Chair Amos called the Study Session to order at 3:30 p.m.
Minutes of the Febiuaiy 10,1999 meeting were accepted as presented.
Chair Amos opened discussion on the chapters under review of the draft Estes Valiey
Development Code.
CHAPTER 9: PLANNED UNIT DEVELOPMENTS

Housing in the downtown area was discussed as recommended by EPURA and
included in the Comprehensive Plan. Commissioners expressed concern that
additional housing in the downtown area should only happen after the parking
problem was resolved.
CHAPTER 12: APPEALS & ENFORCEMENT
Town Attorney Greg White reviewed the current steps with a zoning violation. It
currently can be a lengthy process to effect any enforcement. The consultant has
attempted to come up with a quicker procedure that give a due process hearing.
This chapter will have to be reviewed with the County Attorney because the Town
of Estes Park is a statutory town and Larimer is a statutory county.

Town Attorney White will review other examples of fines. Criminal fines will
probably not be included. The current procedure of initially advising the person of
the violation will be continued. Only when no correction is made will enforcement
through the court be pursued.
CONCLUSION
Staff review and legal review will take place in the next couple of weeks. The next
scheduled meeting to review the entire draft will be on March 24, 1999. That
meeting is scheduled from 3:30 p.m. until 8:30 p.m. with a dinner break.
On April 14, 1999, there will be a joint session of the Town Trustees and County
Commissioners to discuss the adoption schedule and procedure for the Estes Valley
Development Code.
Town Attorney Greg White advised the commissioners that in dealing with the
language of the code, it was acceptable to discuss general philosophical principals,
but it was not appropriate to discuss specific properties. By prejudicing themselves
would prevent them from sitting on the Board. Those with specific concerns can
address the staff, public hearings or letters to the chair. If 3 or more commissioners
get together to discuss the code, it must be a public meeting with a 24-hour public
notice.
