HomeMy WebLinkAboutDECLARATION First Supplement The Meadows at Wildfire Condominiums 2022-04-11RECEPTION #20220024986,4119/2022 12:19:34 PM, 1 ot4,$28.00 Angela Myers,Clerk &Recorder,Lanmer County CO FIRST SUPPLEMENT TO THE DECLARATION OF THE MEADOWS AT WILDFIfflE CONDOMINIUMS, A CONDOMINIUM COMMUNITY (Building E) THIS FIRST SUPPLEMENT TO THE DECLARATION Of THE MEADOWS AT WILDFIRE CONDOMINIUMS,is made on the date hereinafter set forth by Wildfire Homes, LLLC a Colorado limited liability company,whose principal address is 530 fox Creek Rd.,Glen Haven,CO $0532 (“Declarant”). RECITALS A.Declarant is the Declarant under that certain Declaration of the Meadows at Wildfire Condominiums,a Condominium Community,a copy of which was recorded on January 20,2022,at Reception Number 20220004734 in the records of the Larimer County Clerk and Recorder (the “Declaration”). B.Pursuant to Section 7.1(a)and Section 10.4 of the Declaration,Declarant reserved the right to convert Common Elements into Units. C.Declarant desires to create additional units consisting of Building E,Units 201,202, 203,204,301,302,303,304 and Garage Units 201,202,203,204,301,302,303,and 304 (collectively the “New Units”). D.Declarant wishes to make the New Units subject to the Declaration. E.Pursuant to Section 3.5 of the Declaration,Declarant reserved the right to amend the percentage of liability for Common Expenses with the addition of new Units. F.All capitalized terms used herein shall have the same meaning ascribed to such terms in the Declaration unless otherwise defined herein. DECLARATIONS Declarant hereby declares that the New Units shall be held,sold and conveyed subject to the Declaration and the following covenants,conditions,restrictions and easements which shall run with the land and be binding on all parties and heirs,successors and assigns of parties having any right,title or interest in all or any part of the Property.Additionally,Declarant hereby submits the New Units to the provisions of the Act. 1.Map;Units.Pursuant to the Declaration,Declarant has recorded the First Supplemental Map of the Meadows at Wildfire Condominiums together herewith establishing and describing the New Units,which New Units are hereby subjected to the Declaration. ,.-.- I -Ji%J.-3;•1 --— _____ 2.Number of Units and Allocated Interests.The number of Units and the percentage share of the Common Expenses allocated to each Unit are set forth in Exhibit A attached hereto. Nothing herein shall amend the percentage of ownership interest of the Common Elements or the number of votes in the Association as set forth in Section 3.5(a)and Section 3.5(c)of the Declaration. 3.Description of Units.Any contract of sale,deed,lease,Mortgage,will or other instrument affecting a Unit shall describe it by its Unit and Building number substantially as follows: “Condominium Unit ___________ Building _____, The Meadows at Wildfire Condominiums,according to the Declaration recorded January 20,2022,at Reception No.20220004734,as amended,the Condominium Map recorded on January 25,2022 at Reception No.20220005679,and the First Supplemental Map recorded on ________________________, at Reception No. _________________, in the records of the Larimer County Clerk and Recorder. 4.Easements.The Property shall be subject to all easements as shown on any Map of the Condominium,those of record,those provided in the Act and otherwise as set forth in the Declaration.
