The setback requirements have been implemented since that time. The requested variance represents the least deviation from the regulations that will afford relief. RECOMMENDATION: Therefore, Staff recommends APPROVAL of the requested variance to Table 4-2 “Base Density and Dimensional Standards” for the “RE-1” Rural Estate District of the Estes Valley Development Code CONDITIONAL TO: Prior to pouring foundation, submittal of a setback certificate prepared by a certified engineer, surveyor, or architect. Full Compliance with the submitted site plan for Lot 1, Amended Plat of Lot 11 and a portion of Lot 12, McCreery Subdivision. The addition should be designed to be totally self-supporting, or a Colorado Registered Engineer must be involved in the new structure design. The Larimer County Wildfire Hazards Coordinator shall review the submitted plans for compliance with applicable regulations.
