Dear Mr, Nordic:
I am writing; as a follow up to our October 7, 1994 punch list at the above referenced
project. Some items still remain deficient and with spring weather at hand we would like
to see then completed.. Also, as noted in that letter,. the subdivision and imprOVements
can not be placed under their one year v,..arratitee until these items are resolved. Please
refer to the attached copy for a list of those items 4's 1, 2, 6 and 11. Included in 4:6 are.
tracked -heavy ,equipment marks.A-Number 11 has now become more critical from
channelized storm Water and comments. from the new home owner down hill.

EASEMENT AGREEMENT
This Agreement, entered into this 22nd day of August
1994, between Sharon E. Nordick (Nordick), and Eddie G. TuJly and
Francis 1 Tully (Tully) is as follows:
1. A driveway has been constructed across a portion of Lot 5,
The Crags Subdivision, Latimer County, Colorado, as described upon
exhibit A which. is attached hereto and incorporated by this
reference, from Audubon Street within said Subdivision. Said
driveway is for the purpose of providing both access and utility
easements for Lot 4 of said Subdivision, and the use thereof for
said utility purposes is also reserved unto Lot 5.
2. The owners of said Lot 5 hereby acknowledge and grant to
the owners of Lot 4 said ingress/egress driveway easement and
utility easement.
3. Said Lot 4 shall have no other arces to Audubon Street.
4. The owner of Lot 4 shall provide for the maintenance of
the driveway, together with snnw remnval therefrom.
5. The owner of Lot 5 shall have the right to use the portion
of his lot across which this easement is located in. any manner so
long as such use does not interfere with this easement and the
rights herein set forth.
6. The undersigned parties further agree that: Any utilities
installed in this easement shall he undergroimd and the party
installing the same shall be responsible f cir. the expense thereof
and shall restore thesurface at his expense; both the access and
utility easement shall be used for single-family dwelling purposes
only; and this easement may not: be used by any other property or
the owners thereef

LIFE SAFE

r: 24. The top of handrails shall be placed not less than 34
inches, or more than 38 inches above the nosing. Ends
shall be returned or shall terminate in newel post or

25. Basements in dwellings and every sleeping room below the
fourth story shall have at least one operable window or
door approved for emergency escape or rescue. Section
1204 UBC.
26. Smoke detectors shall receive their primary power from
the building wiring and shall be equipped with battery

MECHANICAL
