S-I 17-87 Property owner: The Lone L.Bond Trust 16957 West 73rd Place Arvada,CO 80007 The 1.64 acre property is Zoned RE-Rural Estate (2.5 acre mm.)with setbacks of 50’on all sides. The front (south side)of the house footprint has changed very little since being built by Lone’s grandfather in 1957 (Van Horn Engineering prepared a survey in 1983 showing virtually the same size of structure),so the change in the designated zoning from accommodations to rural estate which occurred in 2000,automatically created non-compliancy of setbacks as well as lot size for this tract and most of the others in the area.Had the property been zoned E-1,(1 acre mm.),the required setbacks would be 25’all around and the proposed addition would easily comply.In addition to the lot being smaller than the minimum area of the RE zoning,the entire existing house is non- compliant to the road easement setback along Baker Drive in front of the house.Philip and Lone Bond are requesting a variance from Table 4-2,Residential Zoning Districts Dimensional Standards, of the Estes Valley Development Code.They propose to build a garage of which the southwest corner will lie 30.0’from the southwesterly property line. Review Criteria: a.Whether there can he any benefIcial use of the property without the variance;the existing garage is not much longer than the owner’s vehicle and hard to access due to the rock wall and steep slope out in front of the garage to the west,making it virtually unusable for parking cars. b.Whether the variance is substantial;the request asks for a 40%reduction of the setback -as proposed the south west garage corner will fall just over 30 feet from the property line instead of the required 50 feet,but this is less of an encroachment into the building setback than the front of the house which lies an average of 13’from the access easement running east-west along the south side of the house. c.Whether the essential character o/the neighborhood would he substantially altered or whether adjoining properties would suffer a substantial detriment as a result of the variance;the proposed garage addition will he no higher than the existing house,built into the hillside,and will allow the owners’vehicles to be parked inside out of view of neighboring properties and Highway 7,thus being not a detriment to the character of the neighborhood but rather an asset. d.Whether the variance would adversely ui/Cc!the delivery of public services such as water and sewer.No utilities will be affected by the proposed placement of the addition. e.Whether the Applicant purchased the property with knowledge of the requirement;the property has been in the family for many years (a Van Horn Engineering survey showed the existing house in place in 1983)-long before the current EVDC was adopted.The current owners inherited the house and believed the southerly property line to fall further to the south. f.Whether the Applicant ‘s predicament can he mitigated through some method other than a variance;No addition may be attached to the existing house without first obtaining a variance.
