I understood this information was forwarded previously and that was my misunderstanding. After review of the information provided by Community Development, the Town Clerk’s office has determined the vacation home licensing fee and workforce housing regulatory linkage fee as codified would apply to these individually owned units. After you have had a chance to review the information below and please let me know what additional questions you may have regarding the property. Community Developments Review: The following information was provided by Community Development in its review of the Mountain Village project to determine its use through the development approval process.The development record references both accommodation use and owner occupancy use. But it appears this was to provide flexibility for the cabin owners purchasing the individual residential units.Property is zoned A, Accommodations. This zoning district allows both household living and accommodation uses.For the portion of the property containing the cabins, a Development Plan was approved June 2017, a preliminary plat was approved July 2017, and a final plat was approved December 2017. Application materials from the Planning Commission and Town Board packets, and minutes related to these applications were reviewed by the current Planning staff, see below. From a review of the documents, the terms single-family homes, townhomes, and accommodation units are used at various points to describe the cabins. However, density was calculated using single-family criteria (9,000 SF) and not accommodations (1,800 SF) nor cabin (5,400 SF).The statement of intent (preliminary plat) references the applicant’s desire to provide vacation rentals but also the ability to allow owner occupancy. Staff did not find a plan note or condition of approval that stated Mountain Village would be limited to accommodation uses (as was done with Solitude Cabins). This is a marked difference between the two developments.This ends up being a significant distinction from Solitude Cabins, which restricted the development to accommodations only through theDevelopment Plan. As such, given staff could not find a similar restriction on use for Mountain Village, and given the indication that they wanted to allow residential use, it appears the individually owned cabin would be subject to the vacation home and workforce housing regulatory linkage fees. If the development wanted to avoid the fees, then it would be suggested that it follow Solitude Cabin's example, and amend their Development Plan to limit use of the cabins to accommodations only.
